APPENDIX 3: POLICY WORDING Core Strategy Policy CS1: Presumption in Favour of Sustainable Development When considering development proposals the Council will take a positive approach that reflects the presumption in favour of sustainable development contained in the National Planning Policy Framework. It will always work proactively with applicants jointly, in particular through the pre-application process, to find solutions which mean that proposals can be approved wherever possible, and to secure development that improves the economic, social and environmental conditions in the area. Planning applications that accord with the policies in this Local Plan (and, where relevant, with polices in neighbourhood plans) will be approved without delay, unless material considerations indicate otherwise. Where there are no policies relevant to the application or relevant policies are out of date at the time of making the decision then the Council will grant permission unless material considerations indicate otherwise – taking into account whether: a. any adverse impacts of granting permission would significantly and demonstrably outweigh the benefits, when assessed against the policies in the National Planning Policy Framework taken as a whole; or b. specific policies in that Framework indicate that development should be restricted. Core Strategy Policy CS12: Retaining Community Uses Proposals for development which would lead to the loss of premises or sites used, or last used, for a community use will not be permitted unless: • the development is the same, similar or related to that use; • adequate alternative facilities and services are available locally; • replacement facilities and services are proposed nearby; or • it can be demonstrated that there is no demand for the use and that there is a greater benefit to the area resulting from the proposed use. Core Strategy Policy CS36: Stour Valley Project The Stour Valley has the potential to act as a sub-regionally significant recreation and habitat resource. The Council and partners will promote sustainable public access and implement a management plan that considers the following: • Sustainable access from the urban area, to a continuous walking, cycling and bridleway route through the valley, including links to the north of the River Stour; • Gateway points in the valley offering education, interpretation and other public facilities; • A demonstration farm and visitor centre at Hick‘s Farm, Muscliffe; • Habitat restoration including floodplain grazing marsh, reed beds, wet woodland and instream corridor habitats; Holdenhurst Village Conservation Area Appraisal - March 2014 67
