Existing management in<strong>for</strong>mation<br />

29 The draft NPOA-Sharks has been developed to address conservation <strong>and</strong> fisheries<br />

management issues <strong>for</strong> New Zeal<strong>and</strong> sharks, <strong>and</strong> to ensure their long-term sustainable<br />

use. The draft NPOA-Sharks addresses a number of management issues, including<br />

improvements to the accuracy of catch data sets, improved accuracy of <strong>species</strong><br />

identification, initiating research <strong>and</strong> monitoring programmes, reducing the use of<br />

generic shark stock codes, <strong>and</strong> better management of shark finning practices.<br />

Consultation on the draft NPOA-Sharks has been completed, <strong>and</strong> the document is<br />

currently being finalised <strong>and</strong> is expected to be provided to the Minister in June 2008.<br />

International obligations<br />

30 An International Plan of Action <strong>for</strong> the Conservation <strong>and</strong> Management of Sharks<br />

(IPOA-Sharks) was developed by the Food <strong>and</strong> Agriculture Organisation of the<br />

United Nations (FAO). As New Zeal<strong>and</strong> is a member state of the FAO, the draft<br />

NPOA-Sharks was developed to encompass the international management principles<br />

defined by the IPOA-Sharks. As noted in the previous paragraph the draft NPOA-<br />

Sharks is now in the final stages of development, <strong>and</strong> includes a range of conservation<br />

<strong>and</strong> management measures <strong>for</strong> New Zeal<strong>and</strong> shark <strong>species</strong>, including carpet shark.<br />

Treaty settlement obligations<br />

31 The Crown <strong>and</strong> several Iwi around regional New Zeal<strong>and</strong> have <strong>for</strong>mally signed Deeds<br />

of Settlement regarding the original terms of the Treaty of Waitangi. From the Deeds<br />

of Settlement, MFish has a range of obligations to Iwi regarding fisheries<br />

management decisions, as set out within individual Iwi Settlement Protocols.<br />

32 The Crown recognises that sharks are a taonga <strong>species</strong> to Māori people, <strong>and</strong> that<br />

individual Iwi have a customary non-commercial interest in the management of shark<br />

<strong>species</strong>. MFish is obligated to consult with Iwi Governance Entities <strong>and</strong> to recognise<br />

<strong>and</strong> provide <strong>for</strong> their customary interests when making decisions on the sustainable<br />

utilisation or setting of sustainability measures <strong>for</strong> shark <strong>species</strong>, including carpet<br />

shark.<br />
