liquor sourcing policy for the Year 2005-06<br />

and 2006-07 implemented by the State of<br />

Rajasthan whereby a licensee of country<br />

liquor is compulsorily required to obtain his<br />

requirement of liquor from the Respondents<br />

distilleries, and the fact that only three<br />

private distilleries and the government<br />

distillery were permitted to obtain rectified<br />

spirit from outside the state of Rajasthan<br />

and none else. The Petitioners claim is that<br />

the policy is arbitrary and clearly aims at<br />

creating a monopoly in favour of the<br />

Respondents.<br />

The Company was originally not made a<br />

party in the writ petition. However, the<br />

Company had filed an application for<br />

impleadment as a respondent and has also<br />

filed its reply.<br />

Dispute as regards the non- payment of<br />

salary to workers during the period of strike<br />

in the year 1999-2000 and 2000-2001,<br />

bonus and exgratia payments were raised. A<br />

settlement was arrived at by the Company<br />

and the Union. An application was made<br />

before the Labour Commissioner under<br />

Section 33-C(1) of the Industrial Disputes<br />

Act which was dismissed. The Labour union<br />

filed a writ against the same.<br />

The case has been decided on September<br />

14, 2007 against the petitioner. The notice is<br />

to be served on the State of Rajasthan.<br />

Status<br />

The Company has filed a Writ Petition under<br />

Article 226 of Constitution of India in the<br />

matter of Section 11 and 12 of the<br />

Rajasthan Excise Act, 1950 and The<br />

Rajasthan Excise Rules, 1956 against the<br />

excise department for their notification<br />

regarding demand of fee under Rule 69B of<br />

the Excise rules on transportation/ captive<br />

consumption of goods (rectified spirit used in<br />

the manufacture of liquor) within the factory<br />

premises.<br />

First listed on 29.11.05 wherein Demand<br />

raised by excise department and on<br />

19.12.05 stay of order dated 29.11.05 was<br />

confirmed. The said matter was listed on<br />

28.04.08 and the next date of hearing has<br />

been fixed for October <strong>24</strong>, 2009<br />
