Fishing Council record an average of 33 hammerhead sharks caught each fishing year<br />

<strong>for</strong> the past 14 seasons (not including catch <strong>and</strong> release). Reported l<strong>and</strong>ings have<br />

been much reduced from this average over recent years, although this might be due to<br />

increasing numbers of hammerheads being released.<br />

Customary fishery characteristics<br />

23 An estimate of current customary catch is not available <strong>for</strong> this <strong>species</strong>.<br />

24 Maori traditionally ate a wide variety of seafood. To date no specific records have<br />

been found of fishing <strong>for</strong> this <strong>species</strong>, but they were nonetheless potentially a small<br />

part of customary catches, given the distance offshore that Maori fished <strong>and</strong> the<br />

quality of their fishing materials.<br />

25 Hammerhead shark has been listed on Schedule 4C because of potential sustainability<br />

<strong>risk</strong>s <strong>under</strong> an open access management regime. Accordingly, no new fishing permits<br />

can be issued <strong>for</strong> commercial targeting of the <strong>species</strong>.<br />

Provisional catch history implications<br />

26 Hammerhead shark is listed on Schedule 4C. Accordingly <strong>for</strong> the 26 clients reporting<br />

l<strong>and</strong>ings of 7.643 tonnes during the fishing year commencing 1 October 1990 <strong>and</strong> the<br />

24 clients reporting l<strong>and</strong>ings of 8.372 tonnes <strong>for</strong> the fishing year commencing October<br />

1991 allocations of provisional catch history may be lost if the QMS introduction of<br />

hammerhead shark is deferred beyond 1 October 2009.<br />

International obligations<br />

27 Hammerhead shark is listed as a highly migratory <strong>species</strong> on Annex 1 of the United<br />

Nations Convention on the Law of the Sea (UNCLOS). UNCLOS requires regional<br />

cooperation <strong>for</strong> ensuring conservation <strong>and</strong> optimal utilisation of listed <strong>species</strong> both<br />

within <strong>and</strong> beyond exclusive economic zones. No specific measures relate to<br />

hammerhead shark.<br />

28 The Convention on the Conservation of Migratory Species of Wild Animals (CMS)<br />

does not list hammerhead shark on Appendix 1 of its convention (basking, white, <strong>and</strong><br />

whale shark are the only HMS shark <strong>species</strong> so listed). Accordingly there is no<br />

current international obligation <strong>for</strong> New Zeal<strong>and</strong> to consider prohibiting the taking of<br />

hammerhead shark.<br />

Treaty settlement obligations<br />

29 MFish is <strong>under</strong>taking research to provide in<strong>for</strong>mation on the traditional <strong>and</strong> customary<br />

factors that may need to be considered in the management decision-making process.<br />

Currently there is no in<strong>for</strong>mation specific to hammerhead shark.<br />
