⎯ An individual who refuses to submit to a test or has a verified<br />

positive drug test will be removed immediately from the safetysensitive<br />

function, referred to an SAP, and provided educational<br />

materials (regardless of whether the employee will be discharged<br />

or given a second chance).<br />

⎯ Any further disciplinary action must be detailed in the policy and<br />

specified as being transit agency-mandated, not FTA-mandated.<br />

A description of the consequences for the misuse of alcohol?<br />

⎯ An individual who refuses to submit to a test, or has an alcohol<br />

concentration of 0.04 or greater, will be removed immediately<br />

from the safety-sensitive function, provided educational material,<br />

and referred to an SAP regardless of whether they are discharged<br />

or given a second chance .<br />

⎯ An individual who has an alcohol concentration of 0.02 or<br />

greater, but less than 0.04 will be removed from duty for at least<br />

8 hours, unless a retest results in an alcohol concentration of less<br />

than 0.02.<br />

⎯ Any further disciplinary action must be detailed in the policy and<br />

specified as being transit agency-mandated, not FTA-mandated.<br />

The identity of the contact person? The contact person (the drug and<br />

alcohol program manager) for drug and alcohol related questions is<br />

identified along with the individual’s telephone number and office<br />

location.<br />

A description of the following?<br />

⎯ The effects of alcohol misuse on an individual’s health, work,<br />

and personal life;<br />

⎯ The signs and symptoms of an alcohol problem; and<br />

⎯ The available methods of intervening when an alcohol problem is<br />

suspected.<br />

A separate designation for additional provisions that exceed the FTA<br />

requirements? Those that are described in the policy must be identified<br />

as such and the policy must state that these provisions are those of the<br />

transit system and are not required by the FTA. Ensure that the policy<br />

distinguishes between provisions included under FTA authority, the<br />

transit agency’s authority, or the authority of another agency.<br />
