confronts when look<strong>in</strong>g <strong>in</strong>to diplomatic relations between Algiers and the<br />

western countries <strong>in</strong> general. Moreover, it helps understand the legal and<br />

diplomatic contexts <strong>in</strong> which Algiers was operat<strong>in</strong>g when the United States<br />

first made its appearance as an <strong>in</strong>dependent state <strong>in</strong> the Mediterranean after<br />

1783. F<strong>in</strong>ally, it serves as a basis to determ<strong>in</strong>e, by the same standards of<br />

western legal thought and statutes, whether the actions of the corsairs of<br />

Algiers were acts of piracy therefore condemnable under exit<strong>in</strong>g <strong>in</strong>ternational<br />

law, or whether they were acts of war therefore captures, enslavement, and<br />

tribute were legal practice sanctioned by the same exist<strong>in</strong>g laws. To handle this<br />

issue properly, one needs to fit it <strong>with</strong><strong>in</strong> its contemporary legal and diplomatic<br />

contexts—the historical and religious contexts have already been dealt <strong>with</strong>.<br />

2. 1. Corsair<strong>in</strong>g vs. Piracy<br />

Corsair<strong>in</strong>g is a history-long maritime occupation very dist<strong>in</strong>ct from<br />

piracy. Its orig<strong>in</strong>s can be traced back to periods pre-dat<strong>in</strong>g the naissance of the<br />

<strong>Ottoman</strong> prov<strong>in</strong>ce of Algiers. As early as the 13 th century, European statutes<br />

and jurisprudence had developed legal def<strong>in</strong>itions and case laws that<br />

dist<strong>in</strong>guished corsairs from pirates. Later, western specialized scholarship<br />

expounded on exist<strong>in</strong>g legal tradition and maritime practice and gave way to a<br />

new science relat<strong>in</strong>g to <strong>in</strong>ter-state relations <strong>in</strong> which piracy and war occupied a<br />

prom<strong>in</strong>ent position. By the time Algiers came to existence as a polity <strong>in</strong> early<br />

16 th century, corsair<strong>in</strong>g had already been clearly def<strong>in</strong>ed and legalized by<br />

exist<strong>in</strong>g European statutes and emerg<strong>in</strong>g <strong>in</strong>ternational law and piracy was<br />
