brief, Blount <strong>County</strong> attorney<br />

Kevin Shepherd<br />

challenged Bryant’s order<br />

to dismiss and her decision<br />

that Parker and Lynn<br />

did not have proper<br />

“standing” to bring<br />

charges against Lowry and<br />

the school board.<br />

“Typically, the defense<br />

of lack of standing is raised<br />

shortly after the lawsuit<br />

h<strong>as</strong> been filed, but in any<br />

event, before the matter<br />

goes to trial,” Shepherd<br />

wrote in the brief. “The<br />

purpose in <strong>do</strong>ing so is<br />

clearly understood because<br />

it saves the parties<br />

and the court from going<br />

through the needless expense<br />

and time of a fullblown<br />

trial.”<br />

Explaining that the<br />

<strong>do</strong>ctrine of standing promoted<br />

“judicial economy<br />

and efficiency,” Shepherd<br />

noted that Bryant had reversed<br />

her earlier decisions,<br />

offering no warning<br />

to Parker and Lynn.<br />

“It is almost without<br />

explanation <strong>as</strong> to why she<br />

(Bryant) stated that each<br />

plaint<strong>if</strong>f had carried their<br />

Thursday, a Rafter Road<br />

resident reported the theft<br />

of two saddles from his<br />

home in Tellico Plains.<br />

The horse seats were in<br />

his b<strong>as</strong>ement on October<br />

5, the resident told <strong>Monroe</strong><br />

<strong>County</strong> Sher<strong>if</strong>f’s Captain<br />

Steve Ogle, but after<br />

that date, he said he didn’t<br />

notice the two pillions <strong>as</strong><br />

missing.<br />

A neighbor, the resident’s<br />

caregiver, said no<br />

forced entry w<strong>as</strong> apparent<br />

but someone could have<br />

left the b<strong>as</strong>ement with the<br />

howdahs through the upstairs<br />

front <strong>do</strong>or.<br />

of her decision is not in<br />

compliance with the laws<br />

Shepherd added the<br />

<strong>Tennessee</strong> Supreme Court<br />

had provided “clear guidance”<br />

for a plaint<strong>if</strong>f to<br />

prove standing, citing c<strong>as</strong>e<br />

law handed <strong>do</strong>wn in 2006<br />

in ACLU v. Darnell, <strong>as</strong>king<br />

<strong>if</strong> “the trial judge erred by<br />

dismissing the c<strong>as</strong>e, after<br />

the trial, for a lack of<br />

standing.”<br />

In 2009, Parker first<br />

brought litigation against<br />

Lowry and the school<br />

board, alleging that Lowry<br />

wrongfully failed to provide<br />

her with tenure and<br />

illegally kept her from addressing<br />

the school board<br />

regarding his <strong>act</strong>ion. Her<br />

lawsuit accused Lowry of<br />

violating state law and<br />

school board policy when<br />

he did not bring her name<br />

before the board <strong>as</strong> required<br />

when hiring and<br />

firing teachers or when declining<br />

to extend an offer<br />

of tenure.<br />

Lynn’s lawsuit – filed in<br />

June 2010 - mirrored<br />

Parker’s in that Lynn<br />

claimed Lowry’s refusal to<br />

bring Parker’s name to the<br />

board for approval, or disapproval,<br />

kept the board<br />

from “<strong>do</strong>ing its job” and<br />

from performing its duties<br />

<strong>as</strong> required by law.<br />

When Parker won her<br />

c<strong>as</strong>e, Bryant termed<br />

Lowry “deficient” in his<br />

Soup<br />

1 medium onion, chopped<br />

2 tablespoons butter<br />

1 medium butternut<br />

squ<strong>as</strong>h (about 4 pounds),<br />

peeled and cubed<br />

3 cans (14-1/2 ounces<br />

each) vegetable broth<br />

1 tablespoon brown sugar<br />

1 tablespoon minced<br />

fresh gingerroot<br />

1 garlic clove, minced<br />

1 cinnamon stick (3<br />

inches)<br />

1 package (8 ounces)<br />

cream cheese, softened<br />

and cubed<br />

In a small skillet, saute<br />

onion in butter until tender.<br />

Transfer to a 5-or 6-<br />

quart slow cooker; add<br />

squ<strong>as</strong>h. Combine the<br />

broth, brown sugar, ginger,<br />

garlic and cinnamon;<br />

pour over squ<strong>as</strong>h. Cover<br />

and cook on low for 6-8<br />

hours or until squ<strong>as</strong>h is<br />

tender.<br />

Cool slightly. Discard<br />

cinnamon stick. In a<br />

blender, process soup in<br />

batches until smooth. Return<br />

all to slow cooker.<br />

Whisk in cream cheese;<br />

cover and cook 15 minutes<br />

longer or until<br />

cheese is melted.<br />

In a large bowl, combine<br />

cinnamon, allspice and<br />

nutmeg. Transfer to a<br />

gre<strong>as</strong>ed 2-qt. baking dish.<br />

Stir cranberry sauce until<br />

softened; spoon over<br />

Combine the almonds,<br />

brown sugar and remaining<br />

butter; sprinkle over<br />

cranberry sauce.<br />

350° for 50-60 minutes or<br />

until golden brown and<br />

board should have been<br />

the entity “with proper<br />

standing” to raise and address<br />

the issue of Lowry’s<br />

failure to follow policy<br />

“and they have not.”<br />

“Without proper<br />

standing, this c<strong>as</strong>e must be<br />

dismissed and the previous<br />

judgment of the court<br />

set <strong>as</strong>ide,” wrote Bryant.<br />

of after a lawsuit is<br />

tried <strong>as</strong> a means to dismiss<br />

a c<strong>as</strong>e already decided,”<br />

Shepherd said. “It h<strong>as</strong><br />

been clearly established<br />

that the director of<br />

schools (Lowry) behaved<br />

wrongfully and in violation<br />

of school board policy <strong>as</strong><br />

well <strong>as</strong> <strong>Tennessee</strong> law<br />

when he failed to allow<br />

prohibited Sonya Lynn<br />

from performing her<br />

faithful duties <strong>as</strong> a board<br />
