SECTION 17.2<br />

Transsexual(or trans)people<br />

Have a deep conviction that their gender identity does not match their appearance and/or anatomy.<br />

The incongruity between identity and body can be so strong that individuals are driven to presenting<br />

themselves permanently in the opposite(acquired)gender(and possibly undergoing hormonal and<br />

surgical intervention).This terminology is used for the purpose of the Gender Recognition Act,but<br />

people in this position may refer to themselves as‘transgendered’or in a number of ways.Transsexual<br />

and transgendered persons have gender dysphoria,a medically recognised condition.Confusion can<br />

arise from the sometime use of the word‘transgender’with reference to transvestites.Transvestites,<br />

those who have a compulsion,or wish,to dress in the clothes of the opposite sex,do not have gender<br />

dysphoria.<br />

Transphobia<br />

Refers to various kinds of aversions towards transexuality and transsexual or transgendered people,<br />

often taking the form of refusal to accept a person’s expression of their internal gender identity.<br />

Whether intentional or not,transphobia can have severe consequences for the object of the negative<br />

attitude.Many transpeople also experience homophobia from people who incorrectly associate the<br />

medically recognised condition of gender identity disorder as a form of homosexuality.Like other<br />

forms of discrimination,such as homophobia,the discriminatory or intolerant behaviour can be direct<br />

such as harassment,assault or murder or indirect such as refusing to take steps to ensure that<br />

transgender people are treated in the same way as non-transgendered people.However direct forms of<br />

transphobia can manifest themselves in ways that are not related to violence.<br />

Victimisation<br />

Less favourable treatment of a person because they have brought legal proceedings under the equality<br />

legislation or are suspected of having done so; or because they have alleged that a person has<br />

committed an action which would amount to unlawful discrimination; or because they have given<br />

evidence or information in connection with proceedings brought under the equality legislation or<br />

because they have otherwise done anything under the legislation in relation to any person or alleged<br />

that a person has committed an act which would amount to a contravention of the legislation.
