a) setting up an expert community to decide <strong>on</strong> formats and standards underpinning<br />

procedures for the interacti<strong>on</strong> <strong>of</strong> the state and civil society;<br />

b) inculcate in the public a sustainable and c<strong>on</strong>scious interest in the formulati<strong>on</strong> <strong>of</strong><br />

the country’s course, provide for informati<strong>on</strong> coverage <strong>of</strong> public policy-making;<br />

c) instituti<strong>on</strong>alize forms <strong>of</strong> c<strong>on</strong>tributi<strong>on</strong> by the public, and plan for coordinati<strong>on</strong> <strong>of</strong><br />

interest groups. 19<br />

The <strong>on</strong>ly problem with this Decree is that it is not being implemented in practice.<br />

Again, this problem results from the absence <strong>of</strong> any single government body resp<strong>on</strong>sible<br />

to secure its proper and timely implementati<strong>on</strong>, and to take resp<strong>on</strong>sibility in case <strong>of</strong> its<br />

n<strong>on</strong>– or improper implementati<strong>on</strong>.<br />

Less<strong>on</strong>s to learn:<br />

If we turn our attenti<strong>on</strong> to the experience <strong>of</strong> Poland, we will return to the same Law<br />

<strong>on</strong> Public Benefit Activity and Volunteerism.<br />

Above all, this law further develops the c<strong>on</strong>stituti<strong>on</strong>al “principle <strong>of</strong> subsidiarity.”<br />

Subsidiarity is “an organizing principle that matters ought to be handled by the smallest<br />

competent authority.” The Oxford English Dicti<strong>on</strong>ary defines subsidiarity as the idea<br />

that a central authority should have a subsidiary functi<strong>on</strong>, performing <strong>on</strong>ly those tasks<br />

which cannot be performed effectively at a more immediate or local level.” 20<br />

The most important provisi<strong>on</strong> <strong>of</strong> the law is the obligati<strong>on</strong> by organs <strong>of</strong> public<br />

administrati<strong>on</strong> to cooperate with NGOs in the n<strong>on</strong>-financial sphere. This includes the<br />

importance <strong>of</strong> c<strong>on</strong>sultating with interested organizati<strong>on</strong>s <strong>on</strong> normative acts and the<br />

creati<strong>on</strong> <strong>of</strong> joint, advisory teams. More generally, it requires both public administrati<strong>on</strong><br />

organs and n<strong>on</strong>-government organizati<strong>on</strong>s to work together <strong>on</strong> annual programs <strong>of</strong><br />

cooperati<strong>on</strong>.<br />

Critique <strong>of</strong> current policies<br />

The Kyrgyz government now has no clear visi<strong>on</strong> <strong>of</strong> the development <strong>of</strong> its<br />

cooperati<strong>on</strong> with the third sector <strong>of</strong> the country. From another perspective, the n<strong>on</strong>government<br />

sector itself is neither integrated nor well-coordinated. For this sector, what<br />

is problematic is the questi<strong>on</strong> <strong>of</strong> representati<strong>on</strong>, i.e., who has the authority to represent<br />

NGOs collectively in cooperative efforts.<br />

Despite some incidents <strong>of</strong> successful cooperati<strong>on</strong> between NGOs and public<br />

authorities, in general local level cooperati<strong>on</strong> can occur <strong>on</strong>ly in individual cases, rather<br />

than as a nati<strong>on</strong>al trend. 21<br />

C<strong>on</strong>clusi<strong>on</strong>s and policy recommendati<strong>on</strong>s<br />

When people discuss civil society, they think about trust and cooperati<strong>on</strong> in a<br />

society. The trust and cooperati<strong>on</strong> between and am<strong>on</strong>g all elements <strong>of</strong> the society are two<br />

fundamental characteristics and indicators <strong>of</strong> society’s health and democratic maturity.<br />
