Nonetheless, the SIDF will provide additional <strong>in</strong>centives and better term loans to foreign<br />
<strong>in</strong>vestors who set up their manufactur<strong>in</strong>g facilities <strong>in</strong> Jizan, Hail, and Tabuk. American and<br />
other foreign firms are able to participate <strong>in</strong> <strong>Saudi</strong> government-f<strong>in</strong>anced and/or governmentsubsidized<br />
research and development programs.<br />
The government uses its purchas<strong>in</strong>g power to encourage foreign <strong>in</strong>vestment. In 1985, the<br />
<strong>Saudi</strong> Government reached an agreement with American defense contractors for “offset” jo<strong>in</strong>t<br />
venture <strong>in</strong>vestments with local <strong>in</strong>vestments equivalent to 35 percent of the program’s value.<br />
British and French defense firms also have offset requirements. Offset requirements are likely<br />
to rema<strong>in</strong> components of major defense purchases and have been <strong>in</strong>corporated <strong>in</strong>to other large<br />
<strong>Saudi</strong> Government contracts.<br />
The government has not notified the WTO about any measures which would be <strong>in</strong>consistent<br />
with the requirements of the Agreement on Trade-Related Investment Measures (TRIMs), nor<br />
does it ma<strong>in</strong>ta<strong>in</strong> any measures that are alleged to violate the WTO TRIMs text.<br />
The government announced <strong>in</strong> 2002 it would ease restrictions on the issuance of visas to<br />
foreign bus<strong>in</strong>essmen to allow greater access, and decreed <strong>in</strong> 2005 that sponsor requirements<br />
for bus<strong>in</strong>ess visas would be lifted. In November 2007, <strong>Saudi</strong> <strong>Arabia</strong> announced that it will beg<strong>in</strong><br />
issu<strong>in</strong>g foreign bus<strong>in</strong>ess visitors five (5) year, multiple entry visas at <strong>Saudi</strong> embassies,<br />
consulates, and ports of entry (but has not yet fully implemented this policy). The government<br />
also announced that foreign bus<strong>in</strong>ess visitors will no longer need to provide <strong>in</strong>vitation letters<br />
from <strong>Saudi</strong> bus<strong>in</strong>esses to receive visas.<br />
Right to Private Ownership and Establishment Return to top<br />
Domestic private entities have the right to establish and own bus<strong>in</strong>ess enterprises and engage<br />
<strong>in</strong> all forms of remunerative activity. Private entities generally have the right to freely establish,<br />
acquire, and dispose of <strong>in</strong>terests <strong>in</strong> bus<strong>in</strong>ess enterprises. Certa<strong>in</strong> activities are reserved for<br />
state monopolies and <strong>Saudi</strong> citizens.<br />
Protection of Property Rights Return to top<br />
The <strong>Saudi</strong> legal system protects and facilitates acquisition and disposition of private property,<br />
consistent with Islamic practice respect<strong>in</strong>g private property. Non-<strong>Saudi</strong> corporate entities are<br />
allowed to purchase real estate <strong>in</strong> <strong>Saudi</strong> <strong>Arabia</strong> accord<strong>in</strong>g to the new foreign <strong>in</strong>vestment code.<br />
Other foreign-owned corporate and personal property is protected, and the Embassy knows of<br />
no cases of government expropriation or nationalization of U.S.-owned assets <strong>in</strong> the K<strong>in</strong>gdom.<br />
<strong>Saudi</strong> <strong>Arabia</strong> does have a system of record<strong>in</strong>g security <strong>in</strong>terests.<br />
<strong>Saudi</strong> <strong>Arabia</strong> recently undertook a comprehensive revision of its laws cover<strong>in</strong>g <strong>in</strong>tellectual<br />
property rights to br<strong>in</strong>g them <strong>in</strong> l<strong>in</strong>e with the WTO agreement on Trade Related Aspects of<br />
Intellectual Property Rights (TRIPs) and promulgated changes <strong>in</strong> coord<strong>in</strong>ation with the World<br />
Intellectual Property Organization (WIPO). The <strong>Saudi</strong> Government recently updated their<br />
Trademark Law (2002), Copyright Law (2003), and Patent Law (2004) with the dual goals of<br />
TRIPs-compliance and effective deterrence aga<strong>in</strong>st violators. In 2008 the Violations Review<br />
Committee created a website and has populated it with <strong>in</strong>formation on current cases.<br />
The current Law on Patents, Layout Designs of Integrated Circuits, Plant Varieties and Industrial<br />
