How did that one go? 48 Moutons,<br />

36 Lafites <strong>and</strong> 29 Petruses (or is<br />

it Petrii?) walk into a bar… wait,<br />

this is no joke! Our long awaited<br />

fall auction season debut has those<br />

for real. And then some. We are a<br />

lucky bunch to have our internetonly<br />

auctions. These colorful weekly<br />

vinous festivities allowed us to have a great summer, thanks to your<br />

continued patronage. Not only that, during the warm months we<br />

found the luxury to squirrel away some top quality consignments <strong>and</strong><br />

particularly attractive lots. This liberty resulted in our most condensed,<br />

concentrated, glorious live auction to date. We are proud of it.<br />

With only a h<strong>and</strong>ful of mixed lots, this auction consists of mostly<br />

singular bottles of extreme rarities, multiple bottles of vintage<br />

wonders as more than 60 original cases, most opened for the very first<br />

time during our diligent inspection process. That’s right; about half<br />

the lots this time come in their precious original packaging. All of<br />

our generous consignors offer this selection because they commonly<br />

share the passion to pursue, acquire <strong>and</strong> appreciate fine <strong>and</strong> rare wines<br />

by the case. They respect this sought-after luxury <strong>and</strong> preserve the<br />

integrity through which vignerons envision their beloved works of art<br />

maturing.<br />

Our consignors span coast to coast, <strong>and</strong> the auction opens <strong>and</strong><br />

closes with collections that are New York City-based. The entry is a<br />

mouthful <strong>and</strong> the finish memorable. California, our home base, gives<br />

the “mid-palate” structure <strong>and</strong> length from North to South. While<br />

top Bordeaux form the core, older DRCs, Leroy, Vogue <strong>and</strong> Roumier<br />

support the red Burgundy selections. Old <strong>and</strong> rare Prestige Cuvees<br />

like Dom Perignon <strong>and</strong> Cristal are sprinkled within, while vintage<br />

Ports, Germans <strong>and</strong> Sauternes add sweet depth. Estimates don’t leave<br />

anyone out - mature daily drinkers mingle among once in a lifetime<br />

cellar trophies.<br />

Italians are more about excellence than extent, starring timeless<br />

Biondi Santi <strong>and</strong> Gaja treasures. Lots representing the New World are<br />

limited to great California reds, <strong>and</strong> range from blue chip classics such<br />

as Heitz Martha’s <strong>and</strong> Opus One to modern day cults like Scarecrow<br />

<strong>and</strong> Screaming Eagle. While many lots will particularly appeal to our<br />

ever-widening audience in Asia, there are also an equal number of lots<br />

that our American <strong>and</strong> European clientele take pleasure in. After all,<br />

the world of fine <strong>and</strong> rare wine has never been this global, <strong>and</strong> the best<br />

of the best never this desirable.<br />

In sharing our discoveries <strong>and</strong> appreciation of the greatest wines of the<br />

world with you, we find great joy <strong>and</strong> cheerfully salute your growing<br />

complete contrast to the extracted behemoth of Leoville Barton <strong>and</strong><br />

the backward, classic Leoville Las Cases. The Poyferre’s low acidity,<br />

sweet tannin <strong>and</strong> an already gorgeous mouthfeel make it a wine<br />

wines 10-20 years old. In bottles 20-30 years<br />

old, a base neck level is an excellent level <strong>and</strong><br />

usually indicates excellent storage history.<br />

VTS – Very Top Shoulder level: acceptable<br />

level for wines 20 to 30 years old. Considered<br />

excellent for bottles older than 30 years.<br />

Generally indicates that a wine has been<br />

properly cellared.<br />

TS – Top Shoulder level: acceptable for wines<br />

30-40 years old. In bottles older than 40<br />

Special Notes<br />

Often producers in Burgundy fill their bottles<br />

close to the top of the bottle. This practice<br />

sometimes results in some seepage when the<br />

cork is inserted. Unless the ullage is severe for<br />

the age of the wine, seepage for Burgundy<br />

or for wines in Burgundy shaped bottles is<br />

usually not a sign of poor storage.<br />

consignments <strong>and</strong> introduced by a heading<br />

that provides information about the storage<br />

lot contains information about the wine, size,<br />

<strong>and</strong> quantity of bottles. An index listing all of<br />

the wines grouped by region is posted at the<br />

end of the catalog.<br />

Auction Value Estimates<br />

Each lot contains an estimate with the<br />

expected range of prices that the given lot<br />

may sell for. All values are based on current<br />

market prices for similar or identical wines.<br />

The condition of wines is generally taken into<br />

Sales Tax<br />

or have their purchases shipped inside of<br />

California, unless the purchase is deemed<br />

will determine if a transaction is non-taxable.<br />

Shipping Your <strong>Wine</strong>s<br />

Instructions for Collection <strong>and</strong> Delivery will<br />

be mailed with each invoice <strong>and</strong>/or sent as<br />

an e-mail attachment following successful<br />

bids for each sale. <strong><strong>Wine</strong>Gavel</strong> recommends<br />

temperature controlled truck delivery for<br />

at our warehouse in Napa, California. Our climate<br />

controlled facility is at a consistent, monitored<br />

temperature of 56-58 degrees <strong>and</strong> under the watch<br />

of an extensive security system. We offer long term<br />

palletized wine storage <strong>and</strong> personal customer<br />

cellarage at a 50 case minimum. Please inquire. For<br />

<strong><strong>Wine</strong>Gavel</strong> auction purchases may be stored free of<br />

charge for the first 15 days with no transfer-in fee.<br />

Paid <strong><strong>Wine</strong>Gavel</strong> cellarage customers are not subject<br />

to a transfer-in fee for <strong><strong>Wine</strong>Gavel</strong> auction purchases<br />

at any point. They are subject to storage fees as<br />

indicated in their <strong><strong>Wine</strong>Gavel</strong> contract. After 15 days,<br />

<strong><strong>Wine</strong>Gavel</strong> clients will be accruing storage charges <strong>and</strong><br />

will be billed by <strong><strong>Wine</strong>Gavel</strong> for any charges incurred.<br />

The greater of $15 per invoice or $1 per Lot will be<br />

assessed for any partial calendar month that auction<br />

wine purchases remain in the facility without prior<br />

arrangement.<br />

Saturday delivery is preferred: Any shipments via<br />

Ground to states east of the Mississippi will typically<br />

schedule to ship on a Friday so they are guaranteed<br />

to deliver by the following Friday (5 delivery days<br />

guarantee by UPS, Fedex does not include the pickup<br />

day). Shipping confirmations are emailed. For further<br />

General Shipping Policies,<br />

Terms <strong>and</strong> Conditions<br />

<strong><strong>Wine</strong>Gavel</strong> provides all purchasers with multiple<br />

options for air <strong>and</strong> ground transport. <strong><strong>Wine</strong>Gavel</strong><br />

does not in any way represent the shipment of wines<br />

across state lines as legal nor does <strong><strong>Wine</strong>Gavel</strong> take<br />

responsibility for the legality of shipment of alcoholic<br />

beverages into any state. Generally states regulate the<br />

shipment of wines into <strong>and</strong> across their borders. Some<br />

states require that the purchaser, consignor or shipper<br />

possess certain licenses or permits, while other states<br />

have a strict prohibition on such shipments, <strong>and</strong> may<br />

not allow them in any form. <strong><strong>Wine</strong>Gavel</strong> advises all<br />

buyers to investigate <strong>and</strong> underst<strong>and</strong>, on their own<br />

examination, the wine shipping laws <strong>and</strong> regulations<br />

of the state to which they intend the wine to be<br />

shipped prior to the purchase of wines at auction.<br />

<strong><strong>Wine</strong>Gavel</strong> can assist in making arrangements to<br />

have wine purchased at auction shipped through the<br />

appropriate channels. All domestic shipments will<br />

be subject to a 1% insurance charge, International<br />

shipments will be charged 2% for coverage. Insurance<br />

covers only breakage or loss. <strong><strong>Wine</strong>Gavel</strong> cannot be<br />

held responsible for any other changes to the wines<br />

during shipment. It may be required for the wines to be<br />

repacked in heavy duty Styrofoam shipping boxes. The<br />

wooden or cardboard cases will normally be shipped<br />

separately at an additional charge. Insurance coverage<br />

does not cover confiscation by any government or law<br />

enforcement agency as a result of any violations of any<br />

shipping laws by any buyer. Loss or breakage resulting<br />

from transportation shall be reported to <strong><strong>Wine</strong>Gavel</strong><br />

in writing within three days of incident. Weatherrelated<br />

issues are not covered by any shipper <strong>and</strong><br />

therefore <strong><strong>Wine</strong>Gavel</strong> is not responsible. <strong><strong>Wine</strong>Gavel</strong><br />

has a weather hold policy in place <strong>and</strong> will not ship<br />

outside that temperature allowance. <strong>Wine</strong>s held longer<br />

than 15 days are subject to a storage fee except where<br />

noted. Any lots that are split into two or more parts for<br />

multiple deliveries or pickups will be subject to a $10<br />

to the purchaser: Common carrier ground service<br />

from $30 per case; fully licensed <strong>and</strong> insured<br />

The buyer’s premium for <strong><strong>Wine</strong>Gavel</strong> <strong>Fine</strong> <strong>and</strong> <strong>Rare</strong> <strong>Wine</strong> <strong>Auctions</strong> is 19%. Payment is due within 14 days after each sale. Please see “Buying at<br />

Conditions<br />

I. All estimates are per lot as numbered in the catalog. We reserve the right to withdraw, divide or group lots prior to sale. <strong><strong>Wine</strong>Gavel</strong> <strong>and</strong>/or<br />

the auctioneer may have a direct or indirect ownership interest in any or all lots in the sale resulting from ownership or purchase by <strong><strong>Wine</strong>Gavel</strong><br />

of the lots (or an agreement to purchase), or from an advance of monies or property to the seller, or a guarantee of minimum proceeds made by<br />

<strong><strong>Wine</strong>Gavel</strong> to the seller.<br />

II. The highest bidder shall prevail. Should any dispute arise between bidders, the decision of the auctioneer as to the successful bidder <strong>and</strong><br />

the re-offering or resale of the lot under dispute shall be final. The auctioneer shall regulate the bidding <strong>and</strong> reserves the right to refuse any bid<br />

believed by him not to be made in good faith. Any bid which is merely, or which is merely a nominal or fractional advance over the previous<br />

bid, may be rejected by the auctioneer, at his discretion. Neither we nor the auctioneer shall be liable for errors <strong>and</strong> omissions in executing<br />

instructions to bid, whether caused by our negligence, the auctioneer’s negligence, or otherwise.<br />

III. Any lot in this sale may be subject to a reserve. The auctioneer or its agent shall have the right to bid on behalf of the seller for any lot subject<br />

to a reserve. The auctioneer may open bidding on any lot by placing a bid on behalf of the seller or the auctioneer <strong>and</strong> may further bid on behalf<br />

of the seller or the auctioneer by placing successive or consecutive bids for a lot or by placing bids in response to other bidders. Any “hammer”<br />

price listed is the price for which a lot closed on the floor at the sale (or a reserve price), <strong>and</strong> such prices do not indicate whether or not any lot<br />

met its reserve price if such a price had been established. Bid only as much as you are prepared to pay as in most cases, bidders will pay their top<br />

bid.<br />

IV. E-Mail, Fax, or Telephone Bidder. A successful e-mail, fax or telephone bidder will be notified of lots purchased <strong>and</strong> must remit payment<br />

before the lots are shipped. Payment must be received by us within fifteen (15) days of notification. Delivery to a successful bidder will be based<br />

on the instructions given by the customer in the “Collection <strong>and</strong> Delivery Form” which will be included with payment.<br />

V. Title shall not pass to the buyer until full payment is received by <strong><strong>Wine</strong>Gavel</strong>.<br />

VI. If a bidder shall fail to comply with these Conditions of Sale, then, as to any lot with respect to which such failure to comply occurs, we<br />

shall be entitled (but not obligated), at our sole discretion, to resell the lot or cause it to be resold by public or private sale, without notice to the<br />

bidder <strong>and</strong> in any manner of sale (whether or not commercially reasonable), <strong>and</strong> to hold the non-complying bidder liable for any deficiency in<br />

the purchase price attending such resale, as well as for all charges, costs <strong>and</strong> expenses incurred in both sales, <strong>and</strong> all incidental damages. In no<br />

event shall any surplus arising from such resale be payable to the non-complying bidder.<br />

VII. If <strong><strong>Wine</strong>Gavel</strong> takes any action to enforce these Conditions of Sale, or to secure payment of any amount due to us from a bidder or<br />

purchaser, the defaulting bidder or purchaser shall be liable for all legal <strong>and</strong> other costs <strong>and</strong> expenses incurred by us, including but not limited to<br />

reasonable attorneys’ fees.<br />

VIII. Successful bidders agree to pay for lots as specified above <strong>and</strong> no credit will be extended. A late payment charge of 1 1/2% per month<br />

shall be imposed on overdue payments. A minimum monthly surcharge of $10 shall apply. All lots purchased in California are subject to sales<br />

tax, unless the purchaser is a licensed entity, in which case any <strong>and</strong> all documentation regarding that entity’s license(s) must be submitted<br />

to <strong><strong>Wine</strong>Gavel</strong> prior to each sale. A 19% Buyer’s Commission will be added to all purchases. Lots will be considered as paid when all fees,<br />

including but not limited to, shipping, h<strong>and</strong>ling, late charges, purchase price, commissions, <strong>and</strong> any <strong>and</strong> all sales or use taxes are paid in full.<br />

IX. All agents will be personally liable <strong>and</strong> responsible for the purchases of those persons they represent, <strong>and</strong> for other costs <strong>and</strong> expenses which<br />

would be the responsibility of the buyer under these terms <strong>and</strong> conditions.<br />

X. Under no circumstances, including, but not limited to negligence, will <strong><strong>Wine</strong>Gavel</strong>, its officers, directors, employees, agents, or affiliates<br />

be liable to any bidder or any third party for any indirect, incidental, special, consequential, punitive or exemplary damages (including,<br />

without limitation, damages for loss of business, loss of profits, loss of opportunity, or business interruption) arising out of participation in<br />

any auction, or the placing or acceptance or rejection of any bid, or the sale (or failure to consummate a sale) for any lot or lots, or resulting<br />

from failure or breach of security, mistakes, omissions, interruptions, deletions, or loss of files or data, errors, defects, delays in operation or<br />

performance, regardless of the cause including, but not limited to, acts of God, communication failure, theft, destruction or unauthorized access<br />

to <strong><strong>Wine</strong>Gavel</strong> <strong>Fine</strong> <strong>and</strong> <strong>Rare</strong> <strong>Wine</strong> Auction’s computer network, programs or services, or for any claim by any other party. Not withst<strong>and</strong>ing<br />

anything to the contrary in this agreement, the exclusive remedy for all damages, losses <strong>and</strong> causes of action which a bidder or other person or<br />

entity participating or involved in any auction may incur or suffer, whether in contract, tort (including negligence), equity, at law or otherwise,<br />

shall be to recover damages in an amount that is not in excess of the wholesale value of any lot that may be the subject of any such dispute.<br />

XI. In the event of any dispute under these Conditions of Sale, or any dispute between the auctioneer <strong>and</strong> bidders, or between any parties<br />

requesting inspection of any of the lots of the auctioneer, or between persons offering their lots to be auctioned <strong>and</strong> the auctioneer, the exclusive<br />

jurisdiction <strong>and</strong> venue over any such dispute shall be in the Federal <strong>and</strong> state courts having jurisdiction <strong>and</strong> located in San Francisco, California,<br />

the parties waiving any other jurisdiction or venue to which they may be entitled.<br />

XII. The auction is being conducted by <strong><strong>Wine</strong>Gavel</strong> <strong>and</strong> no individual auctioneer, employee, office or director of <strong><strong>Wine</strong>Gavel</strong>, shall be held to<br />

any personal liability hereunder for negligence or otherwise.<br />

XIII.The placing of a bid shall constitute acceptance <strong>and</strong> agreement of these Conditions of Sale.<br />

XIV. Warranty Information, Buyer’s Remedies:<br />

(i) All property is sold “as is”, <strong>and</strong> neither <strong><strong>Wine</strong>Gavel</strong> nor the consignor make any guarantees, warranties or representations, expressed or<br />

implied, with respect to the property, except as to warranty of title. <strong><strong>Wine</strong>Gavel</strong> will only accept returns in the instance of an obvious or<br />

egregious cataloging error on the part of <strong><strong>Wine</strong>Gavel</strong>. Buyers will have 14 days after the sale to bring forth any issue regarding any lot.<br />

(ii) Neither <strong><strong>Wine</strong>Gavel</strong> nor the consignor make any representations or warranty of any kind, expressed or implied, with respect, but not limited<br />

to any of the following characteristics of the property: age, authenticity, provenance, physical condition, importance, size, quality, quantity,<br />

parity, value, historical references or significance, material, source, or origin.<br />

(iii) All information in the catalog or elsewhere, concerning the characteristics mentioned in (ii) above, is offered to the bidders as a statement of<br />

opinion only. It is not intended to contain statements of fact for which we or the consignor may be held liable. This disclaimer of liability on our<br />

part applies whether the information is included in the catalog, advertisements, announcements, or communicated through our representatives,<br />

bill of sale or elsewhere, <strong>and</strong> whether written or oral.<br />

(iv) Neither <strong><strong>Wine</strong>Gavel</strong>, nor the consignor, shall be responsible for ensuring the correctness or accuracy of descriptions or other information in<br />

this catalog or elsewhere. The bidder assumes the full responsibility to inspect <strong>and</strong> evaluate the Property to his or her complete satisfaction prior<br />

to any purchase. The bidders <strong>and</strong> buyers must make an independent judgment about (1) the Property, (2) its value, <strong>and</strong> (3) descriptions or other<br />

information about the property. We may, without in any way diminishing the disclaimers of liability contained in this Paragraph <strong>and</strong> elsewhere,<br />

mention in the description of the lot, significant damage, although this does not include all faults, imperfections <strong>and</strong> deficiencies.<br />

(v) Neither <strong><strong>Wine</strong>Gavel</strong> nor the consignor make any warranty or representation, express or implied, concerning the re-marketing of any wines<br />

purchased at our auctions.<br />

(vi) The estimates provided by <strong><strong>Wine</strong>Gavel</strong> are merely our opinion of the price that a willing buyer might pay for the Property at auction. The<br />

actual price that might be realized at auction or upon sale of the Property may be substantially different from these estimates. We shall not be<br />

liable in any way for such estimate or differences in the final selling price.<br />

(vii) If there is any breach of a warranty of title, buyer’s sole remedy shall be to rescind the sale <strong>and</strong> receive a refund of the purchase price,<br />

including the buyer’s commission. This means that neither we, nor the consignor, shall have any liability for other damages, such as but not<br />

limited to , direct, indirect, special, incidental or consequential damages. No refund will be made until the Property is returned at buyer’s expense<br />

to the premises of <strong><strong>Wine</strong>Gavel</strong> or where the Property was purchased in the same condition as the Property was in at the time of the sale. We act<br />

only as an agent for the consignor <strong>and</strong> make no independent warranty of any kind.<br />
