<strong>We</strong> <strong>have</strong> <strong>received</strong> <strong>an</strong> E-mail from the Department of Commerce which has been<br />

forwarded from the Embassy of India, Washington regarding US Generalized System of<br />

Preferences (<strong>GSP</strong>) eligibility for your information <strong>an</strong>d necessary action.<br />

2. Please note that the Office of the US Trade Representative (USTR) has made<br />

available full calendar year 2012 import statistics which c<strong>an</strong> be found at<br />

http://dataweb.usitc.gov/scripts/user_set.asp.<br />

3. The attached document (PDF format) contains four lists referred to in the Notice<br />

published in the US Federal Register on 19 March, 2013, entitled “2012 Generalised<br />

System of Preferences (<strong>GSP</strong>) Product Review: Inviting Public Comments on Possible<br />

Actions Related to Competitive Need Limitations.” These four lists show products that<br />

could be excluded from or reinstated to the duty-free treatment available under the <strong>GSP</strong><br />

based on Competitive Need Limitations (CNLs). Briefly, these four lists are as under:-<br />

List I contains <strong>GSP</strong> eligible articles from Beneficiary Developing Countries (BDCs) that<br />

exceeded a CNL <strong>an</strong>d are newly subject to potential exclusion (This list contains only two<br />

products, which are from Brazil. It does not contain <strong>an</strong>y product from India).<br />

List II contains <strong>GSP</strong> eligible articles from BDCs that are eligible for a de minimis CNL<br />

waiver. (This list contains 100 products from a number of BDCs, including 48 products<br />

from India)<br />

List III contains <strong>GSP</strong> eligible articles from certain BDCs that are currently not receiving<br />

<strong>GSP</strong> duty free treatment, but that may be considered for re-designation. (This list<br />

contains 156 products from a number of BDCs, including 17 products from India)<br />

List IV contains Articles subject to CNL waiver revocation based on the provisions of<br />

Section 503(d)(4)(B)(ii) of the 1974 Act, as amended by Public Law 109–432. (This list<br />

contains only one product, which is from Indonesia. It does not contain <strong>an</strong>y product<br />

from India)


4. As mentioned above, no product from India figures in List I <strong>an</strong>d List IV.<br />

However, it may please be noted that the USTR has provided these lists for informational<br />

purposes only <strong>an</strong>d has strongly encouraged the interested parties to independently<br />

research the 2012 trade statistics, using the U.S. International Trade Commission’s<br />

(USITC) “dataweb” site, which c<strong>an</strong> be found at<br />

http://dataweb.usitc.gov/scripts/user_set.asp.<br />

5. The Office of the USTR will accept public comments submitted by April 12,<br />

2013, regarding: (1) possible de minimis CNL waivers; (2) possible re-designations of<br />

articles currently not eligible for <strong>GSP</strong> benefits because they previously exceeded the CNL<br />

thresholds; <strong>an</strong>d (3) potential revocation of CNL waivers.<br />

6. The information regarding Statutory provisions related to CNLs <strong>an</strong>d the<br />

Requirements for Submissions (of Comments), etc. are mentioned in the USTR Federal<br />

Notice of 19 March 2013 regarding Generalized System of Preferences Product Review;<br />

Competitive Need Limitations which is available at http://www.ustr.gov/.<br />

2012 <strong>GSP</strong> Annual Product Review: Import Statistics Relating to Competitive Need<br />

Limitations (CNLs), Potential Revocations, De Minimis Waivers, <strong>an</strong>d Product Redesignations<br />

This document contains the lists referred to in the notice published in the Federal Register on March 19, 2013, entitled “2012<br />

Generalized System of Preferences (<strong>GSP</strong>) Product Review: Inviting Public Comments on Possible Actions Related to Competitive<br />

Need Limitations.” These lists are provided for informational purposes only. Interested parties are strongly encouraged to<br />

independently research the 2012 trade statistics, using the U.S. International Trade Commission’s (USITC) “dataweb” site, which c<strong>an</strong><br />

be found at http://dataweb.usitc.gov/scripts/user_set.asp.<br />

List I shows <strong>GSP</strong>-eligible articles from beneficiary developing countries (BDCs) that exceeded a CNL by having been<br />

imported into the United States in 2012 in excess of $155 million, or in a qu<strong>an</strong>tity equal to or greater th<strong>an</strong> 50 percent of the total U.S.<br />

import value for this product in 2012. These products will be removed from eligibility for <strong>GSP</strong> for the subject countries on July 1,<br />

2013, unless the President gr<strong>an</strong>ts a waiver for the product for the subject country in response to a petition filed by <strong>an</strong> interested party.<br />

Such petitions for CNL waivers were due on November 21, 2012, as <strong>an</strong>nounced in the notice initiating the 2012 <strong>GSP</strong> Annual Review,<br />

published in the Federal Register on July 30, 2012 (See 77 FR 44704). The last column in List I shows those products for which<br />

petitions <strong>have</strong> been accepted <strong>an</strong>d remain under review.<br />

List II identifies <strong>GSP</strong>-eligible articles from BDCs that are above the 50 percent CNL, but that are eligible for a de minimis<br />

waiver of the 50 percent CNL. Articles eligible for de minimis waivers are automatically considered in the <strong>GSP</strong> <strong>an</strong>nual review<br />

process, without the filing of a petition. Public comments (including comments in support of or in opposition to de minimis waivers)<br />

are invited in accord<strong>an</strong>ce with the requirements for submissions set out in the notice published in the Federal Register on March 19,<br />

2013.<br />

List III shows <strong>GSP</strong>-eligible articles from certain BDCs that are currently not receiving <strong>GSP</strong> duty-free treatment, but that may<br />

be considered for <strong>GSP</strong> redesignation based on 2012 trade data <strong>an</strong>d consideration of certain statutory factors. Recommendations to the<br />

President on redesignations are normally made as part of the <strong>GSP</strong> <strong>an</strong>nual review process, <strong>an</strong>d public comments (including comments<br />

in support of or in opposition to redesignations) are invited in accord<strong>an</strong>ce with the requirements for submissions set out in the notice<br />

published in the Federal Register on March 19, 2013.<br />

List IV shows articles subject to CNL waiver revocation based on the provisions of Section 503(d)(4)(B)(ii) of the 1974 Act,<br />

as amended by Public Law 109–432. Recommendations to the President on revocation of these waivers will be made as part of the<br />
