particular alcohol testing device that the<br />

BAT or STT will be using. The training<br />

must also emphasize the responsibility of the<br />

BAT and STT for maintaining the integrity<br />

of the testing process and ensuring the<br />

privacy of employees being tested. The<br />

training must instruct BATs and STTs on<br />

how to avoid conduct or statements that<br />

could be viewed as offensive or<br />

inappropriate.<br />

The instructor must be an individual who<br />

has demonstrated the necessary knowledge,<br />

skills, and abilities by regularly conducting<br />

DOT alcohol tests as an STT or BAT for at<br />

least a year or who has conducted STT or<br />

BAT training on Part 40 requirements for at<br />

least a year, or who has successfully<br />

completed a “train the trainer” course.<br />

Proficiency Demonstration. BATs<br />

must conduct seven error-free mock<br />

collections to demonstrate proficiency in<br />

alcohol testing and the use of the Evidential<br />

Breath Testing Device (EBT) that he/she<br />

will be using. STTs must complete five<br />

error-free mock collections to demonstrate<br />

proficiency in alcohol testing and the use of<br />

the Alcohol Screening Device (ASD) that<br />

he/she will use.<br />

A qualified individual that evaluates the<br />

BAT/STT’s performance must monitor the<br />

demonstrations and document in writing that<br />

the mock collections were error-free.<br />

Refresher Training. BATs and STTs<br />

must undergo refresher training at least<br />

every 5 years from the date on which they<br />

satisfactorily completed their initial<br />

qualifications training and proficiency<br />

demonstration. The refresher training must<br />

meet the same requirements.<br />

Error Correction Training. BATs and<br />

STTs must undergo error correction training<br />

if they make a mistake in the alcohol testing<br />

process that causes a test to be cancelled,<br />

including fatal and uncorrected flaws. The<br />

training must occur within 30 days of the<br />

date of the error and must cover the subject<br />

matter area(s) of the error. The BAT or STT<br />

must also demonstrate proficiency in the<br />

alcohol testing procedures by conducting<br />

three error-free mock tests of which two are<br />

related to the error and one is uneventful.<br />

The training and proficiency demonstration<br />

must be observed, evaluated, and<br />

documented in writing by a qualified<br />

instructor.<br />

Medical Review Officers<br />

The Medical Review Officer (MRO) is<br />

the gatekeeper of the drug testing program.<br />

As such, individuals must meet the<br />

following requirements to qualify as an<br />

MRO:<br />

Credentials. An MRO must be a<br />

licensed physician (Doctor of Medicine or<br />

Osteopathy).<br />

Basic Knowledge. An MRO must be<br />

knowledgeable about and have clinical<br />

experience in controlled substance abuse<br />

disorders including detailed knowledge of<br />
