I cannot but think you were wrong in originally<br />

objecting to an enquiry by a Committee <strong>of</strong> the .<br />

Legislative Council into the state <strong>of</strong> the Convict<br />

Establishment . It appears to me that a Body<br />

constituted for the purpose <strong>of</strong> making laws binding<br />

on the 'ho le community <strong>of</strong> <strong>Tasmania</strong> must possess the<br />

ancillary, and almost inseparable, right <strong>of</strong> enquiry<br />

into all subjects <strong>of</strong> pub lic interest. The<br />

anticipation that such an enquiry might lead to<br />

interference with matters placed , from peculiar<br />

circumstances , beyond the control <strong>of</strong> the local<br />

authorities , could afford no substantial reason for<br />

resisting a proceeding within the strict rights <strong>of</strong><br />

the Council. 2 2 -<br />

On May 3, 1856, he confirmed this opinion:<br />

.... you will inform the Legislative Council, that<br />

Her Majesty's Government consider that their right<br />

<strong>of</strong> enquiry into alleged abuses in the Convict<br />
