2. The licensee shall undertake the water diversion in accordance with the plans and/or<br />

reports filed in the following Departmental records:<br />

3. This licence is based on knowledge available at the time <strong>of</strong> issue, and therefore the<br />

Director reserves the right to amend the<br />

(c)<br />

number, type and location <strong>of</strong> observation wells required<br />

frequency and method <strong>of</strong> measurement <strong>of</strong> observation wells<br />

responsibility for investigation <strong>of</strong> complaints, and<br />

conditions pertaining to annual water monitoring reports<br />

any time that the Director has information indicating unreasonable interference with<br />

water supplies or that damage to the aquifer is occurring.<br />

CONDITIONS<br />

4. The licensee shall position the pump intake in the production well(s) above the top <strong>of</strong> the<br />

aquifer.<br />

AND REPORTING<br />

5 The licensee shall when requested by the Director<br />

equip the diversion site(s) with a cumulative meter or other device which registers<br />

the quantity <strong>of</strong> water pumped<br />

measure the water levels in the diversion site(s) while the pump is operating<br />

obtain water samples for which a chemical analyses shall be performed that<br />

reports the following information:<br />

(i)<br />

Total Dissolved Solids, Hardness, Alkalinity, pH, Ca, Mg, Na+K, CO3.<br />

HCO3, SO4, Cl, NO3, Fe<br />

(ii)<br />

(iii)<br />

water temperature, date, and time <strong>of</strong> sampling<br />

date the analyses were perfomled<br />

(iv)<br />

results <strong>of</strong> the analyses<br />

6. The licensee shall when requested by the Director record and retain for each calendar<br />

year the following inf<strong>of</strong>nlation and shall provide this inf<strong>of</strong>nlation to the Director on or<br />

before January 31 <strong>of</strong> each year<br />

monthly readings <strong>of</strong> the number <strong>of</strong> cubic metres <strong>of</strong> water pumped from the<br />

diversion site( s) including dates and times the readings were taken<br />

monthly measurements <strong>of</strong> water levels from the diversion site(s) including dates<br />

and times at which readings were taken<br />

total annual quantity <strong>of</strong> water pumped expressed in cubic metres<br />

annual submissons <strong>of</strong> chemical analysis<br />

a review <strong>of</strong> the perfom1ance <strong>of</strong> the diversion site(s) during the past year and an J I -<br />

assessment, supported by graphs and calculations, <strong>of</strong> the perfom1ance <strong>of</strong> the ~<br />

recommendations for adjustments <strong>of</strong> pumping rates, the number and location <strong>of</strong><br />

observation wells, and diversion site(s) monitoring requirements<br />

and any other information requested by the Director .<br />

COMPLAINT<br />

INVESTIGATION<br />

(1) The licensee shall<br />

(a)<br />

(b)<br />

(c)<br />

provide to the Director and all water users, within a distance specified<br />

by the Director, the telephone numbers <strong>of</strong> the licensee and<br />

representative(s) for emergencies relating to operation <strong>of</strong> the diversion<br />

site(s)<br />

investigate all written complaints relating to allegations <strong>of</strong> surface<br />

water and groundwater interference as a result <strong>of</strong> the diversion site(s)<br />

operation within a distance specified by the Director<br />

provide a report to the Director, within a time specified by the<br />

Director, outlining the results <strong>of</strong> any<br />

(i)<br />

(ii)<br />

investigation relating to the alleged interference<br />

remediation or mitigative measures as a result <strong>of</strong> impact due to<br />

the operation <strong>of</strong> the diversion site(s) such as:<br />

lowering the intake <strong>of</strong> the pump to compensate for a<br />

drop in water level<br />

re-drilling the water well to an increased depth so as to<br />

allow the pump to be installed at a lower depth<br />

drilling a new well which must be pump tested to<br />

standards specified by the Director, or<br />

providing an alternate water supply satisfactory to the 1111.<br />

(2) The Director may make decision to suspend or cancel this licence if the<br />

licensee fails to satisfy the Director <strong>of</strong> the investigation and mitigative<br />

measures relating to alleged interference.<br />

G~ENERAL<br />

8. The licensee shall hold harmless the Minister <strong>of</strong> Environment or any other agent <strong>of</strong> the<br />

<strong>Government</strong> <strong>of</strong> <strong>Alberta</strong> for damage or damage claims arising out <strong>of</strong> the water diversion<br />

9. The licensee shall reclaim all abandoned wells or other holes relating to the water<br />

diversion under this licence in accordance with the Water (Ministerial) Regulation <strong>of</strong> the<br />

Water Act, and shall submit a reclamation report to the Director after completion <strong>of</strong> the<br />

water diversion<br />

10. The rights and privileges granted are subject to periodic review on licence renewal and<br />

amendment by the Director to ensure the most beneficial use <strong>of</strong> the water in the public<br />

interest.<br />

11. The licensee shall not deposit any substance that will adversely affect the water body.<br />

1:2. Where applicable, the licensee shall only release water to a water body when the quality<br />

<strong>of</strong> water is equal to or better than the quality <strong>of</strong> water in the receiving water body.<br />
