Violations of the act may result in: (1)<br />

suspension of grant payments; (2) suspension<br />

or termination of grants; or (3) suspension or<br />

debarment of the recipient. The decision of<br />

which sanction or sanctions to apply in a<br />

particular case is left to the discretion of the<br />

FTA. A debarred recipient is ineligible for<br />

any award from a federal agency during the<br />

term of the debarment, which may be up to 5<br />

years. The agency head may waive a<br />

particular grant, suspension if it is determined<br />

by the agency head that such a waiver would<br />

be in the public interest. This authority cannot<br />

be delegated to any other federal official.<br />

The DFWA does not require employers to<br />

test for drugs and alcohol or pay for<br />

rehabilitation.<br />
