Too much dust can be unhealthy,<br />

so we all need to work together to<br />

reduce dust pollution.<br />

State law requires that the city <strong>of</strong> <strong>Glendale</strong>, along with other<br />

cities and towns, and Maricopa County, adopt and enforce<br />

new dust control ordinances to help make the air cleaner for<br />

our community.<br />

It is the property owner’s responsibility to control dust on<br />

their property. Although this brochure does not cover all<br />

compliance responsibilities, it is intended to help those<br />

responsible understand and comply with the new city<br />

requirements. It also includes general information on state<br />

and county requirements.<br />

<strong>REQUIREMENTS</strong><br />

ENFORCEMENT<br />

The city <strong>of</strong> <strong>Glendale</strong>, Maricopa County, and the state <strong>of</strong><br />

Arizona each have rules and regulations for dust control.<br />

• The city enforces the dust control requirements as<br />

outlined in its city fugitive dust ordinance. The city’s<br />

ordinance is found in the <strong>City</strong> Code Book, website:<br />

www.glendaleaz.com/codebook/.<br />

• Maricopa County’s dust regulations and ordinances<br />

can be found at: www.maricopa.gov/aq.<br />

• The Arizona Department <strong>of</strong> Environmental<br />

Quality enforces state requirements that have<br />

not been delegated to the cities or the County.<br />

and commercial facilities and residential<br />

buildings with more than four units<br />

No property owner shall allow parking,<br />

maneuvering, or an entry/exit areas that<br />

serves commercial, industrial or more<br />

than four residential-units unless the<br />

surface is permanently maintained with<br />

a dustpro<strong>of</strong> method.<br />

Effective date for enforcement:<br />

October 1, 2008<br />

FUGITIVE <strong>DUST</strong> REMINDERS AND HELPFUL HINTS<br />

Drivers, when driving a motor vehicle on dirt roads:<br />

• Reduce your speed to 15 mph.<br />

• Stay on public or private roads, and lawful easements.<br />

• Beware <strong>of</strong> additional restrictions during High Pollution<br />

Advisory Days.<br />

• Do not park on unpaved surfaces (dirt shoulders and vacant<br />

lots) that have not been stabilized.<br />

Vehicle use on unpaved surfaces closed by<br />

landowner<br />

Leaf-blowers<br />

No property owner shall allow parking,<br />

maneuvering, or an entry/exit area that<br />

are 3,000 sq. ft. or greater in size and<br />

that serve residential buildings with<br />

four or less units unless the surface is<br />

permanently maintained with a dust<br />

pro<strong>of</strong> method.<br />

No person shall park or use a vehicle on<br />

an unpaved vacant lot unless the surface<br />

actually utilized is an excepted property<br />

or is permanently maintained with a<br />

dustpro<strong>of</strong> method.<br />

No person shall operate a vehicle on any<br />

unpaved surface that is closed by the<br />

landowner by rule or regulation <strong>of</strong> a federal<br />

agency, the State <strong>of</strong> Arizona, Maricopa<br />

County, the city or by proper posting <strong>of</strong> a<br />

private land owner.<br />

No person shall use a leaf-blower to move<br />

landscape materials into a public roadway<br />

(street) at anytime.<br />

This regulation also prohibits the use <strong>of</strong><br />

leaf-blowers by city <strong>of</strong> <strong>Glendale</strong> employees<br />

and contractors working for the city on<br />

high pollution advisory days issued by the<br />

state. (Leaf-blowers used while in vacuum<br />

mode is acceptable).<br />

Effective date for enforcement:<br />

October 1, 2009<br />

Effective date: March 31, 2008<br />

A vehicle is a motorized device, including<br />

motor vehicles, all-terrain vehicles and<br />

<strong>of</strong>f-road vehicles.<br />

Effective date: March 31, 2008<br />

In addition, the state and county prohibits<br />

the use <strong>of</strong> leaf-blowers on surfaces that<br />

have not been stabilized with asphalt,<br />

concrete, hardscape, soil stabilizers,<br />

gravel, crushed granite, grass or other<br />

vegetative cover.<br />

Effective date: March 31, 2008<br />

Property Owners:<br />

• Post proper “No Trespassing” warning signs on your vacant<br />

property.<br />

• Use berms, gates, and fences to keep trespassers <strong>of</strong>f your<br />

vacant property.<br />

• Stabilize unpaved surfaces used by vehicles (private roads,<br />

parking areas, driveways and easements).<br />

• Beware that if you allow vehicle use on your property, you are<br />

responsible for dust control.<br />

• Beware that there are wood-burning restrictions during high<br />

Pollution Advisory Days (Maricopa County).<br />

Stabilization methods include:<br />

• Paving with concrete/asphalt.<br />

• Gravel/decomposed granite.<br />

• Vegetation (grass cover).<br />

• Watering.<br />

• Applying and maintaining dust suppressants/stabilizers.<br />

Leaf-blower, restrictions include:<br />

• Never blow landscape debris or dirt onto public roads at any<br />

time (city <strong>of</strong> <strong>Glendale</strong>).<br />

• Never use leaf-blowers (except on vacuum mode) during a<br />

high pollution advisory day (city employees and contractors<br />

working for the city).<br />

• Never use leaf-blowers directly on an unstabilized dirt<br />

surface at any time (Maricopa County).<br />

Farms and Croplands:<br />

• Farm operations are subject to state dust control<br />

requirements.
