ASU MRED Program <strong>of</strong> Work in the Heritage District<br />
RECOMMENDED MOTION<br />
The information presented is designed to provide the <strong>Gilbert</strong> Redevelopment Commission with an<br />
update and overview <strong>of</strong> the partnership between the <strong>Town</strong> and the Arizona State University Master <strong>of</strong><br />
Real Estate Development (MRED) program.<br />
BACKGROUND/DISCUSSION<br />
Mark Stapp, Executive Director for the Arizona State University Master <strong>of</strong> Real Estate<br />
Development (MRED) program will present to the <strong>Gilbert</strong> Redevelopment Commission an<br />
overview <strong>of</strong> the MRED program and the current Synthesis project taking place in <strong>Gilbert</strong>. The<br />
ASU MRED program <strong>of</strong>fers a transdisciplinary approach to real estate development education<br />
through a full-immersion curriculum that explores the development process in its entirety. During<br />
the one-year program, the Program Teams locate, analyze and consider the physical, legal,<br />
economic, political and financial conditions impacting the user/developer <strong>of</strong> property and the<br />
critical market and financial analysis required for a successful project<br />
Through this program, the Program Teams take part in 3 group-based synthesis projects which<br />
utilize actual locations and variable development situations in order to assess opportunities and<br />
present development solutions. Upon completion, projects are presented to the MRED faculty as<br />
well as a panel <strong>of</strong> industry leaders. Teams are balanced to include members <strong>of</strong> varying<br />
experiences in order to maximize the internal learning experience and mimic the actual<br />
development process.<br />
This year the ASU MRED program has selected the Heritage District in <strong>Gilbert</strong> to participate in 2<br />
<strong>of</strong> the 3 synthesis projects. Teams will be required to assess and present solutions for various<br />
parcels <strong>of</strong> vacant land owned by <strong>Gilbert</strong> located within the Heritage District.<br />
Each ASU MRED Team’s objective is to:<br />
1. Determine if the current zoning in <strong>Gilbert</strong> supports development compatible with current and<br />
future market demands and if not, what zoning changes will be required and what is the<br />
strategy and cost <strong>of</strong> requesting the proposed changes.<br />
2. With Masters <strong>of</strong> Urban Design students (MUD), prepare concept plan(s) that define the <strong>Gilbert</strong><br />
Heritage District and maximize each Parcel’s value.
3. Make a specific <strong>of</strong>fer to <strong>Gilbert</strong> to become the Master Developer including:<br />
a. Respondent’s overall vision for the District<br />
b. Anticipated primary uses and markets for the District<br />
c. Proposed financing types and sources<br />
d. Development phasing<br />
e. Proposed involvement <strong>of</strong> the <strong>Town</strong> and other stakeholders.<br />
4. Based on the Master Development Plan, prepare a financial analysis to determine how much<br />
can be paid for each Parcel and the Parcels in aggregate, given defined investment criteria,<br />
assumptions, terms and conditions.<br />
5. Prepare for <strong>Gilbert</strong> a bound analysis (“Project Report”), including the description <strong>of</strong> strategic<br />
investment and development alternatives.<br />
6. With the MUD students, make a presentation <strong>of</strong> the Master Developer proposal to <strong>Gilbert</strong>.<br />
Through the coordinated efforts <strong>of</strong> the Arizona State University, the ASU MRED program and<br />
<strong>Gilbert</strong>, Arizona the continued <strong>redevelopment</strong> <strong>of</strong> the Heritage District will be a major contributing<br />
factor in <strong>Gilbert</strong>’s continuing quest to be a Community <strong>of</strong> Excellence.<br />

American Legion Merrill Mitchell Post 39<br />

We also plan to recreate/install original<br />
“GILBERT” sign replica across <strong>Gilbert</strong> Road<br />
in heart <strong>of</strong> downtown <strong>Gilbert</strong>.<br />
Signs will stretch across <strong>Gilbert</strong> Road, South<br />
<strong>of</strong> Elliott and South <strong>of</strong> Juniper.<br />

Bring art to the downtown area and connect the art piece to <strong>Town</strong>’s<br />
motto <strong>of</strong> “<strong>Gilbert</strong> – Clean, Safe, Vibrant,” while preserving the <strong>Town</strong>’s<br />
rich history, present achievements and future plans.<br />
Through this project, the class will be challenged to examine art and its<br />
importance within the community through a mural. We also plan to<br />
work with the American Legion and local veterans to create the mural.<br />

Beautify downtown <strong>Gilbert</strong> and bring culture to the public sphere.<br />
Murals can also have a dramatic impact whether consciously or<br />

areas where people live and work.<br />
Public murals add an aesthetic improvement to the neighborhood.<br />

Entertainment District<br />
RECOMMENDED MOTION<br />
A motion may be given to continue the research and public process as outlined in the<br />
staff report to create an Entertainment District within the Heritage District.<br />
BACKGROUND<br />
<strong>Gilbert</strong>’s Heritage District wants to create a vibrant downtown with bars and other<br />
entertainment venues that desire liquor. Since State law prohibits businesses with liquor<br />
licenses from locating within 300 horizontal feet <strong>of</strong> a church, staff is researching a<br />
provision that would create an Entertainment District that permits an exemption from this<br />
requirement. A.R.S.§ 4-207C (4) is a provision whereby the <strong>Town</strong> Council may create an<br />
Entertainment District and within that district the <strong>Town</strong> may, on a case by case basis,<br />
approve an exemption from the 300-foot requirement. This is not an automatic approval<br />
as the State also needs to approve the license. The District is designated by resolution<br />
adopted by the <strong>Town</strong> Council.<br />
The District is required to contain a significant number <strong>of</strong> entertainment uses, artistic and<br />
cultural venues, including musical halls, concert facilities, theaters, arenas, stadiums,<br />
museums, studios, galleries, restaurants, bars and other related facilities. Based on<br />
<strong>Gilbert</strong>’s population, the <strong>Town</strong> can have a maximum <strong>of</strong> two entertainment districts. At this<br />
time, the Heritage District contains a theater, museum, galleries, studios, restaurants, and<br />
bars. Other entertainment uses are expected to develop over time.<br />
The Statute requires that the Entertainment District be a specific contiguous area that<br />
consists <strong>of</strong> no more than one square mile, that is no less than one-eighth <strong>of</strong> a mile in<br />
width and that it contain a significant number <strong>of</strong> the uses noted above. Staff is working on<br />

a map that will show the location <strong>of</strong> schools, churches, entertainment uses, <strong>Town</strong> owned<br />
vacant land, and zoning districts that accommodate entertainment uses.<br />
Summary – Staff is looking for input on any questions or research that should be done as<br />
part <strong>of</strong> the effort to create an Entertainment District in the Heritage District. Staff will<br />
research the success <strong>of</strong> this type <strong>of</strong> district in Glendale and Mesa and bring the<br />
information to the Redevelopment Commission at the next meeting. All landowners within<br />
the District and 300’ outside the District will be notified <strong>of</strong> the proposed Entertainment<br />
District, the Redevelopment Commission would hold a hearing on the proposal for a<br />
recommendation to the <strong>Town</strong> Council and the <strong>Town</strong> Council would review the proposal<br />
for adoption <strong>of</strong> an Entertainment District with a Resolution.<br />

Chairman Barlow opened the floor to the public for any comments or communications on<br />
items not on the <strong>agenda</strong>. There were no communications from citizens.<br />
Chairman Barlow modified the <strong>agenda</strong> to allow an update under <strong>agenda</strong> item #7 be given by<br />
Economic Development Director Henderson before the Presentation portion <strong>of</strong> the <strong>agenda</strong>.<br />
ADMINISTRATIVE ITEMS<br />
7. Update on Projects in the Heritage District<br />
Economic Development Director Henderson provided an update and made the Commission<br />
aware <strong>of</strong> a partnership that is in place with Local First AZ. Local First AZ is a shop local group<br />
and through tourism funds, <strong>Gilbert</strong> authorized a “Small Wonders Map” (print version and digital<br />
version) that will link the Downtown with other attraction amenities. He indicated that the<br />
group will be in the downtown soliciting ads and buy-in for the maps. The town will participate<br />
by funding two-thirds with tourism money and one-third from individuals who wish to advertise<br />
in the Small Wonders Map.

The other update by Economic Development Director Henderson was about the ASU Masters<br />
<strong>of</strong> Real Estate Development (MRED) Program. The Program kicked <strong>of</strong>f with Synthesis 2 in<br />
November 2012. He mentioned over the course <strong>of</strong> the year the program does three synthesis<br />
projects. The students will inventory town land and in March 2013 will give their proposal,<br />
assumptions and summation <strong>of</strong> the program and initiatives. Economic Development Director<br />
Henderson indicated the AUS MRED students will come to the January Redevelopment<br />
Commission to give a more formal presentation and briefing.<br />
Economic Development Director Henderson mentioned Synthesis 3 will take the students<br />
through May 2013 and complete the project for <strong>Gilbert</strong>. It is still in draft form and the <strong>Town</strong><br />
has provided facts and figures to the students. An invitation was extended to the students to<br />
tour the community, morning and/or night to get a feel <strong>of</strong> the land and <strong>of</strong>fered town services if<br />
there were any questions. So that the community will have access, a link will be provided on<br />
the Heritage District webpage.<br />
PRESENTATION<br />
1. Public Art Sculpture Project<br />
Arts subcommittee representative, Ms. Diane Fales, gave an informational update on the art<br />
sculpture options being considered. Some examples were included in the Redevelopment<br />
Commission packets. Presentation included:<br />
• Consider fiberglass statues as a canvass for local artists to contribute to public art<br />
• Neighbors in Chandler coordinated such a project approximately five years ago –<br />
Ostrich forms.<br />
• Use various forms to support a theme, enhance certain activities. Example given:<br />
painted giant eggs were part <strong>of</strong> an area-wide egg hunt in England. It can generate<br />
excitement.<br />
• Interested in use <strong>of</strong> benches. Businesses could sponsor a bench.<br />
• Benches and chairs can become a social media – creates photo opps for tourists.<br />
• Benches could be strategically located in the Heritage District.<br />
• Use <strong>of</strong> different season for placement <strong>of</strong> items.<br />
In conclusion, Ms. Fales mentioned she will keep the Redevelopment Commission informed as<br />
more details are available.<br />
PUBLIC HEARING<br />
2. Z12-21 An amendment to the <strong>Town</strong> <strong>of</strong> <strong>Gilbert</strong> Land Development Code in the<br />
Heritage Village Center Zoning District<br />
Chairman Barlow opened the public hearing for Z12-21 A request to amend the <strong>Town</strong> <strong>of</strong><br />
<strong>Gilbert</strong> Land Development Code, Chapter I Zoning Regulations, Division 2: Land Use<br />
Designations, Article 2.4: Heritage Village Center Zoning District, Section 2.402 Land Use<br />
Regulations Table - Heritage Village Center District, Limitation L2 - Drive-through prohibited,<br />

related to the restriction <strong>of</strong> drive-through facilities. A definition for a service bay will be added. The<br />
effect <strong>of</strong> the amendment will be to permit or permit with additional regulations a drive-through use in<br />
the Heritage Village Center Zoning District.<br />
Principal Planner Edwards gave a quick review <strong>of</strong> the previous meeting discussions pertaining to<br />
a request for a text amendment to change the current zoning regulations <strong>of</strong> drive-through<br />
facilities in the Heritage District.<br />
Overview included:<br />
• Discussed at the October 17 th , October 29 th and November 14 th Redevelopment<br />
Commission meetings and Planning Commission Study Sessions November 7 th and<br />
December 5th.<br />
• A c<strong>of</strong>fee company wants to renovate an existing building and convert a service bay to a<br />
drive-through facility and the Heritage Village Center Zoning District restricts drivethroughs.<br />
• HVC Zoning located along <strong>Gilbert</strong> Road and the vacant parcels west <strong>of</strong> <strong>Gilbert</strong> Road.<br />
• Heritage District currently has two (2) drive-through facilities (Burger King & Dairy<br />
Queen) and two (2) Service Bay facilities (Xpress Lube & Clements Garage). Two<br />
drive-throughs and one service bay on the north side <strong>of</strong> canal. West <strong>of</strong> <strong>Gilbert</strong> Road is<br />
mostly vacant while the east side is completely developed. Clements Garage is located<br />
on the east side <strong>of</strong> <strong>Gilbert</strong> Road just north <strong>of</strong> the railroad tracks surrounded by<br />
undeveloped land.<br />
• The Vision <strong>of</strong> Heritage District has been the same since the Redevelopment Plan was<br />
adopted. The Heritage District will be a destination to visit, shop, work and live. It will<br />
be a place where new residents can visit and connect with the <strong>Town</strong>’s origin. The<br />
Heritage District will, again, be the vital center <strong>of</strong> the <strong>Town</strong>. The vision has not changed<br />
but what has changed are the players, businesses, needs <strong>of</strong> the community and the<br />
economy.<br />
• Tools to guide the Vision include the Redevelopment Plan, General Plan, Heritage<br />
District Overlay Zoning District, Heritage Village Center Zoning district, two Urban<br />
Design Team Recommendations (DAT Studies), Heritage District Design Guidelines<br />
and the ASU Mixed-Use Guideline Study.<br />
• Key words in the vision statement are quality, variety, historic compatibility, mixed uses,<br />
active uses, pedestrian ambiance and public use.<br />
• The purpose in the Land Development Code for the Heritage Village Center zoning<br />
district is intended to foster small scale, pedestrian oriented mixed-use development<br />
and encourage a mix <strong>of</strong> uses-high density residential, retail service, <strong>of</strong>fice, lodging,<br />
entertainment, public and quasi public and cultural uses. It will encourage quality and<br />
variety in building, landscape, signage design, insure historic compatibility in land use and<br />
reinforce the historic character <strong>of</strong> the downtown, support mixed commercial and<br />
residential areas and attract active uses that will enhance the pedestrian ambiance <strong>of</strong> the<br />
downtown.<br />

• Supporting the vision are established goals such as:<br />
o Promote quality urban design with emphasis on small town historical character.<br />
o Insure the economic viability <strong>of</strong> downtown. Promote reinvestment and attract<br />
new development.<br />
o Improve pedestrian and auto circulation to ensure pedestrian safety.<br />
o Promote downtown as the symbolic/cultural center <strong>of</strong> the community.<br />
• The HVC Zoning District currently has a L2 limitation prohibiting drive-through facilities<br />
for Automated Teller machine, Banks and Other financial institutions, dry cleaning and<br />
Laundry Outlet, Restaurants, Beverage Service Restaurant, Limited Service.<br />
• <strong>Gilbert</strong> has only two other areas with the same L2 limitation—Gateway Village Center<br />
District (110 acres) and the Gateway Business Center (GBC). No drive-throughs are<br />
permitted in Chandler’s City Center or Scottsdale’s Downtown Overlay District.<br />
Principal Planner Edwards also reviewed the different zoning options available for a text<br />
amendment to the <strong>Gilbert</strong> Land Development Code.<br />
• Option 1: Delete Existing L2 limitation – Permits drive-throughs in the HVC Zoning<br />
District.<br />
• Option 2: Modify Existing L2 limitation – existing drive-through lane. The L2 limitation<br />
for the property north <strong>of</strong> the Western Canal could be revised to state that existing<br />
drive-throughs facilities and Service Bay/Roll Up door facilities can remain and continue<br />
to be used as drive-throughs until the drive-through facility is no longer there. An<br />
existing Service Bay/Roll Up door would be able to convert to a drive-through facility.<br />
A public comment was given suggesting a Use Permit could also be a requirement when<br />
a drive-through facility has a new user or Service Bay/Roll up door facility conversion is<br />
proposed. A suggestion was also made at a previous meeting that a Use Permit could<br />
also be a requirement as well as limit to restaurant uses.<br />
• Option 3: Modify Existing L2 limitation – location north <strong>of</strong> Western Canal on East side<br />
<strong>of</strong> <strong>Gilbert</strong> Road. The L2 Limitation could be revised to state that the limitation does<br />
not apply to the area north <strong>of</strong> the Western Canal on the east side <strong>of</strong> <strong>Gilbert</strong> Road.<br />
• Option 4: Use Permit. Delete the L2 limitation and require a Use Permit.<br />
• Option 5: Unique Findings for a Use Permit – Require findings today for all Use<br />
Permits. Some unique findings could address standards such as circulation, access,<br />
stacking, hours <strong>of</strong> operation.<br />
• Option 6: Change the zoning district boundary – A different zoning district could be<br />
proposed for the area north <strong>of</strong> the Western Canal and east <strong>of</strong> <strong>Gilbert</strong> Road. General<br />
Commercial could be proposed. In order to do this, it would require a Prop 207 waiver<br />
from all the property owners and go through a zoning boundary change. From a<br />
planning perspective, may lose a great deal <strong>of</strong> flexibility.<br />
Interim Planning Manager Edwards reviewed the limitations and Use Definitions for the text<br />
amendment.<br />

Limited Service (This was later deleted in the motion because it is not the intent<br />
to require all Eating and Drinking Establishments to require a Use Permit – just<br />
those affected by this L2 change. Since the Use Permit requirement is part <strong>of</strong> the<br />
language for the L2b text amendment, it was deleted from the chart.)<br />
• Added a use definition for Service Bay Facility – A building containing bay or roll-up<br />
doors or similar service openings to provide a service within the building.<br />
Interim Planning Manager Edwards made a correction that the U should be removed and for<br />
the Redevelopment Commission to strike it from the motion if they desire to move forward.<br />
In conclusion, Interim Planning Manage Edwards emphasized the following points from the<br />
Powerpoint Presentation:<br />
• Affects the HVC zoning district, specifically north <strong>of</strong> the canal, not all property in the<br />
Heritage District<br />
• Affects existing drive-throughs currently with restaurant uses to continue as restaurant<br />
uses with a drive-through facility and provides an opportunity for an auto use that is no<br />
longer permitted to convert to a restaurant use with a drive-through facility.<br />
• A vibrant destination has a mix <strong>of</strong> uses. Includes a working environment and<br />
commercial activities.<br />
• Chandler and Scottsdale centers have grandfathered drive-through uses.<br />
• Pedestrian ambiance includes outdoor seating and places for people to gather. Active<br />
uses enhance pedestrian ambiance.<br />
• Vision – a place to work-gather-dine, no single use dominates the area, is economically<br />
sustainable.<br />
• Goals in the Redevelopment Plan and Character area promote reinvestment and ensure<br />
pedestrian safety.<br />
• Findings for Use Permit will review access, circulation, stacking, hours <strong>of</strong> operation,<br />
noise, light and visual impacts.<br />

Interim Planning Manager Edwards mentioned the Planning Commission comments received<br />
during its December 5 th meeting.<br />
• Concern about the future pedestrian connections from the south <strong>of</strong> Heritage District<br />
through up to the north.<br />
• The north side <strong>of</strong> canal has a different feel - has a different pedestrian focus – more<br />
vehicular.<br />
• No action should be considered and the L2 restriction should continue.<br />
• The amendment seems too specific.<br />
• Access from <strong>Gilbert</strong> Road.<br />
• Question about a Use-Permit.<br />
Chairman Barlow opened the <strong>agenda</strong> item to the public and requested the speakers to limit<br />
their comments to two minutes. Slips received as follows:<br />
• 5 in favor and wished to speak<br />
• 5 in opposition and wished to speak<br />
• 6 in favor and did not want to speak<br />
• 3 in opposition and did not want to speak<br />
Ms. Linda Bergeson, owner <strong>of</strong> properties in the Heritage District, wanted clarification on how<br />
the proposed text amendment if passed would affect existing drive-throughs. Interim Planning<br />
Manager Edwards responded if an existing drive-through (example: Burger King) closes its<br />
doors, the text amendment would allow the drive-through to stay as long as the new user is a<br />
restaurant. If the text amendment is not approved and Burger King closes and closed more<br />
than 12 months, the drive –through goes away. Ms. Bergeson read from a statement: she<br />
prepared “My husband and I grew up and graduated from schools in the Old <strong>Town</strong> Scottsdale<br />
area. We had an opportunity to visit the Old <strong>Town</strong> Scottsdale area twice in the last three<br />
weeks. It was amazing to see what most <strong>of</strong> what we remembered, including my husband’s high<br />
school, gone and replaced with new development. The good part was that it still had its 5 th<br />
Avenue that we remember, Sugarbowl and some <strong>of</strong> the other old style shops that we<br />
remember. It was very pedestrian friendly and we spent quite a lot <strong>of</strong> time walking the entire<br />
area which was very pleasant experience. Most importantly it seems like it has transformed<br />
itself through vision and planning into a destination that attracts people from around the world<br />
which she hopes it is the ultimate goal <strong>of</strong> <strong>Gilbert</strong> since she is a long time resident.” She does<br />
not believe that having drive-through in their downtown area attracts anyone and is only a<br />
convenience. She mentioned a comment made previously by a Commissioner about the way<br />
the northern section <strong>of</strong> the Heritage District is probably the best it will be in our lifetime. She<br />
felt it is a very narrow view and hopes this is not the view <strong>of</strong> the Commission or leaders <strong>of</strong> the<br />
<strong>Town</strong> <strong>of</strong> <strong>Gilbert</strong> in relations to our Heritage District. You only have to look at the neighbors<br />
in Scottsdale and Chandler to understand that there is a limited to life to some businesses that<br />
allow others to rise (example: empty lot next to Bergies). The building had been there for<br />
many years and no one could perceive what happened to it in July. It is now gone and a new<br />
development will come in; hopefully, a development that wants to abide by the guidelines <strong>of</strong> the<br />
Heritage District. She believes that a master plan and vision <strong>of</strong> which the Commission was<br />

appointed to be a part <strong>of</strong> to work to enhance the plan for the good <strong>of</strong> the entire district. She<br />
does not believe the position is to change the rules for those that come in and do not want to<br />
comply with the current codes. In her opinion, a good addition to our neighborhood district is<br />
someone who does not come and immediately start asking to change the rules but one who<br />
comes in and adapts their plans to the existing vision <strong>of</strong> the neighborhood. Approval <strong>of</strong> this<br />
drive-through will open the door for future requests for exemptions and weaken the plan and<br />
vision for the district that has previously been overwhelming approved by its Citizens,<br />
Commissioners, Planners and Council in the <strong>Town</strong> <strong>of</strong> <strong>Gilbert</strong>. She urged the Redevelopment<br />
Commission to vote no on the text amendment.<br />
Mr. Dan Roberts, property owner <strong>of</strong> the building, read a statement – “All plans including our<br />
nation’s Constitution need flexibility in amending from time to time as none are going to be<br />
perfect forever. For this reason the City uses text amendments. For over twenty years nothing<br />
has happened north <strong>of</strong> the canal to bring it closer to meeting the desired goals. Each change<br />
over time and flexibility <strong>of</strong> regulation are needed to achieve this. The Heritage District’s goal <strong>of</strong><br />
becoming a popular place to work, gather, dine, relax, shop, and live has started to become a<br />
reality in the core and at the south end <strong>of</strong> the district. However, it is not due to the zoning<br />
regulations. If our City stuck to the exact vision as seen in the dream pictures presented as the<br />
desired ideal, today, we would not have Joe’s Real BBQ, Oreganos or Postinos. Those buildings<br />
are not built according to the vision <strong>of</strong> two or more story buildings as well as other<br />
restrictions. Because they were allowed, we have the exact desire and outcome <strong>of</strong> vibrancy for<br />
the area. This text amendment does not interrupt any positive progress in the core or the<br />
south end <strong>of</strong> the district. It is limited to the existing buildings with drive-through or service<br />
bays north <strong>of</strong> the canal. The north end <strong>of</strong> the district is nothing like the south end <strong>of</strong> the core.<br />
The speed limit is higher, there are existing drive throughs such as Dairy Queen and Burger<br />
King and there are no defining improvements there. Most people feel like the downtown<br />
begins south <strong>of</strong> the canal where the speed limit is reduced to 25 mph. Those who do a visual<br />
inspection <strong>of</strong> the location understand the reasonableness <strong>of</strong> the request. The building has a<br />
useful life <strong>of</strong> another 30 years and not likely to be torn down anytime soon nor will the<br />
buildings surrounding it. Some flexibility is needed as the property could go on forever in its<br />
grandfathered use <strong>of</strong> an automotive service business. New automotive uses are not permitted.<br />
This is a rare opportunity to go from meeting zero percent <strong>of</strong> the goal to 99% <strong>of</strong> the goal.<br />
Successful pedestrian areas not always 100% car free. Pedestrian-friendly areas such as<br />
Agritopia are planning to incorporate drive throughs in the epic center main street shopping<br />
area, the SanTan Mall is pedestrian friendly area which incorporates vehicles throughout.<br />
Despite the tight regulations, Downtown Scottsdale and Chandler have drive throughs within<br />
their boundaries and all part <strong>of</strong> a mixed-use area. The goal and vision is a vibrant place to<br />
work, gather dine relax shop and live it is not to have only two story buildings or eliminate<br />
every car. For the property to reach its highest use and achieve the desired goal <strong>of</strong> the District<br />
<strong>of</strong> having a more vibrant, pedestrian-friendly, family place to work, live and play, the text<br />
amendment is essential.”<br />
Mr. Bruce Bergeson, <strong>Gilbert</strong> resident – Said Joe’s BBQ has been in the Heritage District for a<br />
long time and did not receive any special treatment. Mr. Bergeson indicated he is a business<br />
owner in the downtown and one reason he opened a business is because <strong>of</strong> the vision and<br />

pedestrian-friendly feel <strong>of</strong> the Heritage District. He said drive-throughs and pedestrians have<br />
anything in common. Ms. Bergeson has not seen any traffic flow plans as to how it will be<br />
converted. He does not see any common sense in allowing the text amendment.<br />
Mr. Jim Desmarchais, resident <strong>of</strong> <strong>Gilbert</strong>, stated he is in total support <strong>of</strong> what is being proposed<br />
with the text amendment. He indicated he has lived in <strong>Gilbert</strong> for a long time and have<br />
watched the downtown area start to grow with Joe’s and Liberty Market and other businesses<br />
but at the north nothing has been happening. If a business is looking for somewhere to locate,<br />
they are looking for other customers. The oil change place that is struggling and may end up<br />
closing which will not entice other businesses to come to the downtown Mr. Desmarchais<br />
also mentioned you cannot anticipate what the future will bring, and that is why there is a<br />
process in place to review the plan. He said the text amendment is very specific so it will not<br />
allow any abuse and will not lose the overall vision <strong>of</strong> the area.<br />
Mr. Alan Fitzgerald, <strong>Gilbert</strong> resident and property owner in the Heritage District provided the<br />
following comment. He said what has been heard tonight goes in opposition with<br />
conversations he had with certified urban designers about the impact <strong>of</strong> traffic in drive-throughs<br />
on being pedestrian friendly. It was stated by the <strong>Town</strong> that they consider drive throughs to be<br />
family- friendly. It is in opposition to best practices in urban design. He is opposed to the<br />
change and wants to stay the course mostly because it does not represents what is safest in<br />
that area. The original presentation given stated it would generate additional 400 – 500 cars<br />
per day and nobody has refuted that or changed that. There have been no published safety<br />
studies, any needed modifications to the street to support the additional traffic, input from the<br />
residents, businesses and school in the surrounding area concerning <strong>of</strong> viability that the<br />
additional traffic and the safety they may have. He thinks the best practice in urban design<br />
strongly points against making a change like this.<br />
Ms. Heidi Serrano, a <strong>Gilbert</strong> resident, read through everything to get a grasp on both sides <strong>of</strong><br />
this situation. She said this is good problem to have which is that a business wants to locate to<br />
<strong>Gilbert</strong> and wants to be in the Heritage District. She pointed out that not long ago, <strong>Gilbert</strong> was<br />
losing businesses, couldn’t get business here and people were losing their jobs and it is great<br />
that <strong>Gilbert</strong> is having this discussion today. She said times change and things change. You need<br />
to reevaluate and reanalyze what is going on and what changes are being made. This is where<br />
we are at today and <strong>Gilbert</strong> has an opportunity <strong>of</strong> a business wanting to locate in <strong>Gilbert</strong>. She<br />
said Dutch Bros is a national company and a business that has proven itself. They are locally<br />
owned and the pr<strong>of</strong>itability goes back into the community.<br />
Ms. Lisa Krapf, a <strong>Gilbert</strong> resident, spoke against the proposed text amendment. She was<br />
somewhat confused on why drive-throughs were lumped together with service bays when they<br />
are two total separate things. Ms. Krapf said that pedestrian friendly to her is not having<br />
anything to do with drive-throughs. She stated there are school children that have to walk<br />
home every day and with cars entering and exiting driveways for the proposed drive-through is<br />

not a good mix. Also it was mentioned to attract active uses that will enhance the pedestrian<br />
ambiance. She thinks it is contradictory to drive throughs period. She would love to have<br />
more businesses come in but why is there a need for a drive-through as opposed to just having<br />
a restaurant or a c<strong>of</strong>fee house without a drive through.<br />
Ms. Christina Shelley, a <strong>Gilbert</strong> resident, spoke on the proposed text amendment and voiced<br />
her thoughts. She mentioned it is apparent the current car repair business will not survive and<br />
why take a chance <strong>of</strong> having the building vacant and invites vandalism and decay. She said that<br />
the current employees will be kept and retrained. Ms. Shelley said it does invite pedestrian<br />
traffic and it has a place to sit outside. She said she has a six year old grandson who would go<br />
over to Dairy Queen while she has a cup <strong>of</strong> c<strong>of</strong>fee. <strong>Gilbert</strong> needs to encourage whatever form<br />
<strong>of</strong> local business you can.<br />
Ms. Russell Krapf, a <strong>Gilbert</strong> resident, spoke on other communities (Providence, RI, Boston, MA,<br />
and Biloxi, MS) where revitalization went right out the window due to decision that were made.<br />
Mr. Krapf said the only city that stood fast was New Orleans, LA where they kept out all drivethroughs<br />
and kept the historical character intact. Pedestrian-friendly and drive-throughs do not<br />
mix and has a concern with the traffic. People will avoid <strong>Gilbert</strong> Road.<br />
Ms. Nancy Roberts, a <strong>Gilbert</strong> resident and property owner and stakeholder in the District. Ms.<br />
Roberts indicated that several years ago there was only one, large locally owned restaurant<br />
called Joe’s Real BBQ in the downtown. Then along came Oregano’s which needed special<br />
zoning overlays in order to build their business. Accommodations were made allowing them to<br />
build and the outcome has been a happy ending for the downtown. Similarly, the proposed text<br />
amendment will allow a wonderful new neighbor also locally owned and operated to the<br />
district. The current auto business is locally owned and operated franchise which has not<br />
bothered anyone. The proposed new c<strong>of</strong>fee company has a well-established reputation <strong>of</strong><br />
being a good neighbor to other businesses. This can be seen in their current locations where<br />
they co-exist harmoniously with multiple competing c<strong>of</strong>fee shops each one thriving in their own<br />
niche. The contributions to area schools and communities can be seen in numerous articles.<br />
<strong>Gilbert</strong> can choose to walk away from this opportunity and move into the direction <strong>of</strong> the<br />
vision and remain with an auto use for another thirty year or embrace this opportunity.<br />
Ms. Roberts ended with a statement from c<strong>of</strong>fee company’s philosophy <strong>of</strong> operation. It is the<br />
company’s Optimist Creed: Talk health, happiness and prosperity to every person you meet;<br />
look at the sunny side <strong>of</strong> everything and make your optimism come true, think only the best,<br />
work only for the best and expect only the best, be just as enthusiastic about the success <strong>of</strong><br />
others as you are about your own, give so much time to the improvement <strong>of</strong> yourself that you<br />
have no time to criticize others.<br />
Ms. Roberts indicated this is the type <strong>of</strong> neighbor <strong>Gilbert</strong> would want to have and want to be<br />
ourselves. Perhaps then everyone can fully reach the goal <strong>of</strong> becoming a popular place to work,<br />
gather, dine, relax, shop, and live together.<br />

Ms. Roberts thanked the Redevelopment Commission for the enormous amount <strong>of</strong> time and<br />
energy that were put into the request.<br />
Chairman Barlow closed the public portion <strong>of</strong> <strong>agenda</strong> item #2 and brought it back to the<br />
Redevelopment Commission for discussion<br />
The Commission had an opportunity to comment on the issue as well as ask question.<br />
Vice Chairman Torgeson mentioned people have a desire to see a vision which started twentytwo<br />
years ago. He said it is a different world. Vice Chairman Torgeson pointed out that the<br />
alley behind Postino’s will mix vehicles and pedestrians on the same piece <strong>of</strong> asphalt. He said<br />
that area will have more pedestrian problems there then with a driveway. Vice Chairman<br />
Torgeson said the town will not ignore any safety issues and it will be stopped at Council if<br />
something is deemed unsafe and would be addressed. The Redevelopment Commission’s<br />
responsibility is to discuss so that respect is given to all sides. Vice Chairman Torgeson stated<br />
he would rather consider this option rather let it turn into a pawn shop or quick loan shop.<br />
Commissioner McNally remembered when Postino’s was introduced to the Heritage District<br />
and googled “wine bars”. He was surprised to see Liberty Market at the top <strong>of</strong> the list. He<br />
said everyone is happy with the outcome. He also stated that competition is good.<br />
Commissioner McNally does not want to stop traffic from coming to the area but try to<br />
increase traffic. He does not think it would create too much additional traffic and there are<br />
plenty <strong>of</strong> staff to look at and review the traffic portion <strong>of</strong> the request.<br />
Commissioner Hamilton indicted there are valid points on both sides. He believes in the vision<br />
but now facing the reality <strong>of</strong> existing building and it existing uses. He thinks it is a narrow way<br />
to promote reinvestment and up-use. Commissioner Hamilton had a small comment on the<br />
language <strong>of</strong> the text amendment.<br />
Commissioner Fresquez mentioned she will not be supporting the text amendment and gave<br />
her rationale. She does not believe the text amendment supports the vision <strong>of</strong> the Heritage<br />
District. She said the vision statement for the Heritage District is lengthy, finely crafted and<br />
heavily wordsmithed. Commissioner Fresquez said there is a process to change the vision and<br />
felt the Redevelopment Commission may want to re-look at the vision and perhaps have a<br />
vision for the retail core, one for the north and one for the southern section and maybe just<br />
look at one vision that actually incorporates everything. Visions are long-term. Commissioner<br />
Fresquez also had a safety concern southbound from Juniper and may be dangerous to turn left.<br />
She said it may not even be legal to turn left as it is stripped for left turn going north. This has<br />
not been addressed and whatever changes needed the expenses not be for the town but for<br />
the business. She heard a comment from the owner that when they purchased the property<br />
that they were not aware they were in the Heritage District because there is no signage.<br />
Commissioner Fresquez mentioned that there is no master plan or economic plan in place and<br />
had inquired <strong>Gilbert</strong> is moving in that direction.<br />

Chairman Barlow reiterated he had been on the Redevelopment Commission for 9 years and<br />
believes in the vision but things have changed. Segments along <strong>Gilbert</strong> Road will need to be<br />
revisited and that a Master Plan & signage is needed. He pointed out one <strong>of</strong> the reasons he<br />
located his business to the Heritage District on <strong>Gilbert</strong> Road was the traffic counts. He wanted<br />
the exposure. He has not noticed any traffic congestion. Chairman Barlow said he was sorry<br />
that some members <strong>of</strong> the community are feeling we have slighted them in some manner but<br />
has been objective in keeping an open-mind.<br />
Commissioner Hamilton to add drive-through to L2b so that it will read: Existing drive-through<br />
facilities located north <strong>of</strong> the Western Canal may continue to operate as drive-through facilities<br />
until the drive-through facility no longer exists. An existing Service Bay facility located north<br />
<strong>of</strong> the Western Canal may convert to a drive-through facility for the Restaurants, Beverage<br />
Service or Restaurants, Limited Service uses until the drive-through facility no longer exists. A<br />
Use Permit is required.<br />
A MOTION was made by Commissioner McNally, seconded by Vice Chairman Torgeson as<br />
follows: For the following reasons: the text amendment proposal conforms to the intent <strong>of</strong> the<br />
General Plan and the purpose statements <strong>of</strong> the Heritage Village Center Zoning District for<br />
existing and future development, the Redevelopment Commission moves to recommend to the<br />
Planning Commission that they recommend approval to the <strong>Town</strong> Council <strong>of</strong> Z12-21, a Land<br />
Development Code text amendment to modify the L2 limitation in Table 2.402 Land Use<br />
Regulations – Heritage Village Center Zoning District, and a Use Definition for Service Bay<br />
Facility as described below:<br />

approve the minutes <strong>of</strong> the regular meeting <strong>of</strong> the Redevelopment Commission <strong>of</strong> November<br />
14, 2012 as amended. Voice vote carried 5-0.<br />
4. Review Holiday Decoration/Events in the Heritage District<br />
Parks and Recreation Manager Anderson gave an update on holiday decorations but wanted to<br />
expand it to facilitate a discussion about future special events in the Heritage District. Parks<br />
and Recreation Manager Anderson heard tonight a lot <strong>of</strong> thought about vibrancy in a<br />
downtown and if you look around at other communities it happens through special events and<br />
how it can create a festive atmosphere. He indicated a possibility <strong>of</strong> taking one <strong>of</strong> the current<br />
<strong>Town</strong> events and putting it in the downtown such as the Fall Festival as well as possibly looking<br />
at special times <strong>of</strong> the year in which <strong>Gilbert</strong> Road would have to be closed. Parks and<br />
Recreation Manager Anderson asked for some feedback from the Redevelopment Commission<br />
so that discussions could begin after the first <strong>of</strong> the year.<br />
Commissioner Fresquez thinks it is a great idea. She asked if there was already an Events<br />
Committee. Parks and Recreations Manager Anderson responded no just staff. Commissioner<br />
Fresquez said if specifically talking about the Heritage District and if a subcommittee is to be<br />

formed, it would be a good idea to have members <strong>of</strong> the Redevelopment Commission as well<br />
as merchants involved. She added that she does not want to have a dark Heritage District<br />
during the holidays and is in favor <strong>of</strong> it and would like to help.<br />
Parks and Recreation Manager Anderson mentioned an idea that has been brainstormed was to<br />
have the Luminary Experience along the western canal in the downtown. Vice Chairman<br />
Torgeson mentioned the need to have areas where power is available.<br />
Chairman Barlow asked what the next step would be. Parks and Recreation Manager Anderson<br />
responded that he will return to the Redevelopment Commission after the first <strong>of</strong> the year to<br />
discuss further. It was suggested to put it on the January 23 rd Morning with the Merchants and<br />
Residents <strong>agenda</strong> as well.<br />
5. Discuss use <strong>of</strong> <strong>Town</strong> Council Chambers as a regular meeting place for<br />
Redevelopment Commission hearings<br />
Chairman Barlow asked for any comments about using the <strong>Town</strong> Council Chambers as a<br />
regular meeting place.<br />
• Vice Chairman Torgeson thinks it is a great idea. Stuff can be easily seen and lends to a<br />
more pr<strong>of</strong>essional atmosphere when people talk about investing in the downtown. The<br />
technology <strong>of</strong>fered by the room is great.<br />
• Commissioner Hamilton liked the comfortable chairs.<br />
• Commissioner McNally likes the room but felt uncomfortable being l<strong>of</strong>ted above the<br />
audience.<br />
• Commissioner Fresquez said she likes having the Redevelopment Commission meetings<br />
in the Heritage District. She thinks it would impact those who would attend if the<br />
venue is moved. Her preference would be to return to the Heritage District.<br />
• Chairman Barlow likes the location in the Heritage District but prefers being on the<br />
same level with the audience. He did like the technology <strong>of</strong>fered with the Council<br />
Chambers. His preference would be to return to the Heritage District.<br />
Commissioner McNally asked if there would be any conflicts with use <strong>of</strong> Council Chambers.<br />
Interim Planning Manager Edwards responded that Conference Room 300 would be a viable<br />
alternative if Council Chambers was not available.<br />
6. Committee Update<br />
a. Downtown <strong>Gilbert</strong> Partnership Report<br />
Commissioner Fresquez reported the Downtown <strong>Gilbert</strong> Partnership has not met but has<br />
intentions to re-invigorate the group after the holidays. She said after the last couple <strong>of</strong><br />
months, if stakeholders or anyone who has an interest in the Heritage District is invited to join.<br />
She said it is an important group and intends to put more effort into it.<br />
b. HRCAP Board and Art Subcommittee Report<br />
Chairman Barlow said it was a great presentation by Ms. Fales and did not have anything further<br />
to report.<br />

c. Event Committee<br />
Commissioner McNally indicated he will attend the 9 a.m. meeting on December 20 th . He did<br />
not have any information as to the success <strong>of</strong> the carnival. He mentioned the Giving Challenge<br />
did not draw as many people as anticipated and does not know the future status <strong>of</strong> it.<br />
d. <strong>Gilbert</strong> Historical Society<br />
Commissioner Fresquez mentioned <strong>agenda</strong> item pertains to the Steering Committee looking at<br />
the idea for a cultural center. Commissioner Fresquez is a member <strong>of</strong> two committees:<br />
• Development Committee which consist <strong>of</strong> 6 members (four Board members and two<br />
consultants)<br />
• Large Steering Committee which consists <strong>of</strong> 15 - 18 members and two consultants. The<br />
group brainstormed ideas for cultural centers and will have some additional meetings<br />
prior to issuing an RFP for a Feasibility Study.<br />
To help with the communications, a drop box was established where you can find research<br />
from other communities, creation <strong>of</strong> an e-newsletter. The Steering Committee is using as a<br />
guideline the report from the City <strong>of</strong> Chandler.<br />
Commissioner Fresquez will provide another update next month.<br />
7. Update on Project in the Heritage District<br />
Principal Planner Edwards mentioned the following updates:<br />
• The Farmers Market, Food Truck Event and Artwalk are still occurring on the weekends<br />
and sharing customers.<br />
• Temporary parking lots are being well utilized.<br />
• New Businesses--Flashback Antiques now opened in the previous Gallery 225 location.<br />
Encouraged the Commission to visit the location.<br />
• The Mexican Food Restaurant next to Postinos East has pulled its permits for Tenant<br />
Improvements. Anticipates being open by April 2013.<br />
• The new Fish Taco currently working on their construction drawings for their tenant<br />
improvements by the barber.<br />
• The dentist at 26 N. <strong>Gilbert</strong> Road has submitted construction drawings and ready to<br />
pull permits.<br />
• The sale <strong>of</strong> the Beavin property is in escrow. Commissioner Fresquez asked who has<br />
purchased the property. Interim Planning Manager Edwards said the property is being<br />
purchased by the owners <strong>of</strong> Postinos and Oakmark Development, Craig Demarco and<br />
Mike Bennan.<br />
• Mr. Mike Bennan with Oakmark Development would like to meet with the<br />
Commissioners to begin discussions about the new building on the north side.<br />

• On the December 20 <strong>Town</strong> Council <strong>agenda</strong> will be an amendment <strong>of</strong> the development<br />
agreement for the Heritage Marketplace and garage-related issues. He encouraged the<br />
Redevelopment Commission to look at the staff report which is available on-line and if<br />
there were any comments to contact staff.<br />

Chairman Torgeson.<br />
Special Events<br />
Merchants<br />
<strong>Town</strong> <strong>of</strong> <strong>Gilbert</strong> Facebook home web page has links to businesses in the Heritage<br />
District. View the latest video created by the <strong>Gilbert</strong> Art Walk that speaks to the<br />
downtown.<br />
Christmas banners were created locally and hung for the first time this season.<br />
Engineering staff continues to work on the street improvement/flashing beacon safety<br />
project that was funded with CDBG funds.<br />
The renewal <strong>of</strong> the Heritage Marketplace Development Agreement was approved by<br />
<strong>Town</strong> Council on 12/20/12. Development should start by December 2013 and at least two<br />

estaurants will be substantially complete by September 2014. The parking spaces in the<br />
future parking garage are no longer committed solely for this development.<br />
Oakmark Development continues to meet with staff and the Commission members on the<br />
draft proposal to build on the north side <strong>of</strong> Postino East in the next few months.<br />
A dentist continues to pursue 26 N. <strong>Gilbert</strong> Road for his place <strong>of</strong> business.<br />
A Fish Taco Restaurant is proposed next to the Barber on <strong>Gilbert</strong> Road. The space is<br />
currently vacant and the new design will include outdoor seating on the east side <strong>of</strong> the<br />
space facing the parking area. Construction continues and the opening is scheduled for<br />
January/February.<br />
The Farmer’s Market is now open 8am to Noon at the Park and Ride lot on Ash Street by<br />
the Water Tower Plaza.<br />
The Food Truck event will be held on Fridays from 4-11pm and on Saturdays from 9am –<br />
3pm. The event will run through June 2013.<br />
The <strong>Gilbert</strong> Art Walk will be held in the Water Tower Plaza on the first and third Saturdays<br />
<strong>of</strong> the month – Jan 5 and 19, Feb 2 and 16, March 2 and 16.<br />
The Morning with Heritage District Merchants and Residents meeting is scheduled for<br />
January 23, 2013 at 7:30 a.m. at the Boys & Girls Club on Oak Street in <strong>Gilbert</strong>.<br />
Postcards mailed to residents 1/3/13, e-mails sent on 12/26/12 to merchants with e-mail<br />
and a flyer mailed to merchants without an e-mail.<br />
