Some believe and argue that Kyrgyz civil society organizati<strong>on</strong>s have been<br />

strengthened enough, and can interact with the State as an equal partner. Others c<strong>on</strong>sider<br />

civil society as inherently inferior and dependent <strong>on</strong> the state. Such debates take place<br />

in every area <strong>of</strong> the world, and c<strong>on</strong>stitute a discourse that is present and significant at<br />

the internati<strong>on</strong>al level.<br />

Pr<strong>of</strong>essor Robert Putnam <strong>of</strong> Harvard University, who undertook important research<br />

<strong>on</strong> civil societies in the U.S.A. and Italy, dem<strong>on</strong>strated that the strength <strong>of</strong> the state<br />

is directly proporti<strong>on</strong>al to the strength <strong>of</strong> its civil society. In other words, he proved<br />

that a str<strong>on</strong>g society equals a str<strong>on</strong>g state. 22 This briefing is based <strong>on</strong> the assumpti<strong>on</strong><br />

that the findings <strong>of</strong> Pr<strong>of</strong>essor Putnam are correct, and that the success and welfare <strong>of</strong> a<br />

country should be worked <strong>on</strong> jointly by the government, business and n<strong>on</strong>-government<br />

sectors.<br />

This briefing generally c<strong>on</strong>cludes that in Kyrgyzstan, a significant level <strong>of</strong> interacti<strong>on</strong><br />

exists between government and n<strong>on</strong>-government sectors. State instituti<strong>on</strong>s and NGOs<br />

have strengthened their instituti<strong>on</strong>al capacity since 1991 and are therefore ripe for<br />

meaningful and systematic cooperati<strong>on</strong> in the interests <strong>of</strong> citizens. One key c<strong>on</strong>straint <strong>on</strong><br />

such l<strong>on</strong>g-term and strategic cooperati<strong>on</strong> is the absence <strong>of</strong> instituti<strong>on</strong>alized mechanisms<br />

<strong>of</strong> inter-sector dialog. In this view, the experience <strong>of</strong> Poland appears both relevant and<br />

timely.<br />

The following summarizes recommendati<strong>on</strong>s for solving the major problem stated<br />

above. Their successful implementati<strong>on</strong> depends <strong>on</strong> <strong>on</strong>e c<strong>on</strong>diti<strong>on</strong>: genuine willingness<br />

<strong>of</strong> government/NGO instituti<strong>on</strong>s to cooperate <strong>on</strong> the basis <strong>of</strong> equal partnership.<br />

The legal framework for the government-NGO cooperati<strong>on</strong> must be improved.<br />

The Law <strong>on</strong> State Social C<strong>on</strong>tracts, to be signed by President, together with the bill <strong>on</strong><br />

“Social Partnership” that is now being drafted, must c<strong>on</strong>stitute the backb<strong>on</strong>e <strong>of</strong> any<br />

such legal framework. Parliamentarians and NGOs who are actively involved in this<br />

legislati<strong>on</strong> must ensure that the Law <strong>on</strong> Social Partnership will have secti<strong>on</strong>s and clauses<br />

<strong>on</strong> c<strong>on</strong>crete mechanisms <strong>of</strong> partnership. In additi<strong>on</strong>, other laws <strong>of</strong> the Kyrgyz Republic<br />

must be reviewed to improve and harm<strong>on</strong>ize the normative basis <strong>of</strong> regulati<strong>on</strong>s, so that<br />

the actual applicati<strong>on</strong> <strong>of</strong> the law will be feasible and sustainable. As an example, tax<br />

incentives could encourage the business sector to financially support NGOs.<br />

A special department <strong>on</strong> NGO Affairs must be established as a part <strong>of</strong> the Ministry<br />

<strong>of</strong> Labor and Social Protecti<strong>on</strong>. This government body would coordinate interacti<strong>on</strong>s<br />

am<strong>on</strong>g state bodies, as well as interacti<strong>on</strong>s with n<strong>on</strong>-governmental organizati<strong>on</strong>s.<br />

The <strong>Department</strong> must develop an acti<strong>on</strong> plan to implement Presidential Decree #241,<br />

whose measures enhance, legally formalize and implement in practice all forms <strong>of</strong><br />

interacti<strong>on</strong> between government agencies, bodies <strong>of</strong> local self-government, and civil<br />

society. This <strong>Department</strong> must also cooperate closely with the anticipated Parliament’s<br />

Commissi<strong>on</strong> <strong>on</strong> NGO Support. Ultimately, there needs to be a divisi<strong>on</strong> <strong>of</strong> labor. The<br />

parliamentary commissi<strong>on</strong> must be resp<strong>on</strong>sible to the legislati<strong>on</strong> <strong>on</strong> NGOs, and work<br />

directly with NGOs with an expertise to elaborate new laws, while the <strong>Department</strong><br />

must be resp<strong>on</strong>sible for the executive aspects <strong>of</strong> inter-sector cooperati<strong>on</strong>, and work <strong>on</strong><br />

the systematic implementati<strong>on</strong> <strong>of</strong> agreed provisi<strong>on</strong>s and successi<strong>on</strong> <strong>of</strong> decisi<strong>on</strong>s made<br />

by the previous government <strong>of</strong>ficials.<br />
