⎯ Direct the analysis of the split specimen if he/she concludes that<br />

there is legitimate explanation for the employee’s failure to<br />

contact the MRO within 72 hours? If the MRO concludes that<br />

there is no legitimate explanation for the employee’s failure to<br />

contact the MRO within 72 hours, then the MRO is not required<br />

to direct the analysis of the split specimen to be performed.<br />

⎯ Maintain all necessary records and send test result reports to the<br />

transit agency’s drug and alcohol program manager.<br />

⎯ Protect the employees’ privacy and testing program<br />

confidentiality.<br />

Are procedures in place for disclosure of verified positive test results to<br />

the employer and the confidentiality that is required for medical<br />

information not specifically related to the use of drugs?<br />

⎯ If any quantitative results are given in the lab report, the<br />

employer is not authorized to receive such quantitative results<br />

and they should not be transmitted by the MRO to the employer.<br />

Does the Medical Review Officer transmit all test results in a timely and<br />

secure manner? Results must be transmitted the same day they are<br />

verified or the next business day.<br />

Does the Medical Review Officer know the procedure for dealing with<br />

adulterated, diluted, and “unsuitable for testing” specimens?<br />

⎯ If a specimen is adulterated or substituted:<br />

⎯ The donor has a right to a split specimen test.<br />

⎯ The donor has the right to discuss the result with the<br />

MRO and provide evidence that supports how the test<br />

results could be obtained legitimately through<br />

physiological means.<br />

⎯ If the MRO is not satisfied with the explanation or<br />

evidence provided, these specimens will be reported to<br />

employers as a “refusal to test.”<br />

Does the MRO have a copy of the DOT Medical Review Officer<br />

<strong>Guidelines</strong>?<br />

Does the MRO know when no-contact test results can be verified<br />

positive?<br />
