(5) For the Bus portion of the Buy America Pre-Award review, the PMOC must confirm<br />

that the Grantee/Sponsor has verified that all vehicles will meet one of the following<br />

conditions:<br />

• Buses: the cost of components produced in the United States is more than 60<br />

percent of the cost of all components and final assembly of buses will take place<br />

in the United States, or; Grantee/Sponsor will obtain from the <strong>FTA</strong> a waiver letter<br />

exempting the buses from <strong>FTA</strong>’s Buy America requirements.<br />

• The PMOC should also confirm that the manufacturer is responsible and capable<br />

of building the bus to the Grantee/Sponsor’s design and solicitation specification.<br />

(6) For both the Bus and Rail Buy America portion of the Pre-Award review, the PMOC<br />

should verify that the Grantee/Sponsor has completed 3-certifications for bus projects<br />

and 2-certifications for rail projects, in the Pre-Award review process.<br />

(7) Bus Projects:<br />

• 60% for more than 10 buses or purchase price in excess of $100,000, and<br />

confirmation that final assembly of buses will take place in the United States.<br />

• Purchaser’s Requirements certification. See description of this requirement in<br />

4.1.2, below.<br />

• <strong>Federal</strong> Motor Vehicle Safety Standards (FMVSS) certification.<br />

(8) Rail Projects:<br />

• Buy America certification, verifying that rail vehicles will contain a minimum of<br />

60% domestic products, by cost, “and” final assembly of the rail vehicles will<br />

take place in the U.S.<br />

• Purchaser’s Requirements certification. See description of this requirement in<br />

4.1.2, below.<br />

(9) PMOCs are reminded that Bus manufacturers who use a two-stage production process<br />

where buses are built partially abroad and partially in the U.S. are permitted to<br />

exempt the following installations from final assembly Buy America provisions.<br />

• Axles and/or wheels<br />

• Bus frames<br />

• Brakes and subcomponents<br />

• Doors and door controls<br />

• Windows<br />
