Hiwassee College Athletic Hall of Fame Induction and Luncheon 

The Hiwassee College Alumni Association invites 

alumni, friends and the public to attend this year’s Athletic 

Hall of Fame induction and luncheon on Saturday, 

April 14, at 12 p.m. The Athletic Hall of Fame honors 

those former students and coaches who have distinguished 

themselves in sports at 

Hiwassee and elsewhere. Members of the Lady Vols 

basketball team will be this year’s guest speakers. 

The 2012 honorees are: 

Dewayne Garner – (1988-90) - Basketball 

Garner, a Chattanooga native, was named the 

TSSAA Player of Year in Tennessee before coming to 

Hiwassee. He carried that success to the collegiate level 

where Garner had an outstanding career at Hiwassee 

on teams that won the Eastern Division, the State 

Championship and

Hughes served as the 

head coach of the Tigers

seasons where he compiled 

a 146-53 record (.729 

winning percentage) and 

led Hiwassee to three regional 

championships and 

two state junior college 

crowns. His best team was 

in 1994 when the Tigers 

advanced to the nJCAA 

national Tournament 

where they finished

than his winning percentage 

was his players’ 

100 percent graduation 

rate. During 20 years of 

coaching, Hughes 

amassed an impressive

All-region 7 team in 1967 

and the All-Dixie Conference 

in 1968. He averaged 

22 points per game during 

his HC career and was 

voted MVP during that 

time. Swann led the team 

in rebounds and points his 

sophomore season while

attorney of the sole 

murder suspect that he, 

the judge, was “obligated 

to get this case resolved.” 

“This lady has been in 

custody since the fall of 

2010,” said Judge Walter 

Kurtz, emphasizing the 

length of Jessica Lynn 

Powers’ incarceration for 

the alleged brutal death 

and burning of the Sweetwater 

businessman and 

election commissioner in 

July 2010. 

Knoxville attorney 

John Eldridge appeared 

with his 28-year-old Sweetwater 

client, requesting a 

motion to continue the 

case because of “outstanding 

discovery conflicts.” 

Eldridge told Kurtz he had 

had trouble with the district 

attorney general’s office 

and the sheriff’s 

department over specific 

reports and investigation 

files. He also said he had 

not been privy to a socalled 

confession by Powers 

to the TBi. 

“We’ve never seen it, 

nor have we seen the entire 

file of the case,” Eldridge 

said, “and because 

of that, our investigation 

has been hampered. And 

now, it is close to trial time 

and we don’t have what we 

need for an adequate defense.” 

Eldridge also said he 

had requested, but had not 

gotten, the results of Powers’ 

polygraph. 

Assistant District Attorney 

General Jim Stutts 

countered Eldridge, telling 

Kurtz that if Eldridge 

wanted “the entire file” he 

had been told he could 

“come and look at it” anytime 

he wanted. 

Eldridge then said his 

law firm was involved in a 

murder case in Sevier 

County that was set for 

the same day as Powers’ 

scheduled Monroe 

County trial and his expert 

witness was needed in 

both places. 

“i’m aware of that 

case,” Kurtz returned. 

“And i set this trial date 

before that case was 

scheduled for trial. As far 

i as i see it, we have 

‘chronological priority’ 

here. So i am not continuing 

this case on that.” 

Saying the Miller case 

involved “many suspects” 

making “many statements” 

involving their 

“culpability” in the homicide, 

Eldridge stated that 

the investigation by the 

Monroe County Sheriff’s 

Department and the Tennessee 

Bureau of investigation 

“had gone far and 

wide,” and there was almost 

“too much to assemble 

and present in court” 

without more time to prepare. 

“This has been a discovery 

nightmare,” Eldridge 

said. “And i need 

my expert witness.” 

Kurtz told Eldrige that 

a submitted “motion 

under seal” would have to 

be taken up privately in his 

chambers and there would 

be no need to involve “a 

letter exchange” unless he 

received a motion for it. 

There was no further 

mention of the sealed motion 

or letter as Kurtz 

cited a rule called 

“Supreme Court #11.” 

Kurtz then ordered Eldridge 

and Stutts to

the sheriff’s department 

to inspect the case file and 

any other information or 

evidence collected in the 

case, telling Eldridge to 

work out the availability of 

the expert witness for 

Powers’ trial. 

“i’m not going to continue 

this case because of 

the witness conflict,” 

Kurtz said, “unless the 

chief justice of Tennessee 

tells me i have to give priority 

to the Sevier County 

case.” 

During the hearing, 

Powers, aka 

Kennedy/Chissen, sat in 

prison attire and said 

nothing. She is the only 

suspect charged in the 

death of Miller, whose 

body turned up shot and 

burned in the trunk of his 

car off Sands road on July 

17, 2010. 

Her trial is set for May 

21, 2012. 

“i did not do this,” she 

told the BuZZ as the 

hearing ended. “i did not 

do this.”

road home in violation of 

court orders and came in 

contact with two small females 

who live there, an 

incident that also 

prompted the arrest of 

Geneva Sledge, 38, who 

was in guardianship of the 

girls and sanctioned 

Lovingood’s visits.

Sexual offender 

registry for lifetime placement 

of community supervision 

on Monday, 

March 26, a result of the 

guilty plea. As part of his 

plea, Lovingood was required 

to register within 

48 hours with the Sex offender 

registry’s officer at 

the state Department of 

Parole and Probation. on 

Thursday, March 29, 

Lovingood had not registered, 

the warrants said. 

As a sex offender, 

Lovingood was also required 

to keep away from 

the young victims and 

have no contact, a second 

act he violated, according 

to the warrants. The children 

made statements to 

Department of Children’s 

Services personnel that 

Lovingood had visited 

with them and even 

walked them to the school 

bus, statements corroborated 

by other witnesses.

remained in custody 

without bond.
