To reduce corrupti<strong>on</strong> in Kyrgyzstan, what is most required is to seriously revise the<br />

legislative process.<br />

Taking into account that Kyrgyz legislati<strong>on</strong> strives for internati<strong>on</strong>al unificati<strong>on</strong><br />

and applicati<strong>on</strong> <strong>of</strong> those standards, it should become a business practice to c<strong>on</strong>duct<br />

mandatory examinati<strong>on</strong> <strong>of</strong> drafted laws and ensure current legal provisi<strong>on</strong>s for terms<br />

<strong>of</strong> corrupti<strong>on</strong>.<br />

These acti<strong>on</strong>s will essentially reduce the possibility <strong>of</strong> corrupti<strong>on</strong> am<strong>on</strong>g civil<br />

servants. The examinati<strong>on</strong> should reveal corrupti<strong>on</strong> prec<strong>on</strong>diti<strong>on</strong>s and help block them<br />

at the point when draft law is being developed. It is no secret that public <strong>of</strong>ficers have a<br />

vested interest in breaches <strong>of</strong> the law. Through these mercenary motives, public <strong>of</strong>ficers<br />

at various levels maintain illegal acti<strong>on</strong>s by accepting bribes. As a result, the State<br />

effectively merges with shadow business.<br />

The scale <strong>of</strong> quasi-state activities remains high, and many “private” for-pr<strong>of</strong>it<br />

enterprises are linked to high-ranking <strong>of</strong>ficials, thus creating a large, informal public<br />

sector in which <strong>of</strong>ficials receive their “rent” as regular income.<br />

11. Shadow ec<strong>on</strong>omy. The shadow ec<strong>on</strong>omy, which reaches 50 percent <strong>of</strong> the gross<br />

nati<strong>on</strong>al product (according to the UNDP study), negatively influences the tax and social<br />

base and leads to a vicious circle <strong>of</strong> mutual tax increases and shadow sector activities.<br />

The shadow ec<strong>on</strong>omy creates unfair competiti<strong>on</strong> for registered enterprises and deforms<br />

<strong>of</strong>ficial statistics. This results in inefficient decisi<strong>on</strong>s that guide the country’s ec<strong>on</strong>omic<br />

policies.<br />

Therefore, the shadow ec<strong>on</strong>omy cannot be c<strong>on</strong>sidered merely a temporary<br />

phenomen<strong>on</strong>. It will increase whenever there is no ec<strong>on</strong>omic growth as well as during<br />

employment increases and relatively fair income distributi<strong>on</strong>. The judicial system plays<br />

a significant role for reducing the shadow ec<strong>on</strong>omy. If the rule <strong>of</strong> law does not work,<br />

and businessmen cannot rely <strong>on</strong> the law and legal protecti<strong>on</strong> <strong>of</strong> their property, they<br />

will find it more favorable to work in a shadow sector that has its own traditi<strong>on</strong>s and<br />

mechanisms.<br />

To legalize the shadow ec<strong>on</strong>omy, it is necessary to develop and carry out a number<br />

<strong>of</strong> reforms:<br />

• create a favorable legal and business envir<strong>on</strong>ment by decreasing costs for<br />

business registrati<strong>on</strong> and strengthening the benefits <strong>of</strong> <strong>of</strong>ficial registrati<strong>on</strong>;<br />
