The Hiwassee College Alumni Association invites<br />

alumni, friends and the public to attend this year’s Athletic<br />

Hall of Fame induction and luncheon on Saturday,<br />

April 14, at 12 p.m. The Athletic Hall of Fame honors<br />

those former students and coaches who have distinguished<br />

themselves in sports at<br />

Dewayne Garner – (1988-90) - Basketball<br />

Garner, a Chattanooga native, was named the<br />

TSSAA Player of Year in <strong>Tennessee</strong> before coming to<br />

Hiwassee. He carried that success to the collegiate level<br />

where Garner had an outstanding career at Hiwassee<br />

on teams that won the Eastern Division, the State<br />

February, down from January’s<br />

The national unemployment<br />

rate was 8.3 in February,<br />

lowest February rate was<br />

Williamson with 5.6 percent.<br />

Knox <strong>County</strong> was<br />

second with 6.1 percent<br />

and Loudon <strong>County</strong> was<br />

fourth with 6.7 (down<br />

from January’s 8.3 percent).<br />

where he made All Tournament<br />

in the nJCAA<br />

All-region 7 team in 1967<br />

and the All-Dixie Conference<br />

in 1968. He averaged<br />

22 points per game during<br />

his HC career and was<br />

voted MVP during that<br />

time. Swann led the team<br />

in rebounds and points his<br />

sophomore season while<br />

murder suspect that he,<br />

the judge, was “obligated<br />

to get this case resolved.”<br />

“This lady has been in<br />

custody since the fall of<br />

2010,” said Judge Walter<br />

Kurtz, emphasizing the<br />

length of Jessica Lynn<br />

Powers’ incarceration for<br />

the alleged brutal death<br />

and burning of the Sweetwater<br />

businessman and<br />

election commissioner in<br />

July 2010.<br />

Knoxville attorney<br />

John Eldridge appeared<br />

with his 28-year-old Sweetwater<br />

client, requesting a<br />

motion to continue the<br />

case because of “outstanding<br />

discovery conflicts.”<br />

Eldridge told Kurtz he had<br />

had trouble with the district<br />

attorney general’s office<br />

and the sheriff’s<br />

department over specific<br />

reports and investigation<br />

files. He also said he had<br />

not been privy to a socalled<br />

confession by Powers<br />

to the TBi.<br />

“We’ve never seen it,<br />

nor have we seen the entire<br />

file of the case,” Eldridge<br />

said, “and because<br />

of that, our investigation<br />

has been hampered. And<br />

now, it is close to trial time<br />

and we don’t have what we<br />

need for an adequate defense.”<br />

Eldridge also said he<br />

had requested, but had not<br />

gotten, the results of Powers’<br />

polygraph.<br />

Assistant District Attorney<br />

General Jim Stutts<br />

countered Eldridge, telling<br />

Kurtz that if Eldridge<br />

wanted “the entire file” he<br />

had been told he could<br />

“come and look at it” anytime<br />

he wanted.<br />

Eldridge then said his<br />

law firm was involved in a<br />

murder case in Sevier<br />

<strong>County</strong> that was set for<br />

the same day as Powers’<br />

scheduled <strong>Monroe</strong><br />

<strong>County</strong> trial and his expert<br />

witness was needed in<br />

both places.<br />

“i’m aware of that<br />

case,” Kurtz returned.<br />

“And i set this trial date<br />

before that case was<br />

scheduled for trial. As far<br />

i as i see it, we have<br />

‘chronological priority’<br />

here. So i am not continuing<br />

this case on that.”<br />

Saying the Miller case<br />

involved “many suspects”<br />

making “many statements”<br />

involving their<br />

“culpability” in the homicide,<br />

Eldridge stated that<br />

the investigation by the<br />

<strong>Monroe</strong> <strong>County</strong> Sheriff’s<br />

Department and the <strong>Tennessee</strong><br />

Bureau of investigation<br />

“had gone far and<br />

wide,” and there was almost<br />

“too much to assemble<br />

and present in court”<br />

without more time to prepare.<br />

“This has been a discovery<br />

nightmare,” Eldridge<br />

said. “And i need<br />

my expert witness.”<br />

Kurtz told Eldrige that<br />

a submitted “motion<br />

under seal” would have to<br />

be taken up privately in his<br />

chambers and there would<br />

be no need to involve “a<br />

letter exchange” unless he<br />

received a motion for it.<br />

There was no further<br />

mention of the sealed motion<br />

or letter as Kurtz<br />

cited a rule called<br />

“Supreme Court #11.”<br />

Kurtz then ordered Eldridge<br />

and Stutts to<br />

any other information or<br />

evidence collected in the<br />

case, telling Eldridge to<br />

work out the availability of<br />

the expert witness for<br />

Powers’ trial.<br />

“i’m not going to continue<br />

this case because of<br />

the witness conflict,”<br />

Kurtz said, “unless the<br />

chief justice of <strong>Tennessee</strong><br />

tells me i have to give priority<br />

to the Sevier <strong>County</strong><br />

case.”<br />

During the hearing,<br />

Powers, aka<br />

Kennedy/Chissen, sat in<br />

prison attire and said<br />

nothing. She is the only<br />

suspect charged in the<br />

death of Miller, whose<br />

body turned up shot and<br />

burned in the trunk of his<br />

car off Sands road on July<br />

17, 2010.<br />

Her trial is set for May<br />

21, 2012.<br />

“i did not do this,” she<br />

told the BuZZ as the<br />

hearing ended. “i did not<br />

do this.”<br />
