Position: Pro Se Law Clerk<br />

POSITION INFORMATION<br />

The United States District Court for the Northern District of Florida is seeking highly qualified applicants for a full time pro<br />

se law clerk position. The pro se law clerk provides the court with procedural and substantive legal advice and assistance in<br />

connection with prisoner petitions and complaints. They independently conduct legal research, review case records/filings,<br />

and draft proposed opinions, memorandum decisions and orders. They provide objective advice to judges, chambers and<br />

court staff and provide information to litigants and attorneys for litigants.<br />

Funding for the position is reviewed annually and is based on the number of case filings. This position does not involve<br />

representing clients or providing advice to pro se litigants. Ethical considerations prohibit the lawyer employed in this<br />

position from practicing law in any capacity for compensation outside or in addition to work for the court.<br />

REPRESENTATIVE DUTIES<br />

• Manage and track pro se litigation cases:<br />

o Performs substantive screening before and after the filing of all prisoner petitions, complaints and pleadings<br />

including state and federal habeas corpus petitions, motions to vacate sentence and civil rights complaints.<br />

Work may also include other non-prisoner pro se civil and Social Security cases. Identifying issues involved<br />

and basis for relief.<br />

o Performs legal research and analysis.<br />

o Provides information, guidance and advice to judges, magistrates and other personnel working in the pro se<br />

area both orally and in writing.<br />

o Prepares drafts of legal memoranda, reports, recommendations, decisions and orders.<br />

o Provides procedural information to pro se litigants or counsel by responding to questions.<br />

o Reviews the docket of pending prisoner litigation to assure the proper progress of such cases and advises the<br />

court of those cases where action by the court is appropriate.<br />

o Advises appropriate personnel on the status of particular cases.<br />

o Maintains liaison between the court and litigants.<br />

• Maintains communication with other courts, state and federal agencies, counsel, litigants and court staff regarding<br />

court rules and procedural issues, calendaring and other litigation matters.<br />

• Remains current with developments in the law of the circuit and the district court, as well as with evolving legislation.<br />

Updates legal personnel and judges on those developments to aid the court in adjusting to new legislation in the pro se<br />

area.<br />

• Evaluates present procedures to determine new innovations for increasing the effectiveness of handling complaints,<br />

petitions and pleadings. Identifies problem areas, makes recommendations and offers solutions, as required by the<br />

court, Administrative Office and other officials.<br />

• Compiles statistics and prepares periodic reports, as required, that reflect the status and flow of cases.<br />

• Schedules and attends meetings and performs other duties as assigned.


MINIMUM QUALIFICATIONS<br />

Excellent legal research, analytical and writing skills along with interpersonal skills well matched for working closely with<br />

U.S. District Judges and court personnel are required. To qualify for the position of pro se law clerk, an individual must be<br />

a law school graduate from a law school of recognized standing, and standing within the upper third of the class from a law<br />

school on the approved list of the American Bar Association or that of the Association of American Law Schools and have<br />

experience on the editorial board of a law review. Bar membership is also required. Prior experience as a pro se or death<br />

penalty law clerk is preferred. Legal experience in one or more of the following areas will be favorably considered: civil<br />

rights; habeas corpus; social security disability; and criminal appellate law.<br />

The successful candidate must be a U.S. citizen or a lawful permanent resident of the United States currently seeking<br />

citizenship or intending to become a citizen after meeting the eligibility requirements. Employees are required to use the<br />

Electronic Fund Transfer (EFT) for payroll deposit. The selected candidate will be subject to a background check as a<br />

condition of employment with the suitability determination made by the Clerk of Court. Employees of the U.S. District<br />

Court are "At Will" employees and are required to adhere to a Code of Conduct of Judicial Employees, which is available<br />

Compensation and grade will be set based on the experience and qualifications of the successful candidate, subject to the<br />

policies and guidelines set forth in the Judiciary Salary Plan. Judiciary benefits include paid vacation, sick leave, paid<br />
