Potential new areas for<br />

legislati<strong>on</strong><br />

The WHO FCTC encourages countries to<br />

implement measures bey<strong>on</strong>d the treaty<br />

obligati<strong>on</strong>s, a call that is reiterated in the<br />

text of Article 13 itself (5). Examples of other<br />

legislati<strong>on</strong> to block TAPS activities under<br />

c<strong>on</strong>siderati<strong>on</strong> by some countries include:<br />

eliminating tax incentives. TAPS activities<br />

can be reduced if companies are not<br />

allowed to take business tax deducti<strong>on</strong>s<br />

for these expenses, including price<br />

discounting <strong>and</strong> product giveaways, thus<br />

reducing financial incentives for these<br />

expenditures. Although this acti<strong>on</strong> has<br />

been proposed in the past (82), most<br />

recently by the US state of California<br />

(83), it has not yet been implemented.<br />

requiring plain packaging. Australia is, as<br />

of 1 December 2012, the first country<br />

to require plain (or st<strong>and</strong>ardized)<br />

packaging of <strong>tobacco</strong> products;<br />

other countries including Irel<strong>and</strong> <strong>and</strong><br />

New Zeal<strong>and</strong> are c<strong>on</strong>sidering similar<br />

legislati<strong>on</strong>. Package design serves an<br />

increasingly critical role in promoting<br />

<strong>tobacco</strong> use as other TAPS activities<br />

are restricted or prohibited (84).<br />

Requiring plain packaging – without<br />

colour, pictures or distinctive typefaces,<br />

other than required health warnings<br />

– minimizes the ability to promote<br />

br<strong>and</strong>s <strong>and</strong> can neutralize the value of<br />

individual br<strong>and</strong>s (85).<br />

M<strong>on</strong>itoring of <strong>tobacco</strong><br />

<strong>advertising</strong>, promoti<strong>on</strong> <strong>and</strong><br />

sp<strong>on</strong>sorship activities is<br />

essential<br />

<strong>tobacco</strong> industry strategies that attempt<br />

to circumvent the law is also important for<br />

establishing effective countermeasures.<br />

M<strong>on</strong>itoring <strong>and</strong> enforcement programmes<br />

should cover traditi<strong>on</strong>al media <strong>and</strong><br />

marketing channels, as well as new <strong>and</strong><br />

emerging <strong>advertising</strong> <strong>and</strong> promoti<strong>on</strong>al<br />

strategies, technologies <strong>and</strong> social<br />

trends (e.g. social networking). Ongoing<br />

m<strong>on</strong>itoring can identify new types of TAPS<br />

activities that circumvent even the most<br />

clearly written comprehensive <str<strong>on</strong>g>bans</str<strong>on</strong>g>.<br />

Coordinati<strong>on</strong> with other<br />

government ministries <strong>and</strong><br />

civil society organizati<strong>on</strong>s is<br />

important<br />

by executive order, coordinati<strong>on</strong> with a<br />

variety of government ministries, NGOs<br />

<strong>and</strong> civil society organizati<strong>on</strong>s is necessary.<br />

Examples of areas within government where<br />

coordinati<strong>on</strong> of activities is needed include:<br />

Health ministry (or other appropriate<br />

ministry/instituti<strong>on</strong>), to oversee the<br />

nati<strong>on</strong>al <strong>tobacco</strong> c<strong>on</strong>trol programme,<br />

including <str<strong>on</strong>g>bans</str<strong>on</strong>g> <strong>on</strong> TAPS; the government<br />

should designate an organizati<strong>on</strong> or<br />

public instituti<strong>on</strong> to m<strong>on</strong>itor TAPS<br />

activities <strong>and</strong> the impact of <str<strong>on</strong>g>bans</str<strong>on</strong>g>, <strong>and</strong><br />

report regularly to the health ministry<br />

<strong>and</strong> other government mechanisms that<br />

coordinate <strong>tobacco</strong> c<strong>on</strong>trol activities.<br />

Justice ministry (or other appropriate<br />

law enforcement agency according to<br />

nati<strong>on</strong>al law, e.g. agency for c<strong>on</strong>sumer<br />

protecti<strong>on</strong>), to enforce <str<strong>on</strong>g>bans</str<strong>on</strong>g> <strong>on</strong> TAPS.<br />

Finance ministry, to make reports <strong>on</strong><br />

TAPS expenditures as required by the<br />

WHO FCTC (in countries where TAPS<br />

activities are not banned completely).<br />

Commerce ministry, to m<strong>on</strong>itor <strong>and</strong><br />

enforce <str<strong>on</strong>g>bans</str<strong>on</strong>g> <strong>on</strong> TAPS.<br />

Communicati<strong>on</strong>s ministry, to m<strong>on</strong>itor<br />

<strong>and</strong> enforce broadcast <strong>and</strong> Internet<br />

<strong>advertising</strong> <str<strong>on</strong>g>bans</str<strong>on</strong>g>.<br />

Enlisting the support of civil society<br />

organizati<strong>on</strong>s is also important in<br />

successfully enacting <strong>and</strong> enforcing <str<strong>on</strong>g>bans</str<strong>on</strong>g> <strong>on</strong><br />

TAPS activities. These include:<br />

media businesses;<br />

■■<br />

other business organizati<strong>on</strong>s, especially<br />

in industries targeted by the <strong>tobacco</strong><br />

industry (e.g. sport, music, bars/<br />

nightclubs);<br />

retail organizati<strong>on</strong>s (especially for pointof-sale<br />

TAPS activities);<br />

youth organizati<strong>on</strong>s;<br />

NGOs involved with health, educati<strong>on</strong>,<br />

child protecti<strong>on</strong>, women’s issues, human<br />

rights <strong>and</strong> other relevant social areas.<br />

TAPS activities should be m<strong>on</strong>itored to<br />

ensure compliance with <str<strong>on</strong>g>bans</str<strong>on</strong>g>. M<strong>on</strong>itoring<br />
