Lynn, Parker Lawsuits Hit Court of Appeals 

Argument Challenges Chancery Ruling of “Standing”

has begun a review of two 

dismissed lawsuits 

brought against Schools 

Director Mike Lowry and 

the Monroe County 

Board of Education by 

Third District school 

board member Sonya 

Lynn and former Tellico 

Plains High special education 

teacher Penny Parker. 

Parker initially won her 

case in Monroe County 

Chancery Court in December 

last year and Lynn 

followed in January, but on 

February 22 of this year 

Chancellor Jerri Bryant 

abruptly reversed both decisions, 

ruling for Lowry 

and the school board. 

In a 15-page appeals 

brief, Blount County attorney 

Kevin Shepherd 

challenged Bryant’s order 

to dismiss and her decision 

that Parker and Lynn 

did not have proper 

“standing” to bring 

charges against Lowry and 

the school board. 

“Typically, the defense 

of lack of standing is raised 

shortly after the lawsuit 

has been filed, but in any 

event, before the matter 

goes to trial,” Shepherd 

wrote in the brief. “The 

purpose in doing so is 

clearly understood because 

it saves the parties 

and the court from going 

through the needless expense 

and time of a fullblown 

trial.” 

Explaining that the 

doctrine of standing promoted 

“judicial economy 

and efficiency,” Shepherd 

noted that Bryant had reversed 

her earlier decisions, 

offering no warning 

to Parker and Lynn. 

“It is almost without 

explanation as to why she 

(Bryant) stated that each 

plaintiff had carried their

the grace of a true Southern lady, and the heart of a willing public servant.

depository, she realized 

her purse was also missing. 

Brookshire said she 

told him she then located 

the pocketbook in her 

kitchen. 

But missing from the 

cabinet and from the 

purse was $10,000 in currency. 


The female offered a 

possible suspect, Brookshire 

said, and assured him 

the money was not freely 

given. 

In another incident on 

Thursday, a Rafter Road 

resident reported the theft 

of two saddles from his 

home in Tellico Plains. 

The horse seats were in 

his basement on October 

5, the resident told Monroe 

County Sheriff’s Captain 

Steve Ogle, but after 

that date, he said he didn’t 

notice the two pillions as 

missing. 

A neighbor, the resident’s 

caregiver, said no 

forced entry was apparent 

but someone could have 

left the basement with the 

howdahs through the upstairs 

front door.

compliance with the laws

Tennessee Supreme Court 

had provided “clear guidance” 

for a plaintiff to 

prove standing, citing case 

law handed down in 2006 

in ACLU v. Darnell, asking 

if “the trial judge erred by 

dismissing the case, after 

the trial, for a lack of 

standing.” 

In 2009, Parker first 

brought litigation against 

Lowry and the school 

board, alleging that Lowry 

wrongfully failed to provide 

her with tenure and 

illegally kept her from addressing 

the school board 

regarding his action. Her 

lawsuit accused Lowry of 

violating state law and 

school board policy when 

he did not bring her name 

before the board as required 

when hiring and 

firing teachers or when declining 

to extend an offer 

of tenure. 

Lynn’s lawsuit – filed in 

June 2010 - mirrored 

Parker’s in that Lynn 

claimed Lowry’s refusal to 

bring Parker’s name to the 

board for approval, or disapproval, 

kept the board 

from “doing its job” and 

from performing its duties 

as required by law. 

When Parker won her 

case, Bryant termed 

Lowry “deficient” in his 

actions. 

“The court finds pursuant 

to TCA 49-5-409 

the written notice from 

the director of schools to 

the plaintiff (Parker) in 

this case was deficient in 

that it did not contain a 

statement of prior authorization 

by a majority vote

Butternut Squash 

Soup 

1 medium onion, chopped 

2 tablespoons butter 

1 medium butternut 

squash (about 4 pounds), 

peeled and cubed 

3 cans (14-1/2 ounces 

each) vegetable broth 

1 tablespoon brown sugar 

1 tablespoon minced 

fresh gingerroot 

1 garlic clove, minced 

1 cinnamon stick (3 

inches) 

1 package (8 ounces) 

cream cheese, softened 

and cubed 

In a small skillet, saute 

onion in butter until tender. 

Transfer to a 5-or 6- 

quart slow cooker; add 

squash. Combine the 

broth, brown sugar, ginger, 

garlic and cinnamon; 

pour over squash. Cover 

and cook on low for 6-8 

hours or until squash is 

tender. 

Cool slightly. Discard 

cinnamon stick. In a 

blender, process soup in 

batches until smooth. Return 

all to slow cooker. 

Whisk in cream cheese; 

cover and cook 15 minutes 

longer or until 

cheese is melted.

Squash Bake 

4 cups mashed cooked 

butternut squash 

4 tablespoons butter, softened, 

divided 

1/2 teaspoon salt 

1/2 teaspoon ground cinnamon 

1/4 teaspoon ground allspice 

1/4 teaspoon ground nutmeg 

1 can (14 ounces) wholeberry 

cranberry sauce 

1/2 cup sliced almonds 

1/4 cup packed brown 

sugar 

In a large bowl, combine 

the squash, 2 tablespoons 

butter, salt, 

cinnamon, allspice and 

nutmeg. Transfer to a 

greased 2-qt. baking dish. 

Stir cranberry sauce until 

softened; spoon over 

squash. 

Combine the almonds, 

brown sugar and remaining 

butter; sprinkle over 

cranberry sauce. 

Bake, uncovered, at 

350° for 50-60 minutes or 

until golden brown and

the entity “with proper 

standing” to raise and address 

the issue of Lowry’s 

failure to follow policy 

“and they have not.” 

“Without proper 

standing, this case must be 

dismissed and the previous 

judgment of the court 

set aside,” wrote Bryant. 

Shepherd’s argument 

before the Court of Appeals 

relies on the 

Supreme Court ruling of 

2006, in which “courts 

employ the doctrine of 

standing to determine 

whether a particular litigant 

is entitled to have a 

court decide the merits of 

a dispute or of particular 

issues.” 

“Thus, it is clear that 

the role of standing is to 

be used proactively at the 

beginning of a lawsuit instead 

of after a lawsuit is 

tried as a means to dismiss 

a case already decided,” 

Shepherd said. “It has 

been clearly established 

that the director of 

schools (Lowry) behaved 

wrongfully and in violation 

of school board policy as 

well as Tennessee law 

when he failed to allow 

Penny parker to speak to 

the board for the denial of 

tenure, which likewise 

prohibited Sonya Lynn 

from performing her 

faithful duties as a board 

of education member.”
