Then, it was only when the Americans realized that “there was to be no<br />

<strong>in</strong>expensive short cut to peace <strong>with</strong> North Africa” 111<br />

that Congress decided to<br />

negotiate directly <strong>with</strong> the “Barbary Powers” for “treaties of amity, or of amity<br />

and commerce.” 112 The treaties were to be negotiated for a duration of ten years<br />

“or for a term as much longer as can be procured.” 113 The resolution adopted on<br />

May 7, 1784 provided for the creation of a commission consist<strong>in</strong>g of Frankl<strong>in</strong>,<br />

Adams, and Jefferson and operat<strong>in</strong>g from Paris and London <strong>with</strong> the purpose of<br />

carry<strong>in</strong>g negotiations, sign<strong>in</strong>g such treaties when concluded, and “transmitt<strong>in</strong>g<br />

them to Congress for their f<strong>in</strong>al ratification.” 114 To that Commission Congress<br />

appo<strong>in</strong>ted David Humphreys, U. S. representative <strong>in</strong> Portugal, as secretary. 115<br />

That diffuse responsibility was one of the major problems which handicapped<br />

negotiations <strong>with</strong> Algiers. When <strong>in</strong>formation and mutual consultations had to<br />

transit through five capitals separated by two seas and one ocean <strong>in</strong> an age of<br />

sail before any decision could be taken that must certa<strong>in</strong>ly account for one of<br />

the reasons which led to the failure of negotiations <strong>with</strong> Algiers.<br />

Besides that <strong>in</strong>tricate and unreasonable diplomatic mach<strong>in</strong>ery, Congress<br />

did not allot the funds necessary for the conclusion of peace treaties <strong>with</strong> the<br />

North African states. For a number of years, however, the commissioners had<br />

been spy<strong>in</strong>g <strong>in</strong> all courts of Europe about the amounts of money Barbary<br />

treaties and tributes cost as well as about presents (what were they? How much<br />
