A market hog was not sufficiently stunned <strong>to</strong> ensure immediate unconsciousness. The captive bolt opera<strong>to</strong>r<br />

failed <strong>to</strong> correctly stun the animal <strong>in</strong> such a manner <strong>to</strong> render the hog unconscious with a m<strong>in</strong>imum <strong>of</strong><br />

excitement and discomfort. Allow<strong>in</strong>g this animal <strong>to</strong> rema<strong>in</strong> conscious after stunn<strong>in</strong>g was egregiously <strong>in</strong>humane.<br />

In the NOS, <strong>FSIS</strong> requested the follow<strong>in</strong>g <strong>in</strong>formation <strong>in</strong> order for slaughter operations <strong>to</strong> resume at your<br />

establishment.<br />

1. Identify the specific reason(s) why the event occurred.<br />

2. Describe the specific actions that will be taken <strong>to</strong> elim<strong>in</strong>ate the cause <strong>of</strong> the <strong>in</strong>cident and prevent<br />

future recurrences.<br />

3. Describe the future moni<strong>to</strong>r<strong>in</strong>g activities that your establishment will use <strong>to</strong> ensure that the actions are<br />

effective.<br />

On September 20, 2013, at 1336 and 1342 hours this <strong>of</strong>fice received 2 written responses via electronic mail<br />

addressed <strong>to</strong> Dr. Kamail Mudahar. The response <strong>in</strong>cluded: a letter describ<strong>in</strong>g your corrective actions <strong>in</strong><br />

response <strong>to</strong> the <strong>in</strong>cident; a copy <strong>of</strong> your revised Captive Bolt Gun Tra<strong>in</strong><strong>in</strong>g SOP-152; and a copy <strong>of</strong> your<br />

tra<strong>in</strong><strong>in</strong>g sign <strong>of</strong>f sheet document<strong>in</strong>g that all bam employees received tra<strong>in</strong><strong>in</strong>g and they unders<strong>to</strong>od the new<br />

procedures.<br />

Your letter acknowledged the egregious act committed by one <strong>of</strong> your employees when they failed <strong>to</strong><br />

adequately render an unrestra<strong>in</strong>ed, non-ambula<strong>to</strong>ry hog <strong>in</strong>sensible with a captive bolt stunner and failure <strong>to</strong><br />

comply with the Humane Methods <strong>of</strong> Slaughter Act <strong>of</strong> 1978 (HMSA). Your response also <strong>in</strong>cluded a copy <strong>of</strong><br />

your revised Captive Bolt Gun Tra<strong>in</strong><strong>in</strong>g SOP-152 stat<strong>in</strong>g that two (2) loaded captive bolt guns and two (2)<br />

employees will be present when carry<strong>in</strong>g out the task <strong>of</strong> captive bolt stunn<strong>in</strong>g. Additionally, your response<br />

states one <strong>of</strong> the employees will use a sort board <strong>to</strong> properly restra<strong>in</strong> the animal so the task can be carried out<br />

successfully by the other employee; the bolt gun will be f<strong>in</strong>nly placed flush aga<strong>in</strong>st the forehead <strong>of</strong> the animal;<br />

after discharge the animal must be rendered <strong>in</strong>sensible and if not, the other captive bolt gun will be used <strong>to</strong><br />

render the animal <strong>in</strong>sensible; and quarterly humane handl<strong>in</strong>g and captive bolt gun stunn<strong>in</strong>g tra<strong>in</strong><strong>in</strong>g for animal<br />

handlers. Your response also <strong>in</strong>cluded a tra<strong>in</strong><strong>in</strong>g sign-<strong>of</strong>f sheet document<strong>in</strong>g that all barn employees have been<br />

tra<strong>in</strong>ed <strong>in</strong> your new procedures.<br />

On September 20, 2013, at 1430 hours, this <strong>of</strong>fice <strong>in</strong>itiated a conference call with you <strong>to</strong> discuss your response<br />

and request additional clarification with regard <strong>to</strong> development and moni<strong>to</strong>r<strong>in</strong>g <strong>of</strong> a robust systematic approach<br />

<strong>to</strong> humane handl<strong>in</strong>g.<br />

On September 20, 2013, at 1512 hours, this <strong>of</strong>fice received a revised written response <strong>from</strong> your establishment<br />

<strong>in</strong> which you provided additional clarification and procedures you implemented as part <strong>of</strong> a robust systematic<br />

animal welfare program. Your response <strong>in</strong>cluded procedures for verify<strong>in</strong>g and document<strong>in</strong>g your new<br />

procedures by your Lives<strong>to</strong>ck Manager and/or Leader and <strong>in</strong>creased the frequency <strong>of</strong> your refresher tra<strong>in</strong><strong>in</strong>g<br />

<strong>from</strong> quarterly <strong>to</strong> monthly for your bam employees. Subsequently, you were verbally notified by this <strong>of</strong>fice that<br />

the <strong>Suspension</strong> <strong>of</strong>the assignment <strong>of</strong> <strong>in</strong>spec<strong>to</strong>rs was be<strong>in</strong>g placed <strong>in</strong> <strong>Abeyance</strong>.<br />

This letter serves as written notification that <strong>FSIS</strong> is plac<strong>in</strong>g the suspension enforcement action at your facility<br />

<strong>in</strong> abeyance. The abeyance <strong>of</strong> the suspension enforcement action for your firm's slaughter operations will<br />

rema<strong>in</strong> <strong>in</strong> effect until such time as your company has demonstrated effective implementation <strong>of</strong> its proposed<br />

corrective and preventive measures, and that the corrective and preventive measures, as proposed, have been<br />

verified by <strong>FSIS</strong> <strong>to</strong> ensure no repetition <strong>of</strong> noncompliance related <strong>to</strong> your firm's responsibilities for the Humane<br />

Methods <strong>of</strong> Slaughter Act and <strong>FSIS</strong> regulations.
