Accountable to Affected People<br />

The jo<str<strong>on</strong>g>in</str<strong>on</strong>g>t <strong>ADB</strong> Board and Management Work<str<strong>on</strong>g>in</str<strong>on</strong>g>g Group<br />

<strong>on</strong> the Accountability Mechanism Review has released the<br />

c<strong>on</strong>sultati<strong>on</strong> paper “Further Strengthen<str<strong>on</strong>g>in</str<strong>on</strong>g>g the Accountability<br />

Mechanism.” This came out <strong>on</strong> February 4, 2011, exactly 15<br />

days after its stipulated release.<br />

The delay <str<strong>on</strong>g>in</str<strong>on</strong>g> release is teem<str<strong>on</strong>g>in</str<strong>on</strong>g>g with <str<strong>on</strong>g>in</str<strong>on</strong>g>side stories of rifts<br />

am<strong>on</strong>g lead borrow<str<strong>on</strong>g>in</str<strong>on</strong>g>g and borrower countries, as well as <str<strong>on</strong>g>in</str<strong>on</strong>g>house<br />

debates and discussi<strong>on</strong>s. This release however comes<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> the wake of several regi<strong>on</strong>al c<strong>on</strong>sultati<strong>on</strong>s. While the name<br />

of the c<strong>on</strong>sultati<strong>on</strong> paper <str<strong>on</strong>g>in</str<strong>on</strong>g>dicates the strengthen<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the<br />

mechanism, it is still the affected people who, <str<strong>on</strong>g>in</str<strong>on</strong>g> the end are the<br />

last and least priority <str<strong>on</strong>g>in</str<strong>on</strong>g> the new avatar of the 2003 policy.<br />

The time has come for each citizen to ask how every dollar<br />

is spent <strong>on</strong> development activities which have affected and<br />

c<strong>on</strong>t<str<strong>on</strong>g>in</str<strong>on</strong>g>ue to affect their lives. The beneficiaries are the <strong>on</strong>es who<br />

should know about and participate <str<strong>on</strong>g>in</str<strong>on</strong>g> decisi<strong>on</strong>s <strong>on</strong> where the<br />

m<strong>on</strong>ey will be spent. The power centers <str<strong>on</strong>g>in</str<strong>on</strong>g> Tokyo, Wash<str<strong>on</strong>g>in</str<strong>on</strong>g>gt<strong>on</strong>,<br />

Manila, New Delhi, Beij<str<strong>on</strong>g>in</str<strong>on</strong>g>g, Jakarta and Phnom Penh should<br />

not determ<str<strong>on</strong>g>in</str<strong>on</strong>g>e and decide <strong>on</strong> their own as to how the landscape<br />

of develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g Asia would look like and how the <strong>ADB</strong> would be<br />

accountable. The Bank must listen to the likes of Chh<str<strong>on</strong>g>in</str<strong>on</strong>g>, Pham,<br />

Ismayilova, Oram and many more who have been affected by<br />

<strong>ADB</strong> projects.<br />

This Bankwatch issue is dedicated to the affected people<br />

who c<strong>on</strong>vey their messages regard<str<strong>on</strong>g>in</str<strong>on</strong>g>g the Accountability<br />

Mechanism. Spoken and written <str<strong>on</strong>g>in</str<strong>on</strong>g> the language they are most<br />

comfortable with, each of them speak of the same issues and<br />

c<strong>on</strong>cerns.<br />

More than 10 years after the road project has been<br />

completed, project-affected communities <str<strong>on</strong>g>in</str<strong>on</strong>g> Cambodia are still<br />

wait<str<strong>on</strong>g>in</str<strong>on</strong>g>g for the promised livelihood restorati<strong>on</strong> program. In<br />

Vietnam, people affected by <strong>ADB</strong> projects are not even familiar<br />

with the accountability mechanism. They do not know that such<br />

a mechanism exists and that they can file a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t and seek<br />

redress. In Kyrgyzstan, affected people po<str<strong>on</strong>g>in</str<strong>on</strong>g>t out that the exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

mechanism processes are not so people-friendly. In Odisha,<br />

people are suggest<str<strong>on</strong>g>in</str<strong>on</strong>g>g how to make use of such a mechanism<br />

for the benefit of the poor. In Ind<strong>on</strong>esia, groups discern some<br />

gaps <str<strong>on</strong>g>in</str<strong>on</strong>g> the first phase of the mechanism and suggest ways to<br />

make it effective and efficient.<br />

The messages <str<strong>on</strong>g>in</str<strong>on</strong>g> the local language <strong>on</strong> this issue reiterate<br />

the predicament of the ‘participatory development process.’<br />

The structures, processes and <str<strong>on</strong>g>in</str<strong>on</strong>g>tenti<strong>on</strong>s of the Accountability<br />

Mechanism determ<str<strong>on</strong>g>in</str<strong>on</strong>g>e the s<str<strong>on</strong>g>in</str<strong>on</strong>g>cerity of the Bank <str<strong>on</strong>g>in</str<strong>on</strong>g> uphold<str<strong>on</strong>g>in</str<strong>on</strong>g>g its<br />

accountability to the project-affected people.<br />

Việt Nam với Cơ chế giải trình<br />

trách nhiệm của <strong>ADB</strong><br />

H<br />

iện nay, Việt Nam là một tr<strong>on</strong>g những nước<br />

ưu tiên nhận tài trợ của <strong>ADB</strong> tr<strong>on</strong>g chương<br />

trình Tiểu vùng sông Mek<strong>on</strong>g. Việt Nam<br />

cũng là một tr<strong>on</strong>g những nước nhận được nhiều<br />

khoản tài trợ nhất từ quỹ Phát triển Châu Á (ADF).<br />

Tr<strong>on</strong>g khi chúng ta có thể dự báo trước được sẽ ngày<br />

càng có nhiều khoản đầu tư của <strong>ADB</strong> tại Việt Nam<br />

thì vấn đề là rất ít tr<strong>on</strong>g số những dự án này được<br />

xem là có sự tham gia của người dân bị ảnh hưởng<br />

bởi dự án. Với tư cách là một thể chế tài chính công<br />

thì các chính sách, chương trình và dự án của <strong>ADB</strong><br />

được cho là cần phải có tính giải trình trách nhiệm<br />

và m<str<strong>on</strong>g>in</str<strong>on</strong>g>h bạch.<br />

Hầu hết người dân Việt Nam nói chung và<br />

người dân bị ảnh hưởng bởi các dự án do <strong>ADB</strong> tài<br />

trợ đều không biết đến cơ chế giải trình trách nhiệm.<br />

Họ không hề biết rằng có một cơ chế như thế tồn tại<br />

để họ có thể nêu những ý kiến về những ảnh hưởng<br />

tiêu cực của các dự án đến đời sống của họ. Lí do<br />

có thể là: ngân hàng dùng những từ ngữ rất “ngân<br />

hàng” hay quá cao siêu để mô tả những chính sách,<br />

cơ chế của họ mà những người dân bình thường<br />

không có chuyên môn không thể hiểu được; khi một<br />

dự án vào đến địa phương không có một cơ quan<br />

nào phổ biến cho họ là khi phát hiện ra dự án có vấn<br />

đề thì họ có thể dựa vào cơ chế nào để cất tiếng nói.<br />

Ngân hàng và các đơn vị thực thi dự án đều biết<br />

đến vấn đề này nhưng họ cảm thấy không cần phải<br />

có trách nhiệm để phổ biến cho người dân. Có thể<br />

khẳng định ngoài những người có chuyên môn thì<br />

không một người dân nào biết đến cái gọi là Cơ chế<br />

giải trình trách nhiệm. Đây phải chăng là sự vi phạm<br />

chính quy định của <strong>ADB</strong> tr<strong>on</strong>g chính sách công bố<br />

thông t<str<strong>on</strong>g>in</str<strong>on</strong>g> cho người dân? Ngay bản thân thuật ngữ<br />

“Cơ chế giải trình trách nhiệm” đã mang tính kỹ<br />

thuật và khó tiếp nhận đối với những người không<br />

có chuyên môn. Vì vậy, tính đến nay tại Việt Nam<br />

có rất ít trường hợp gửi thư khiếu nại lên Cơ chế giải<br />

trình trách nhiệm của <strong>ADB</strong>, kể cả đối với những dự<br />

án có quy mô ảnh hưởng sâu rộng. Vào năm 2006,<br />

với dự án Phát triển du lịch tiểu vùng sông Mek<strong>on</strong>g<br />

mở rộng đã có một trường hợp gửi thư khiếu nại lên<br />

Cơ chế giải trình trách nhiệm của <strong>ADB</strong> nhưng sau<br />

đó được cho là không hợp lệ. Vấn đề đặt ra là ai sẽ<br />

là người kiểm chứng tính đúng sai khi <strong>ADB</strong> cho nó<br />

là không hợp lệ? Để cho Cơ chế giải trình thực sự<br />

hiệu quả thì <strong>ADB</strong> nên công khai tất cả các trường<br />

hợp khiếu nại dù cho nó hợp lệ hay không, đối với<br />

trường hợp mà <strong>ADB</strong> cho rằng không hợp lệ để xem<br />

xét giải quyết thì phải chỉ ra nó không hợp lệ ở điểm<br />

nào.<br />

Một tr<strong>on</strong>g những vấn đề khiến Cơ chế giải trình<br />

trách nhiệm khó phát huy hiệu quả ở Việt Nam là<br />

hầu hết người dân đều không thông thạo tiếng Anh<br />

mà nguồn tham khảo chủ yếu lại là tiếng Anh. Vì<br />

vậy, khuyến nghị <strong>ADB</strong> nên có tất cả các thông t<str<strong>on</strong>g>in</str<strong>on</strong>g> về<br />

Cơ chế giải trình trách nhiệm của họ dưới dạng tiếng<br />

Việt chứ không chỉ một vài tài liệu mang tính hình<br />

thức để người dân có thể dễ dàng tiếp cận hơn. Hơn<br />

thế nữa, <strong>ADB</strong> cũng nên có chính sách chấp thuận tất<br />

cả các trường hợp khiếu nại kể cả từ một cá nhân và<br />

bằng ngôn ngữ mẹ đẻ của họ.<br />

За последние полтора года или около того, Центральная Азия и Кавказ на регулярной основе<br />

с некоторыми промежутками времени, направляла жалобы в АБР согласно Механизму<br />

Подотчетности (МП). Когда пострадавшие люди и их соответствующие местные представители<br />

Организаций Гражданского Общества знают об этом механизме, они стремятся решать воздействия<br />

проектов финансируемых АБР. Однако, многие люди на местах не знают о существовании такого<br />

механизма. На фоне существующих систем управления в каждой из этих стран данного региона,<br />

Механизм Подотчетности позволяет требовать права и справедливости для людей.<br />

Одна из легитимных жалоб в Кыргызстане на первом этапе МП<br />

проходит через так называемый Офис Специального<br />

Проектного Посредника (ОСПП), который пытается решить<br />

данный вопрос. Однако, несмотря на то, что уже прошло шесть<br />

месяцев, с тех пор как жалоба была направлена в ОСПП, до<br />

сих пор вопрос пострадавших людей еще не решен. Несмотря<br />

на то, что жалоба была признана легитимной, что означает<br />

о наличии проблем и нарушений при реализации проекта,<br />

этот вопрос остается все еще нерешенным и пострадавшие<br />

люди находятся сейчас в отчаянии как экономически, так как<br />

и психологически.<br />

Похоже, функции и роль первого этапа МП АБР<br />

ограничен в решении вопросов компенсации по проекту<br />

строительства дороги. В жалобах данного региона<br />

многие вопросы связаны с переселением, но следует<br />

отметить, что вопросы переселения подняты в жалобе<br />

в связи с отсутствием информации, консультаций<br />

и участия пострадавших людей во время фазы подготовления проекта.<br />

К сожалению, ни новая политика рассмотрения МП, ни новый Рабочий документ по Политике по<br />

связям с общественностью не включают ясного разъяснение о том, как должна распространяться<br />

информация о Механизме Подотчетности на местах.<br />

В ходе расследования ОСПП, как правило, местные сообщества начинают узнавать о дополнительных<br />

проблемах и нарушениях проекта. Однако, проблемы, кроме тех, что указанны в жалобе, не<br />

рассматриваются ОСПП, так как для этого надо писать новую жалобу. Консультационный проект<br />

политики Механизма Подотчетности подготовленный в феврале 2011 года по-прежнему не включает<br />

в себя вопросы, кроме тех, что были подняты в жалобе для рассмотрения ОСПП.<br />

В Консультационном проекте политики МП утверждает, что бюджет ОСПП и Группа экспертов по<br />

соответствию условиям (CRP) слишком огромный и должен быть сокращен. Однако, их работа принесла<br />

значимые результаты, и жалобы поспособствовали тому, что все стейкхолдеры стали принимать<br />

участие в решении проблем и узнали о демократическом и активном участии в процессе принятия<br />

решений, узнали о требованиях Политики по мерам защиты и прекращения практики штамповки<br />

проектов. Если банк серьезно относится к своей прозрачности и подотчетности, рассмотрение проекта<br />

МП должны более конкретными в вопросах легкого доступа и своевременного разрешения жалоб.<br />

Proses bersama dalam memecahkan kasus-kasus<br />

yang terjadi dalam Proyek CERD berujung pada<br />

pengajuan k<strong>on</strong>sultasi kepada Office Special Project<br />

Facilitator (OSPF) <strong>ADB</strong>. Pilihan <str<strong>on</strong>g>in</str<strong>on</strong>g>i dilakukan<br />

setelah beragam upaya advokasi yang kami<br />

lakukan di t<str<strong>on</strong>g>in</str<strong>on</strong>g>gkat kabupaten h<str<strong>on</strong>g>in</str<strong>on</strong>g>gga pusat tidak<br />

mendapatkan penelesaian yang menyeluruh dan<br />

berkeadilan bagi beneficiaries. Walaupun demikian,<br />

pilihan menawarkan Mekanisme Akuntabilitas<br />

<strong>ADB</strong>, yang merupakan mekanisme <str<strong>on</strong>g>in</str<strong>on</strong>g>ternal <strong>ADB</strong>,<br />

kepada masyarakat korban kami jalankan dengan<br />

kekhawatiran akan <str<strong>on</strong>g>in</str<strong>on</strong>g>dependensi OSPF <strong>ADB</strong>.<br />

MEMBEDAH TAHAP KOMPLAIN<br />

Lebih dua tahun melakukan upaya pemecahan<br />

masalah-masalah proyek tanpa mendapatkan<br />

penyelesaian yang berkeadilan, menyebabkan<br />

masyarakat korban di 5 desa penerima proyek<br />

bersepakat untuk bersama-sama menggunakan<br />

mekanisme akuntabilitas <strong>ADB</strong>. Ini Bahan-bahan<br />

pendukung yang dapat kami kumpulkan tentang<br />

mekanisme kompla<str<strong>on</strong>g>in</str<strong>on</strong>g> mulai dibedah bersama.<br />

Pertemuan berlangsung di antara waktu luang<br />

masyarakat di desa, siang atau malam. Beberapa<br />

bahan harus kami perbanyak, ditulis ulang,<br />

diterjemahkan ke dalam bahasa Ind<strong>on</strong>esia, bahkan<br />

tak jarang harus pula disederhanakan dengan bahasa<br />

daerah setempat saat diskusi.<br />

Pemahaman kami dan masyarakat juga bertambah<br />

dengan mempelajari pengalaman pengajuan<br />

kompla<str<strong>on</strong>g>in</str<strong>on</strong>g> kepada <strong>ADB</strong> di negara la<str<strong>on</strong>g>in</str<strong>on</strong>g>. iii Diskusi<br />

dengan beberapa teman di berbagai negara la<str<strong>on</strong>g>in</str<strong>on</strong>g> juga<br />

kami lakukan untuk mendapatkan pemahaman yang<br />

utuh tentang mekansme <str<strong>on</strong>g>in</str<strong>on</strong>g>i. Penggalangan dukungan<br />

dari masyarakat desa la<str<strong>on</strong>g>in</str<strong>on</strong>g>nya juga dilakukan para<br />

masyarakat pem<strong>on</strong>itor. Dan pada 16 Pebruari 2005,<br />

surat pengajuan kompla<str<strong>on</strong>g>in</str<strong>on</strong>g> yang ditandatangani 5<br />

orang perwakilan dari masyarakat di 5 desa dan 3<br />

orang dari <str<strong>on</strong>g>NGO</str<strong>on</strong>g> dikirimkan ke OPF iv<br />

BERPERAN SEBAGAI PERANTARA<br />

Peran sebagai perantara ternyata tidak dibatasi<br />

dalam setiap tahapan proses kompla<str<strong>on</strong>g>in</str<strong>on</strong>g>. Kami tetap<br />

mengambil peran sebagai penghubung komunikasi<br />

antara OSPF & manajemen proyek dengan<br />

masyarakat. Kamipun secara resmi menjadi tempat<br />

berdiskusi dan berk<strong>on</strong>sultasi, serta menjadi sumber<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>formasi utama bagi masyarakat pengaju kompla<str<strong>on</strong>g>in</str<strong>on</strong>g><br />

untuk mengetahui perkembangan proses k<strong>on</strong>sultasi.<br />

Menjadi perantara bukanlah tanpa masalah. Mulai<br />

dari tud<str<strong>on</strong>g>in</str<strong>on</strong>g>gan sebagai provokator oleh beberapa<br />

orang di manajemen proyek dan perangkat desa,<br />

h<str<strong>on</strong>g>in</str<strong>on</strong>g>gga beragam ’ketidakpuasan’ yang akhirnya<br />

harus dibuang jauh karena compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ants dan<br />

masyarakat desa menyetuju<str<strong>on</strong>g>in</str<strong>on</strong>g>ya. K<strong>on</strong>disi <str<strong>on</strong>g>in</str<strong>on</strong>g>i terjadi<br />

menjelang pelaksanaan review & assessment, di<br />

mana tim OSPF yang tidak dikenal sebelumnya,<br />

di s<str<strong>on</strong>g>in</str<strong>on</strong>g>i? Atau saat laporan review & assessment tidak<br />

membahas seluruh aspek dalam surat pengajuan<br />

kompla<str<strong>on</strong>g>in</str<strong>on</strong>g>.<br />

Demikian juga dengan cakupan permasalahan yang<br />

ditangani OSPF. Lembaga <str<strong>on</strong>g>in</str<strong>on</strong>g>i hanya berk<strong>on</strong>sentrasi<br />

pada masalah‐masalah yang terjadi di desa pengaju<br />

kompla<str<strong>on</strong>g>in</str<strong>on</strong>g>. Padahal, <str<strong>on</strong>g>in</str<strong>on</strong>g>dikasi pelanggaran terhadap<br />

desa<str<strong>on</strong>g>in</str<strong>on</strong>g> proyek <str<strong>on</strong>g>in</str<strong>on</strong>g>i tidak hanya terjadi di 5 desa<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>i. Sedari awal kami berharap, proses k<strong>on</strong>sultasi


<str<strong>on</strong>g>in</str<strong>on</strong>g>i akan menghasilkan suatu keputusan untuk<br />

mendesa<str<strong>on</strong>g>in</str<strong>on</strong>g> ulang pelaksanaan proyek <str<strong>on</strong>g>in</str<strong>on</strong>g>i secara<br />

keseluruhan. Melalui proses <str<strong>on</strong>g>in</str<strong>on</strong>g>i pula, kami berharap<br />

adanya <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigasi terhadap berbagai masalah yang<br />

terjadi.<br />

MENJADI BAHAN PEMBELAJARAN<br />

Proses k<strong>on</strong>sultasi yang difasilitasi OSPF menjadi<br />

bahan pembelajaran yang luar biasa bagi masyarakat<br />

dan kami. Banyak hal yang bisa dipelajari dari<br />

proses <str<strong>on</strong>g>in</str<strong>on</strong>g>i. Kami dan masyarakat mengenal dan juga<br />

melihat bahwa OSPF mencoba berada pada posisi<br />

netral dan menunjukkan objektivitasnya. OSPF telah<br />

berperan sebagaimana disebutkan dalam prosedur,<br />

dan masyarakat cukup puas dengan kesepakatan<br />

yang dicapai. Sungguhpun demikian, dalam proses<br />

k<strong>on</strong>sultasi OSPF perlu memperhatikan hal-hal di<br />

bawah <str<strong>on</strong>g>in</str<strong>on</strong>g>i.<br />

1. OSPF harus memahami k<strong>on</strong>disi dan kultur<br />

masyarakat, kebiasaan, dan komunikasi<br />

yang mereka gunakan.<br />

Seorang compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ant dari Kabupaten Tanah<br />

Laut menyatakan bahwa dir<str<strong>on</strong>g>in</str<strong>on</strong>g>ya sempat serba<br />

salah ketika staf OSPF berkunjung ke rumahna<br />

dalam rangka eligibility check. Kehadiran staf<br />

OSPF <str<strong>on</strong>g>in</str<strong>on</strong>g>i bertepatan dengan waktu shalat,<br />

sementara sang tamu tetap mengajukan beragam<br />

pertanyaan. ”Dia mempersilakan kami shalat<br />

tapi pertanyaan tetap terus diajukannya. Dia<br />

tidak tahu kebiasaan-kebiasaan masyarakat, itu<br />

wajar (sebagai orang as<str<strong>on</strong>g>in</str<strong>on</strong>g>g), tapi menjadi tidak<br />

wajar ketika dia tidak mau belajar mengenai<br />

budaya setempat,” ujar compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ant tersebut.<br />

2. OSPF harus menyiapkan cara yang pal<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

mudah agar maksud dan tujuan OSPF bisa<br />

dimengerti masyarakat (seh<str<strong>on</strong>g>in</str<strong>on</strong>g>gga tidak<br />

terjadi salah persepsi di t<str<strong>on</strong>g>in</str<strong>on</strong>g>gkat masyarakat).<br />

Beragam alat, bahan dan metode perlu<br />

disediakan untuk mendapatkan proses &<br />

hasil yang pal<str<strong>on</strong>g>in</str<strong>on</strong>g>g efektif.<br />

Rekomendasi <str<strong>on</strong>g>in</str<strong>on</strong>g>i tak datang tanpa sebab.<br />

Penyampaian Hasil Pen<str<strong>on</strong>g>in</str<strong>on</strong>g>jauan & Penilaian<br />

terjadi dengan m<strong>on</strong>ot<strong>on</strong>, Staf OSPF berbicara<br />

atau membacakan (dalam bahasa Inggris)<br />

kemudian diterjemahkan ke bahasa Ind<strong>on</strong>esia,<br />

demikian terjadi berulang. Untungnya, k<strong>on</strong>disi<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>i tertol<strong>on</strong>g pada 4 desa la<str<strong>on</strong>g>in</str<strong>on</strong>g>nya setelah kami<br />

melakukan penterjemahan kembali ke bahasa<br />

setempat.<br />

Hal yang juga kami sesalkan adalah OSPF<br />

kurang bisa memahami kebiasaan masyarakat<br />

dalam menangkap <str<strong>on</strong>g>in</str<strong>on</strong>g>formasi. Padahal ada tiga<br />

jenis cara masyarakat menangkap <str<strong>on</strong>g>in</str<strong>on</strong>g>formasi,<br />

yaitu dengan cara mendengarkan (audio),<br />

melihat/membaca (visual) dan melihat/<br />

membaca dan mendengarkan (audio visual).<br />

Seharusnya Staf OSPF menggunakan berbagai<br />

alat bantu seh<str<strong>on</strong>g>in</str<strong>on</strong>g>gga masyarakat benar-benar<br />

dapat menangkap dan memahami hal-hal yang<br />

dipresentasikan.<br />

3. OSPF harus menyiapkan sebuah mekanisme<br />

komunikasi yang lebih mudah seanda<str<strong>on</strong>g>in</str<strong>on</strong>g>ya<br />

pengajuan kompla<str<strong>on</strong>g>in</str<strong>on</strong>g> dilakukan langsung<br />

oleh masyarkat tanpa ada perantara dan<br />

tanpa fasilitas komunikasi yang memadai.<br />

Proses pengajuan kompla<str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>i sejak awal<br />

difasilitasi oleh tiga <str<strong>on</strong>g>NGO</str<strong>on</strong>g> (bahkan sejak awal<br />

2003 dalam kegiatan sebelumnya). Posisi kami,<br />

yang akhirnya menjadi perantara, kami nilai<br />

mempermudah dan memperlancar pelaksanaan<br />

kegiatan <str<strong>on</strong>g>in</str<strong>on</strong>g>i. Terbesit dalam pikiran kami, apa<br />

yang akan terjadi jika proses kompla<str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>i<br />

terjadi tanpa adanya perantara, langsung ke<br />

masyarakat. Jarak yang jauh –OSPF berada di<br />

Manila dan masyarakat di pelosok desa- dan<br />

keterbatasan alat komunikasi merupakan faktor<br />

penghambat komunikasi, dan <str<strong>on</strong>g>in</str<strong>on</strong>g>i mempengaruhi<br />

kelancaran proses k<strong>on</strong>sultasi.<br />

Sudah seharusnya OSPF memikirkan k<strong>on</strong>disi<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>i sebagai antisipasi terhadap pengajuan<br />

k<strong>on</strong>sultasi yang datang langsung dari masyaraat<br />

korban proyek yang didanai utang <strong>ADB</strong>.<br />

4. Proses k<strong>on</strong>sultasi yang memakan waktu<br />

terlalu lama, memunculkan kebosanan di<br />

masyarakat dan memungk<str<strong>on</strong>g>in</str<strong>on</strong>g>kan terjad<str<strong>on</strong>g>in</str<strong>on</strong>g>ya<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>timidasi atau hal la<str<strong>on</strong>g>in</str<strong>on</strong>g> yang membuat upaya<br />

penyelesaian yang ilakukan OSPF menjadi<br />

tidak efektif.<br />

226 hari! Itulah waktu yang harus dilalui<br />

masyarakat untuk sebuah proses kompla<str<strong>on</strong>g>in</str<strong>on</strong>g>,<br />

sejak mengirimkan surat pengaduan h<str<strong>on</strong>g>in</str<strong>on</strong>g>gga<br />

kesepakatan penyelesaian masalah tercapai.<br />

Waktu yang lama <str<strong>on</strong>g>in</str<strong>on</strong>g>i menurunkan kesabaran<br />

masyarakat.<br />

SUKA CITA TANPA HARUS LUPA<br />

Sungguhpun proses k<strong>on</strong>sultasi telah menimbulkan<br />

ketidaksabaran, kekuatiran dan kelelahan yang<br />

mendera, namun itu semua telah terbayar melalui<br />

kesepakatan yang berhasil dicapai antara masyarakat,<br />

<strong>ADB</strong>-IRM, dan manajemen proyek. Pemenuhan<br />

komp<strong>on</strong>en proyek yang belum dilaksanakan<br />

(Komp<strong>on</strong>an A dan B) selama <str<strong>on</strong>g>in</str<strong>on</strong>g>i, masyarakat akan<br />

terlibat dan menjadi pengambil keputusan dalam<br />

setiap tahapan pelaksanaan proyek (perencanaan,<br />

pelaksanaan, m<strong>on</strong>itor<str<strong>on</strong>g>in</str<strong>on</strong>g>g), Pen<str<strong>on</strong>g>in</str<strong>on</strong>g>gkatan transparansi<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>formasi perkembangan proyek melalui media dan<br />

pen<str<strong>on</strong>g>in</str<strong>on</strong>g>gkatan k<str<strong>on</strong>g>in</str<strong>on</strong>g>erja fasilitator desa, serta pelatihan<br />

bagi Kelompok Operasi<strong>on</strong>al & Pemeliharaan (Pok-<br />

OP) sarana fisik, dan perbaikan sarana fisik di Desa<br />

Handil Baru Kec. Aluh‐aluh Kab. Banjar.<br />

“Siapa yang akan menyangka, jalan di desa kami itu<br />

akhirnya bisa diperbaiki,” kata seorang compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ant<br />

Desa Handil Baru, menyatakan pendapatnya<br />

tidak akan ada hasilnya (pengajuan kompla<str<strong>on</strong>g>in</str<strong>on</strong>g>) saat<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>i tidak berkomentar apa-apa lagi. Suka cita <str<strong>on</strong>g>in</str<strong>on</strong>g>i<br />

memang layak disyukuri, tanpa harus lupa untuk<br />

mengawal semua kesepakatan dalam waktu yang<br />

telah disepakati.<br />

Kegembiraan serupa juga diungkapkan oleh Staf<br />

OSPF yang sejak awal memfasilitasi proses <str<strong>on</strong>g>in</str<strong>on</strong>g>i. Hal<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>i cukup beralasan karena sepanjang mekanisme<br />

akuntabilitas <str<strong>on</strong>g>in</str<strong>on</strong>g>i diperbaharui (menggantikan<br />

mekanisme lama sejak Mei 2003), kompla<str<strong>on</strong>g>in</str<strong>on</strong>g><br />

masyarakat Kalimantan Selatan kepada <strong>ADB</strong><br />

melalui OSPF <str<strong>on</strong>g>in</str<strong>on</strong>g>i adalah yang keempat. Dan, <str<strong>on</strong>g>in</str<strong>on</strong>g>ilah<br />

satu‐satunya proses k<strong>on</strong>sultasi yang berujung pada<br />

kesepakatan semua pihak. v


Frame a Just Accountability Mechanism<br />

or Give Up Your Immunity<br />

The c<strong>on</strong>cept of natural justice entails that <str<strong>on</strong>g>in</str<strong>on</strong>g> any acti<strong>on</strong> or activity by any state or n<strong>on</strong>-state actor<br />

(sovereign or n<strong>on</strong>-sovereign) that imp<str<strong>on</strong>g>in</str<strong>on</strong>g>ges <strong>on</strong> the rights and entitlements of a pers<strong>on</strong> or a group of<br />

people or that results <str<strong>on</strong>g>in</str<strong>on</strong>g> significant changes <str<strong>on</strong>g>in</str<strong>on</strong>g> the surround<str<strong>on</strong>g>in</str<strong>on</strong>g>g envir<strong>on</strong>ment, ecology, livelihood,<br />

culture and identity, that pers<strong>on</strong> or group has a legitimate right to scrut<str<strong>on</strong>g>in</str<strong>on</strong>g>ize the activities, seek relevant<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong>, and appeal or seek redress before a relevant and appropriate forum.<br />

Therefore, it becomes all the more important<br />

for <strong>ADB</strong> to establish an <str<strong>on</strong>g>in</str<strong>on</strong>g>dependent accountability<br />

mechanism (AM) and a proper grievance redressal<br />

forum which appropriately addresses the lack of<br />

opportunities for the project-affected people to take<br />

<strong>ADB</strong> to court or sue them. The 2003 Policy and<br />

the current review process <str<strong>on</strong>g>in</str<strong>on</strong>g>dicate that the <strong>ADB</strong><br />

management is still not able to understand their<br />

resp<strong>on</strong>sibility or is underm<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g the process of<br />

natural justice.<br />

The Problem<br />

First of all, the <strong>ADB</strong> has to recognize its own<br />

resp<strong>on</strong>sibility as an agent of change with a visi<strong>on</strong><br />

to eradicate poverty and to <str<strong>on</strong>g>in</str<strong>on</strong>g>itiate susta<str<strong>on</strong>g>in</str<strong>on</strong>g>able<br />

development. The accountability of a multilateral<br />

development bank, aris<str<strong>on</strong>g>in</str<strong>on</strong>g>g from the impact and<br />

effects of its policies, projects and f<str<strong>on</strong>g>in</str<strong>on</strong>g>ancial support,<br />

cannot be diluted by br<str<strong>on</strong>g>in</str<strong>on</strong>g>g<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> the member countries<br />

and the project developers to shield it. <strong>ADB</strong> plays<br />

The Khulna-Jessore Dra<str<strong>on</strong>g>in</str<strong>on</strong>g>age Rehabilitati<strong>on</strong> Project <str<strong>on</strong>g>in</str<strong>on</strong>g> Bangladesh was <strong>on</strong>e of the projects<br />

filed by <str<strong>on</strong>g>Forum</str<strong>on</strong>g> members under the Accountability Mechanism. The compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t was rejected<br />

by Special Project Facilitator s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce the Project Completi<strong>on</strong> Report has been made. The<br />

failed project has left a legacy of social and envir<strong>on</strong>mental disasters such as <str<strong>on</strong>g>in</str<strong>on</strong>g>undati<strong>on</strong> of<br />

thousands of hectares of land and loss of <str<strong>on</strong>g>in</str<strong>on</strong>g>digenous variety of fish and crops.<br />

a significant role through its various <str<strong>on</strong>g>in</str<strong>on</strong>g>struments,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g grants and loans, <str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g>fluenc<str<strong>on</strong>g>in</str<strong>on</strong>g>g policies<br />

of member countries and the projects undertaken.<br />

Sec<strong>on</strong>dly, it is all the more realistic that the<br />

project-affected who are located far away from the<br />

<strong>ADB</strong> headquarters and its Resident Missi<strong>on</strong>s, <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

cases of disputes aris<str<strong>on</strong>g>in</str<strong>on</strong>g>g out of policies and projects<br />

(c<strong>on</strong>nected to and supported by <strong>ADB</strong>), will take<br />

recourse to local and nati<strong>on</strong>al appeal and redress<br />

mechanisms (not even know<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> the first place that<br />

there is an <strong>ADB</strong> c<strong>on</strong>necti<strong>on</strong>). If the projects come <str<strong>on</strong>g>in</str<strong>on</strong>g>to<br />

review under <strong>ADB</strong>’s Accountability Mechanism, it<br />

should be understood that the project-affected have<br />

exhausted all their opti<strong>on</strong>s and that there is no other<br />

alternative left.<br />

Due to the immunities and<br />

privileges enjoyed by the<br />

Asian Development Bank<br />

(<strong>ADB</strong>) under <str<strong>on</strong>g>in</str<strong>on</strong>g>ternati<strong>on</strong>al<br />

law and through its charters,<br />

<strong>ADB</strong> is shielded from private<br />

citizen lawsuits <str<strong>on</strong>g>in</str<strong>on</strong>g> member<br />

countries. This immunity<br />

basically denies affected<br />

people an effective forum<br />

to air their grievances and<br />

seek redress.<br />

Thirdly, it is also relevant that many of the<br />

develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g countries, while fac<str<strong>on</strong>g>in</str<strong>on</strong>g>g imm<str<strong>on</strong>g>in</str<strong>on</strong>g>ent<br />

lawsuits, can flaunt <strong>ADB</strong>’s immunity thereby<br />

transferr<str<strong>on</strong>g>in</str<strong>on</strong>g>g all the resp<strong>on</strong>sibility and accountability<br />

issues <strong>on</strong>to the shoulders of <strong>ADB</strong>.<br />

Fourthly, impart<str<strong>on</strong>g>in</str<strong>on</strong>g>g justice has to be prompt and<br />

quick, keep<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> m<str<strong>on</strong>g>in</str<strong>on</strong>g>d the universal axiom of ‘justice<br />

delayed is justice denied.’ <strong>ADB</strong>’s appeal mechanism<br />

cannot be mired <str<strong>on</strong>g>in</str<strong>on</strong>g> bureaucratic delays and has to be<br />

simple and understandable to the project-affected.<br />

<strong>ADB</strong> should be resp<strong>on</strong>sible for communicat<str<strong>on</strong>g>in</str<strong>on</strong>g>g its<br />

mechanism <str<strong>on</strong>g>in</str<strong>on</strong>g> detail to the project-affected.<br />

The member countries, be<str<strong>on</strong>g>in</str<strong>on</strong>g>g both d<strong>on</strong>or and<br />

n<strong>on</strong>-d<strong>on</strong>or members of the <strong>ADB</strong>, subscribe to the<br />

<strong>ADB</strong>’s Charter, and are part of its decisi<strong>on</strong>-mak<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

and adm<str<strong>on</strong>g>in</str<strong>on</strong>g>istrative processes. The countries and<br />

governments, therefore, cannot deny <strong>ADB</strong> the<br />

right to implement its policies which the member<br />

countries have themselves framed and accepted.<br />

Therefore…<br />

The soluti<strong>on</strong> lies <str<strong>on</strong>g>in</str<strong>on</strong>g> the follow<str<strong>on</strong>g>in</str<strong>on</strong>g>g:<br />

i. Adopt a robust Accountability Mechanism<br />

(AM) which is not subjected to the whims<br />

and fancies of its member countries or those<br />

be seen <str<strong>on</strong>g>in</str<strong>on</strong>g>stead as an attempt to restore the<br />

resp<strong>on</strong>sibility and accountability of the<br />

<strong>ADB</strong> to the project-affected, its primary<br />

beneficiaries.<br />

ii. The AM appeal cannot be subjected to the<br />

c<strong>on</strong>diti<strong>on</strong> of go<str<strong>on</strong>g>in</str<strong>on</strong>g>g a priori through local or<br />

nati<strong>on</strong>al dispute resoluti<strong>on</strong> mechanisms.<br />

iii. The AM has to compensate entirely for the<br />

the lack of the right of the project-affected<br />

to file lawsuits aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st the <strong>ADB</strong>. The<br />

immunity should not violate the universal<br />

rights of a pers<strong>on</strong> or a group of pers<strong>on</strong>s.<br />

The AM has to be seen <str<strong>on</strong>g>in</str<strong>on</strong>g> that respect and<br />

it should facilitate a process that makes up<br />

for the immunity that <strong>ADB</strong> enjoys.<br />

iv. The AM should not be subjected to<br />

bureaucratic delays. The time span from the<br />

appeal to its resoluti<strong>on</strong> has to be quick and<br />

fast-tracked with <strong>on</strong>e-w<str<strong>on</strong>g>in</str<strong>on</strong>g>dow resp<strong>on</strong>se.<br />

the project-affected through the Public<br />

On SPF’s Site Visit<br />

In the meantime, apparently pressured by<br />

SPF’s <str<strong>on</strong>g>in</str<strong>on</strong>g>terventi<strong>on</strong>, <strong>ADB</strong>’s Cambodia Resident<br />

Missi<strong>on</strong> (CARM) declared the c<strong>on</strong>duct of a new<br />

socio-ec<strong>on</strong>omic survey of the families to resolve<br />

the problems. Faced with two sets of processes, the<br />

families decided to go with the CARM survey and<br />

asked SPF to put the case <strong>on</strong> hold. If CARM still<br />

could not br<str<strong>on</strong>g>in</str<strong>on</strong>g>g about viable soluti<strong>on</strong>s, they thought<br />

that they could rely <strong>on</strong> SPF. In January 2008, SPF<br />

agreed to stay with the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ants.<br />

In July 2007, 63 Cambodian families who were <str<strong>on</strong>g>in</str<strong>on</strong>g>voluntarily relocated by the <strong>ADB</strong>-funded Highway<br />

One Project, filed a grievance with the Special Project Facilitator (SPF). Earlier <str<strong>on</strong>g>in</str<strong>on</strong>g> 2005, the <strong>ADB</strong><br />

management c<strong>on</strong>ducted a project audit; c<strong>on</strong>cluded that the <strong>ADB</strong>’s 1995 resettlement policy had not been<br />

followed; and directed the Cambodian government to repay the affected people with their due compensati<strong>on</strong>.<br />

Although the 63 families had received repayment, they still could not have their livelihoods restored to the<br />

pre-project level. They were heavily <str<strong>on</strong>g>in</str<strong>on</strong>g>debted, too. These problems were attributed to the c<strong>on</strong>siderable delay<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> the project’s compensati<strong>on</strong> delivery. Policy n<strong>on</strong>-compliance was already admitted by <strong>ADB</strong>. The claimants<br />

wanted outstand<str<strong>on</strong>g>in</str<strong>on</strong>g>g issues addressed. The case thus seemed a perfect fit with SPF’s mandate. 1<br />

the obstacle by hir<str<strong>on</strong>g>in</str<strong>on</strong>g>g a<br />

local c<strong>on</strong>sultant who was<br />

assigned to work with<br />

the families.<br />

SPF’s decisi<strong>on</strong> was welcomed by the 63 families.<br />

However, it would have been better if SPF had<br />

visited them directly for further <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong>. That<br />

would have ga<str<strong>on</strong>g>in</str<strong>on</strong>g>ed for SPF a lead role <str<strong>on</strong>g>in</str<strong>on</strong>g> the case,<br />

which could have arguably shortened the succeed<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

negotiati<strong>on</strong>s between the families and CARM that<br />

ended up tak<str<strong>on</strong>g>in</str<strong>on</strong>g>g nearly two years. In October 2009,<br />

<strong>ADB</strong> f<str<strong>on</strong>g>in</str<strong>on</strong>g>ally approved a USD 500,000 grant project,<br />

which <str<strong>on</strong>g>in</str<strong>on</strong>g>cluded a comp<strong>on</strong>ent to restructure the 63<br />

families’ debts. 3<br />

SPF must ga<str<strong>on</strong>g>in</str<strong>on</strong>g> the claimants’ c<strong>on</strong>fidence <str<strong>on</strong>g>in</str<strong>on</strong>g> its<br />

processes to be able to work effectively. Face-toface<br />

dialogues with affected people are <str<strong>on</strong>g>in</str<strong>on</strong>g>dispensible<br />

to fulfill SPF’s missi<strong>on</strong>. We need to be rem<str<strong>on</strong>g>in</str<strong>on</strong>g>ded<br />

that under the current structure, SPF is still part<br />

SPF also sent its c<strong>on</strong>sultant to the community leaders (M<str<strong>on</strong>g>in</str<strong>on</strong>g>g Chh<str<strong>on</strong>g>in</str<strong>on</strong>g> and M<str<strong>on</strong>g>in</str<strong>on</strong>g>g Vanna)<br />

to expla<str<strong>on</strong>g>in</str<strong>on</strong>g> the SPF mechanism to them.

the management’s last opportunity to improve the<br />

project. In December 2010, <strong>ADB</strong>’s Southeast Asia<br />

Director-General, after hav<str<strong>on</strong>g>in</str<strong>on</strong>g>g received compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts<br />

from communities relocated by <strong>ADB</strong>’s railway<br />

rehabilitati<strong>on</strong> project <str<strong>on</strong>g>in</str<strong>on</strong>g> Cambodia, visited the<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ants and listened directly to their voices.<br />

This, <str<strong>on</strong>g>in</str<strong>on</strong>g> every<strong>on</strong>e’s eyes, would be useful not <strong>on</strong>ly<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> resolv<str<strong>on</strong>g>in</str<strong>on</strong>g>g emerg<str<strong>on</strong>g>in</str<strong>on</strong>g>g problems but also <str<strong>on</strong>g>in</str<strong>on</strong>g> deal<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

with challenges that might be encountered by<br />

families yet to be resettled under the project. If the<br />

Director-General could visit affected communities<br />

for <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong>, why couldn’t the SPF?<br />

<strong>on</strong> the Accountability Mechanism<br />

In the case of Highway 1, the project started <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

1999 and ended <str<strong>on</strong>g>in</str<strong>on</strong>g> 2005, but the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t to OSPF<br />

was filed <strong>on</strong>ly <str<strong>on</strong>g>in</str<strong>on</strong>g> 2007! What is wr<strong>on</strong>g with the AM?<br />

Why did the community not compla<str<strong>on</strong>g>in</str<strong>on</strong>g> earlier? All<br />

the answers are with the <strong>ADB</strong> and the Execut<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

Agency (EA)/government. The OSPF or the CRP,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> particular, can provide the answers.<br />

There is a tremendous lack of <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong> <strong>on</strong><br />

the AM and <strong>on</strong> the various project comp<strong>on</strong>ents,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g the c<strong>on</strong>sequent impacts, am<strong>on</strong>g the<br />

project-affected people <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>ADB</strong>-funded projects and<br />

technical assistances (TA).<br />

s the experience <str<strong>on</strong>g>in</str<strong>on</strong>g> the Highway 1 Project <str<strong>on</strong>g>in</str<strong>on</strong>g> Cambodia shows, a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t of which has been filed to<br />

the Office of the Special Project Facilitator (OSPF) s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce 2007, there are still some issues that need to<br />

be reviewed and that demand feedback from the community and N<strong>on</strong> Government Organizati<strong>on</strong>s.<br />

Another c<strong>on</strong>tentious issue is the numerous steps<br />

for the community to follow. With a l<strong>on</strong>g 8-step<br />

process <str<strong>on</strong>g>in</str<strong>on</strong>g> AM implementati<strong>on</strong>, we suggest that the<br />

follow<str<strong>on</strong>g>in</str<strong>on</strong>g>g be merged: step 3 with step 4 and step 6<br />

with step 7. In our experience, the process of gett<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

approval from the Board or the <strong>ADB</strong> President<br />

takes a l<strong>on</strong>g time to go through each step. So if the<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t was eligible for further <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong>, the<br />

process should not take much l<strong>on</strong>ger anymore. The<br />

affected communities who submitted the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts<br />

need a speedy resoluti<strong>on</strong>.<br />

The <str<strong>on</strong>g>in</str<strong>on</strong>g>specti<strong>on</strong> and <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> process, as<br />

well as its procedures, is too lengthy, complicated<br />

and difficult for most affected people to comply<br />

with.<br />

We are c<strong>on</strong>cerned that the process rema<str<strong>on</strong>g>in</str<strong>on</strong>g>s<br />

complicated and will not be readily accessible to<br />

many affected communities with<str<strong>on</strong>g>in</str<strong>on</strong>g> Cambodia. These<br />

communities will require professi<strong>on</strong>al assistance<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> lodg<str<strong>on</strong>g>in</str<strong>on</strong>g>g claims. Efforts will need to be made to<br />

educate communities <strong>on</strong> their right to <str<strong>on</strong>g>in</str<strong>on</strong>g>itiate review<br />

acti<strong>on</strong>s.<br />

Another th<str<strong>on</strong>g>in</str<strong>on</strong>g>g that begs an answer is why OSPF<br />

and CRP need the approval of the government.<br />

Under this arrangement, the OSPF and CRP can<br />

never work it out for the community affected by the<br />

project. What is the role then of OSPF and CRP?<br />

What is the <strong>ADB</strong> policy for?<br />

In our view, the team <str<strong>on</strong>g>in</str<strong>on</strong>g> charge of review<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t should be <str<strong>on</strong>g>in</str<strong>on</strong>g>dependent of the pers<strong>on</strong>(s)<br />

resp<strong>on</strong>sible for the decisi<strong>on</strong> that would determ<str<strong>on</strong>g>in</str<strong>on</strong>g>e<br />

the eligibility of the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t.<br />

at the <strong>ADB</strong> level, but no grievance mechanisms<br />

exist at the local <strong>on</strong>e where <str<strong>on</strong>g>in</str<strong>on</strong>g>dividuals can directly<br />

settle their problems. There should be no restricti<strong>on</strong><br />

<strong>on</strong> the m<str<strong>on</strong>g>in</str<strong>on</strong>g>imum number of compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ant. Any<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>dividual who has a valid c<strong>on</strong>cern or <str<strong>on</strong>g>in</str<strong>on</strong>g>terest, or has<br />

been affected by a project can file a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t. The<br />

process to determ<str<strong>on</strong>g>in</str<strong>on</strong>g>e the eligibility of a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t<br />

at the SPF level heavily depends <strong>on</strong> the op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong>s of<br />

<strong>ADB</strong> staff, the Execut<str<strong>on</strong>g>in</str<strong>on</strong>g>g Agency (EA)/government<br />

or the private project sp<strong>on</strong>sor (PPS). Those op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong>s<br />

should be made public as so<strong>on</strong> as a decisi<strong>on</strong> is<br />

made.<br />

Projects that <str<strong>on</strong>g>in</str<strong>on</strong>g>volve a change <str<strong>on</strong>g>in</str<strong>on</strong>g> the envir<strong>on</strong>ment<br />

and <str<strong>on</strong>g>in</str<strong>on</strong>g>voluntary resettlement usually trigger l<strong>on</strong>gterm<br />

impacts bey<strong>on</strong>d the project completi<strong>on</strong><br />

report (PCR). However, as it is, the eligibility of<br />

the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t depends <strong>on</strong> the release of the PCR.<br />

Acceptance of compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts under the accountability<br />

mechanism should not be limited by the issuance of<br />

the PCR.<br />

One more questi<strong>on</strong> rema<str<strong>on</strong>g>in</str<strong>on</strong>g>s: how can the <strong>ADB</strong><br />

make the Accountability Mechanism work?<br />

Exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g Accountability Mechanism:<br />

Beh<str<strong>on</strong>g>in</str<strong>on</strong>g>d the Masquerade<br />

Catastrophe for Affected People<br />

Rather, the lack of awareness and more so the<br />

lack of drive to promote awareness <strong>on</strong> the existence<br />

and functi<strong>on</strong>s of AM can be blamed for this. Thus<br />

far, <str<strong>on</strong>g>in</str<strong>on</strong>g> general, <strong>ADB</strong> with its’ standards, mechanisms,<br />

and policies, <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g the AM, is far from people’s<br />

awareness. With these facts, it is questi<strong>on</strong>able that<br />

<strong>ADB</strong> claimed as a public <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>, but <str<strong>on</strong>g>in</str<strong>on</strong>g> reality it<br />

is actually far from the public.<br />

Mak<str<strong>on</strong>g>in</str<strong>on</strong>g>g AM an <str<strong>on</strong>g>in</str<strong>on</strong>g>tegral part of the project at<br />

its early stages of implementati<strong>on</strong> could have made<br />

th<str<strong>on</strong>g>in</str<strong>on</strong>g>gs different and better. The exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g policy has<br />

not required this to happen. So, the affected people<br />

(AP) have not been able to understand the relevance<br />

and importance of it. This has naturally prevented<br />

them from understand<str<strong>on</strong>g>in</str<strong>on</strong>g>g how and where to address<br />

their compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t prior to project implementati<strong>on</strong>, or<br />

us<str<strong>on</strong>g>in</str<strong>on</strong>g>g it <str<strong>on</strong>g>in</str<strong>on</strong>g> the early stage.<br />

Sec<strong>on</strong>dly, even after ga<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g knowledge<br />

about this mechanism, people still found it rather<br />

hard to use because it is heavily procedural and<br />

bureaucratic. Statements of <str<strong>on</strong>g>in</str<strong>on</strong>g>eligibility such as<br />

“compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ants have yet to address the problem to the<br />

c<strong>on</strong>cerned operati<strong>on</strong>s department” 1 <strong>on</strong>ly burdened<br />

the affected people who are putt<str<strong>on</strong>g>in</str<strong>on</strong>g>g forward their<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t. The material and time lost <str<strong>on</strong>g>in</str<strong>on</strong>g> submitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t are not be<str<strong>on</strong>g>in</str<strong>on</strong>g>g taken <str<strong>on</strong>g>in</str<strong>on</strong>g>to account by<br />

the decisi<strong>on</strong>-makers. Supposedly, as a c<strong>on</strong>sequence<br />

of the losses created by the Management and the<br />

Operati<strong>on</strong>s Department, the <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong> through<br />

its Accountability Mechanism should have been<br />

address<str<strong>on</strong>g>in</str<strong>on</strong>g>g the grievances to those who displaced you. <strong>ADB</strong>’S Accountability Mechanism is supposed<br />

to do this <str<strong>on</strong>g>in</str<strong>on</strong>g> projects supported by it.<br />

Ind<strong>on</strong>esia recorded 303<br />

loans so far. But s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce AM<br />

was established <str<strong>on</strong>g>in</str<strong>on</strong>g> May<br />

2003, there were <strong>on</strong>ly two<br />

cases submitted, and <strong>on</strong>ly<br />

<strong>on</strong>e was c<strong>on</strong>sidered as<br />

eligible. This near to n<strong>on</strong>e<br />

number of compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts are <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

no way <str<strong>on</strong>g>in</str<strong>on</strong>g>dicator of success<br />

of the projects.<br />

The build<str<strong>on</strong>g>in</str<strong>on</strong>g>g of this current mechanism is much<br />

like an ivory tower. It does not proactively reach<br />

the potential affected people 2 and the identified<br />

affected people. In additi<strong>on</strong>, it is impractical for the<br />

APs to use this mechanism. It is far from be<str<strong>on</strong>g>in</str<strong>on</strong>g>g ‘a


friendly and accessible mechanism.’ For a country<br />

that c<strong>on</strong>sists of 17,508 islands, Ind<strong>on</strong>esia faces<br />

difficulties <str<strong>on</strong>g>in</str<strong>on</strong>g> provid<str<strong>on</strong>g>in</str<strong>on</strong>g>g proper communicati<strong>on</strong> and<br />

transportati<strong>on</strong> services for the whole archipelago.<br />

As a c<strong>on</strong>sequence, it is near impossible for the<br />

APs to address their compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts or grievances to<br />

the Ind<strong>on</strong>esian Resident Missi<strong>on</strong> which is based <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

the capital city, Jakarta. Internet service, as <str<strong>on</strong>g>in</str<strong>on</strong>g> most<br />

parts of the develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g countries, can best be termed<br />

as a tertiary good, about which most of the people<br />

are either not aware or are not equipped to access.<br />

Civil society organizati<strong>on</strong>s have criticized the<br />

<strong>ADB</strong>’s AM dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g the <strong>ADB</strong> AM Policy Review<br />

held <str<strong>on</strong>g>in</str<strong>on</strong>g> November 2010 <str<strong>on</strong>g>in</str<strong>on</strong>g> Ind<strong>on</strong>esia. They<br />

c<strong>on</strong>veyed their c<strong>on</strong>cerns <str<strong>on</strong>g>in</str<strong>on</strong>g> at least three areas: 1)<br />

The compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t scope does not cover corrupti<strong>on</strong> and<br />

impact assessment <strong>on</strong> the project (it even tends to<br />

sidel<str<strong>on</strong>g>in</str<strong>on</strong>g>e the issue rather than deliver the problems<br />

to the c<strong>on</strong>cerned department); 2) Tim<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the<br />

project is limited to the submissi<strong>on</strong> of the Project<br />

Completi<strong>on</strong> Report (PCR); and 3) Accountability<br />

Mechanism should be a project comp<strong>on</strong>ent and not<br />

separated from the whole design and implementati<strong>on</strong><br />

of a project.<br />

Envir<strong>on</strong>mental Stand<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

This mechanism <strong>on</strong>ly focuses <strong>on</strong> people who<br />

are go<str<strong>on</strong>g>in</str<strong>on</strong>g>g to be affected. But we are all aware that<br />

the envir<strong>on</strong>ment can potentially be affected or<br />

harmed by any project. The AM does not guarantee<br />

though that the envir<strong>on</strong>ment would be rehabilitated<br />

whenever it is affected. Thus, by us<str<strong>on</strong>g>in</str<strong>on</strong>g>g the<br />

c<strong>on</strong>structi<strong>on</strong> comm<strong>on</strong>ly used <str<strong>on</strong>g>in</str<strong>on</strong>g> envir<strong>on</strong>mental law,<br />

an envir<strong>on</strong>mental legal stand<str<strong>on</strong>g>in</str<strong>on</strong>g>g may be adopted <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

the AM c<strong>on</strong>text. S<str<strong>on</strong>g>in</str<strong>on</strong>g>ce the envir<strong>on</strong>ment is not able to<br />

file a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t for itself, then the envir<strong>on</strong>ment could<br />

be represented by envir<strong>on</strong>mental <str<strong>on</strong>g>NGO</str<strong>on</strong>g>s or any<strong>on</strong>e<br />

who shows c<strong>on</strong>cern <str<strong>on</strong>g>in</str<strong>on</strong>g> protect<str<strong>on</strong>g>in</str<strong>on</strong>g>g the envir<strong>on</strong>ment.<br />

As such, the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ants are not <strong>on</strong>ly the affected<br />

people, but also the affected envir<strong>on</strong>ment.<br />

Unless the Bank amends the AM policy <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

order to make the mechanism user-friendly and<br />

sympathetic to both the affected people and the<br />

affected envir<strong>on</strong>ment, the Bank’s accountability<br />

mechanism will rema<str<strong>on</strong>g>in</str<strong>on</strong>g> a masquerade for the Bank.<br />

Will the Bank ever be accountable to the<br />

Submissi<strong>on</strong> to the<br />

Accountability Mechanism Review*<br />

T<br />

he Accountability Mechanism (AM) has been <str<strong>on</strong>g>in</str<strong>on</strong>g> implementati<strong>on</strong> s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce 2003. However, 27 cases are<br />

be<str<strong>on</strong>g>in</str<strong>on</strong>g>g registered under the C<strong>on</strong>sultati<strong>on</strong> Phase, first phase of AM, <str<strong>on</strong>g>in</str<strong>on</strong>g> seven years. Out of which, 10<br />

were deemed as eligible. Seventeen (17) compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts were declared as not eligible by Special Project<br />

Facilitator (SPF) particularly due to adm<str<strong>on</strong>g>in</str<strong>on</strong>g>istrative issues, i.e. 10 compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts were not raised to the Operati<strong>on</strong>s<br />

Department (OD) prior to the fil<str<strong>on</strong>g>in</str<strong>on</strong>g>g of said compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts. Furthermore, <str<strong>on</strong>g>in</str<strong>on</strong>g> its sec<strong>on</strong>d phase, Compliance Review<br />

Phase, <strong>on</strong>ly 3 compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts were registered so far. There was a five-year gap from 2004 to 2009 as not a s<str<strong>on</strong>g>in</str<strong>on</strong>g>gle<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t was filed to the Compliance Review Panel (CRP). This was not because the <strong>ADB</strong> is do<str<strong>on</strong>g>in</str<strong>on</strong>g>g well<br />

with their projects. But <strong>on</strong> the c<strong>on</strong>trary, it <str<strong>on</strong>g>in</str<strong>on</strong>g>dicates that this policy has not been effective enough to raise the<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>terest and the capacity of the affected people to file such highly technical compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts.<br />

Based <strong>on</strong> the experiences gathered from<br />

more than 40 <strong>ADB</strong>-funded projects, <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g 11<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts registered under the AM by members<br />

of the <str<strong>on</strong>g>NGO</str<strong>on</strong>g> <str<strong>on</strong>g>Forum</str<strong>on</strong>g> <strong>on</strong> the <strong>ADB</strong>, we c<strong>on</strong>clude two<br />

major facts: first, the lack of <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong> about AM<br />

and its procedures am<strong>on</strong>g affected people especially<br />

dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g the early stages of the project; and sec<strong>on</strong>d,<br />

the lack of trust and c<strong>on</strong>fidence am<strong>on</strong>g affected<br />

people <str<strong>on</strong>g>in</str<strong>on</strong>g> fil<str<strong>on</strong>g>in</str<strong>on</strong>g>g a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t to the <strong>ADB</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> resolv<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

their grievances. There are persist<str<strong>on</strong>g>in</str<strong>on</strong>g>g problems<br />

about the effectiveness and c<strong>on</strong>stra<str<strong>on</strong>g>in</str<strong>on</strong>g>ts faced by<br />

affected people as they seek AM to hold<str<strong>on</strong>g>in</str<strong>on</strong>g>g the <strong>ADB</strong><br />

accountable for its f<str<strong>on</strong>g>in</str<strong>on</strong>g>anc<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> their respective<br />

places due to different political realities.<br />

Issues for c<strong>on</strong>siderati<strong>on</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> the AM review are as<br />

follows:<br />

Lack of <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong><br />

There is a tremendous lack of <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong> <strong>on</strong> the<br />

AM as well as about project comp<strong>on</strong>ents, <str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

their respective impacts, am<strong>on</strong>g project-affected<br />

people <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>ADB</strong>-funded projects and programs <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

develop<str<strong>on</strong>g>in</str<strong>on</strong>g>g member countries (DMCs). Projectaffected<br />

people d<strong>on</strong>’t know if they can file their<br />

grievances <str<strong>on</strong>g>in</str<strong>on</strong>g> such a forum. As the current AM is<br />

a separate mechanism from the project, this leads<br />

to lack of knowledge <str<strong>on</strong>g>in</str<strong>on</strong>g> address<str<strong>on</strong>g>in</str<strong>on</strong>g>g their grievances<br />

aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st the impact of a project. Most borrowers,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>clud<str<strong>on</strong>g>in</str<strong>on</strong>g>g implement<str<strong>on</strong>g>in</str<strong>on</strong>g>g agencies, either are not<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>formed or are not <str<strong>on</strong>g>in</str<strong>on</strong>g>form<str<strong>on</strong>g>in</str<strong>on</strong>g>g project-affected<br />

people about this mechanism at the earliest stage<br />

of the project cycle. The AM must be <str<strong>on</strong>g>in</str<strong>on</strong>g>cluded as a<br />

mandatory comp<strong>on</strong>ent of each <strong>ADB</strong>-funded or cof<str<strong>on</strong>g>in</str<strong>on</strong>g>anced<br />

projects.<br />

‘Directly affected materially and<br />

adversely’<br />

Impacts of a project go bey<strong>on</strong>d be<str<strong>on</strong>g>in</str<strong>on</strong>g>g material<br />

and direct. Chang<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the envir<strong>on</strong>ment, shelters<br />

and livelihoods, and cultural heritage will not <strong>on</strong>ly<br />

cause material harm such as loss of shelter and<br />

livelihoods, but also n<strong>on</strong>-material harm such as loss<br />

of cultural lives, <str<strong>on</strong>g>in</str<strong>on</strong>g>creas<str<strong>on</strong>g>in</str<strong>on</strong>g>g oppressi<strong>on</strong> and gender<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>justices, and human rights violati<strong>on</strong>s, am<strong>on</strong>g<br />

others.<br />

However, the AM limits its scope to people who<br />

are ”directly affected materially and adversely.”<br />

Though the Envir<strong>on</strong>mental Impacts Assessment<br />

(EIA) under the 2009 Safeguard Policy Statement,<br />

for example, requires assessment of direct and<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>direct envir<strong>on</strong>mental impacts. It means, there is<br />

an acceptance that impacts of a project may also be<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>direct. The AM must broaden its scope to <str<strong>on</strong>g>in</str<strong>on</strong>g>clude<br />

‘<str<strong>on</strong>g>in</str<strong>on</strong>g>direct’ and ‘n<strong>on</strong>-material’ harm to the people.<br />

Who can file a compla<str<strong>on</strong>g>in</str<strong>on</strong>g><br />

In most cases, there are no local grievance<br />

mechanism where <str<strong>on</strong>g>in</str<strong>on</strong>g>dividuals can settle their<br />

problems. There should not be restricti<strong>on</strong> <strong>on</strong><br />

m<str<strong>on</strong>g>in</str<strong>on</strong>g>imal numbers of compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ant. Any <str<strong>on</strong>g>in</str<strong>on</strong>g>dividual<br />

who has c<strong>on</strong>cern, <str<strong>on</strong>g>in</str<strong>on</strong>g>terest, or has been affected by<br />

a project can file a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t. Attenti<strong>on</strong> must be<br />

paid to the most discrim<str<strong>on</strong>g>in</str<strong>on</strong>g>ated groups like women<br />

and <str<strong>on</strong>g>in</str<strong>on</strong>g>digenous people <str<strong>on</strong>g>in</str<strong>on</strong>g> view of their suppressed<br />

status <str<strong>on</strong>g>in</str<strong>on</strong>g> society. Requests from local, nati<strong>on</strong>al and<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>ternati<strong>on</strong>al legal entities/bodies, whom statutes<br />

clearly set forth <str<strong>on</strong>g>in</str<strong>on</strong>g> their missi<strong>on</strong> and objectives to<br />

protect <str<strong>on</strong>g>in</str<strong>on</strong>g>ternati<strong>on</strong>al rights and the envir<strong>on</strong>ment also<br />

should be admitted.<br />

Fil<str<strong>on</strong>g>in</str<strong>on</strong>g>g compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts to SPF/CRP<br />

The compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ant should be provided the choice<br />

to file his/her case either to the SPF or CRP, or even<br />

file it simultaneously to both AM phases. For this<br />

purpose, SPF and CRP should provide <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong><br />

about the maximum assistance they can provide to<br />

affected people. C<strong>on</strong>sider<str<strong>on</strong>g>in</str<strong>on</strong>g>g that there are <strong>ADB</strong><br />

projects located <str<strong>on</strong>g>in</str<strong>on</strong>g> remote areas, requests should be<br />

allowed to be submitted <str<strong>on</strong>g>in</str<strong>on</strong>g> writ<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> local language<br />

and a form which is familiar and comfortable to the<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ant.<br />

Transparency of eligibility process and<br />

grievance mechanism if SPF deems a<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t as not eligible<br />

The process to determ<str<strong>on</strong>g>in</str<strong>on</strong>g>e eligibility of a<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t at the SPF level heavily depends <strong>on</strong><br />

op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong>s from <strong>ADB</strong> staff, the Execut<str<strong>on</strong>g>in</str<strong>on</strong>g>g Agency<br />

(EA)/government or PPS (private project sp<strong>on</strong>sor).<br />

Those op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong>s should be made public when a<br />

decisi<strong>on</strong> is made. Furthermore, a grievance or appeal<br />

mechanism must be provided if a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ant<br />

doesn’t agree with the decisi<strong>on</strong> made.<br />

Assessment of a project as a whole<br />

AM is designed to f<str<strong>on</strong>g>in</str<strong>on</strong>g>d soluti<strong>on</strong> to a problem<br />

caused by a project, either through problem solv<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

or <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> of n<strong>on</strong>-compliance to policies.<br />

N<strong>on</strong>-compliance to policies will def<str<strong>on</strong>g>in</str<strong>on</strong>g>itely affect<br />

the whole project. The exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g role of the CRP<br />

should not merely be c<strong>on</strong>f<str<strong>on</strong>g>in</str<strong>on</strong>g>ed to provid<str<strong>on</strong>g>in</str<strong>on</strong>g>g specific<br />

project site soluti<strong>on</strong> where the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t comes<br />

from. In order to make sure a comprehensive and<br />

adequate result or soluti<strong>on</strong>, submitted compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t<br />

should be treated as the basis to review the whole<br />

project. <strong>ADB</strong> can stop further the implementati<strong>on</strong><br />

of a project if they found major problems at the<br />

prelim<str<strong>on</strong>g>in</str<strong>on</strong>g>ary <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> of the SPF and/or CRP.<br />

Expansi<strong>on</strong> to wider range of issues<br />

It is desirable to <str<strong>on</strong>g>in</str<strong>on</strong>g>clude issues other than the<br />

<strong>on</strong>es raised <str<strong>on</strong>g>in</str<strong>on</strong>g> a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t. Dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g an <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong><br />

by the SPF, usually local communities <strong>on</strong>ly come<br />

to know related problems and violati<strong>on</strong>s under the<br />

project. However, relevant problems other than<br />

specified <str<strong>on</strong>g>in</str<strong>on</strong>g> the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t are not c<strong>on</strong>sidered by SPF<br />

as it is necessary to write and file a new compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t.<br />

PRC should not be the cut-off date for<br />

n<strong>on</strong> eligibility<br />

Projects related to chang<str<strong>on</strong>g>in</str<strong>on</strong>g>g envir<strong>on</strong>ment and<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>voluntary resettlement usually triggerl<strong>on</strong>gterm<br />

impacts bey<strong>on</strong>d the project completi<strong>on</strong> report<br />

(PCR). However, the eligibility of the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t<br />

depends <strong>on</strong> the release of the PCR. Acceptance of<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts to the accountability mechanism should<br />

not be limited until after issuance of the PCR. The<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t must be accepted as l<strong>on</strong>g as a borrow<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

country is repay<str<strong>on</strong>g>in</str<strong>on</strong>g>g the loan amount to the <strong>ADB</strong>.<br />

Private Sector Operati<strong>on</strong>s<br />

In l<str<strong>on</strong>g>in</str<strong>on</strong>g>e with the Public Communicati<strong>on</strong> Policy<br />

(PCP), the AM also protects the c<strong>on</strong>fidentiality of<br />

the private sectors projects. The issue of bus<str<strong>on</strong>g>in</str<strong>on</strong>g>ess<br />

c<strong>on</strong>fidentiality is critically looked at <str<strong>on</strong>g>in</str<strong>on</strong>g> the <strong>on</strong>-go<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

review of the <strong>ADB</strong> PCP. The private sector operati<strong>on</strong>s<br />

must be <str<strong>on</strong>g>in</str<strong>on</strong>g>cluded <str<strong>on</strong>g>in</str<strong>on</strong>g> the purview of the AM as it<br />

directly c<strong>on</strong>travenes the right to <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong> – an<br />

important country-system c<strong>on</strong>stituti<strong>on</strong>al provisi<strong>on</strong>.<br />

The AM does not clearly def<str<strong>on</strong>g>in</str<strong>on</strong>g>e its applicati<strong>on</strong><br />

<strong>on</strong> f<str<strong>on</strong>g>in</str<strong>on</strong>g>ancial <str<strong>on</strong>g>in</str<strong>on</strong>g>termediaries nor <strong>on</strong> co-f<str<strong>on</strong>g>in</str<strong>on</strong>g>anciers<br />

when it comes to private sector operati<strong>on</strong>s. The AM<br />

must expand its mandate <strong>on</strong> co-f<str<strong>on</strong>g>in</str<strong>on</strong>g>anc<str<strong>on</strong>g>in</str<strong>on</strong>g>g projects<br />

as well as F<str<strong>on</strong>g>in</str<strong>on</strong>g>ancial Intermediaries. Like <str<strong>on</strong>g>in</str<strong>on</strong>g> the case<br />

of the Southern Transport Development Project<br />

(STDP) <str<strong>on</strong>g>in</str<strong>on</strong>g> Sri Lanka, the CRP recommended that<br />

<strong>ADB</strong> management should review its co-f<str<strong>on</strong>g>in</str<strong>on</strong>g>anc<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

arrangements for the project to strengthen the its<br />

compliance to the Safeguard Policy. Although a<br />

Memorandum of Understand<str<strong>on</strong>g>in</str<strong>on</strong>g>g was signed between<br />

<strong>ADB</strong> and JBIC, the MOU did not address the issue<br />

of co-f<str<strong>on</strong>g>in</str<strong>on</strong>g>anc<str<strong>on</strong>g>in</str<strong>on</strong>g>g compliance.<br />

Immediate resp<strong>on</strong>se rather than lengthy<br />

process<br />

The <str<strong>on</strong>g>in</str<strong>on</strong>g>specti<strong>on</strong> and <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> process, as well<br />

as its procedures, are too lengthy, complicated and<br />

difficult for most affected people. At the beg<str<strong>on</strong>g>in</str<strong>on</strong>g>n<str<strong>on</strong>g>in</str<strong>on</strong>g>g,<br />

the first full <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> also raised c<strong>on</strong>cerns about<br />

the <str<strong>on</strong>g>in</str<strong>on</strong>g>dependence, credibility, transparency and<br />

dissem<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> of <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong>, and the effectiveness<br />

of the <str<strong>on</strong>g>in</str<strong>on</strong>g>specti<strong>on</strong>.<br />

AM is very complicated and usually takes a<br />

l<strong>on</strong>g time to attend to compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts. AM should not<br />

burden the local communities to f<str<strong>on</strong>g>in</str<strong>on</strong>g>d all policy<br />

violati<strong>on</strong>s and it should be the role of AM to f<str<strong>on</strong>g>in</str<strong>on</strong>g>d<br />

them or hire <str<strong>on</strong>g>in</str<strong>on</strong>g>dependent legal and technical experts<br />

to f<str<strong>on</strong>g>in</str<strong>on</strong>g>d such policy violati<strong>on</strong>s. The mechanism needs<br />

to be improved and simplified. It should take shorter<br />

time. The operati<strong>on</strong>s department has not always<br />

been resp<strong>on</strong>sive. It is a waste of time for affected<br />

people to file their grievance to <strong>ADB</strong> management<br />

and borrower government just to have their<br />

respective compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t declared eligible at the SPF.<br />

Although affected people may have already filed<br />

the case to the SPF or CRP, project implementati<strong>on</strong><br />

c<strong>on</strong>t<str<strong>on</strong>g>in</str<strong>on</strong>g>ues, hence add<str<strong>on</strong>g>in</str<strong>on</strong>g>g more burden to affected<br />

people. A project’s implementati<strong>on</strong> should be<br />

put <strong>on</strong> hold while await<str<strong>on</strong>g>in</str<strong>on</strong>g>g the declarati<strong>on</strong> of a<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t’s eligibility unless the grievances have<br />

been addressed completely and satisfactorily with<br />

utmost participati<strong>on</strong> of project-affected people.<br />

Lack of trust am<strong>on</strong>g affected people<br />

AM should be very c<strong>on</strong>cerned <strong>on</strong> the different<br />

political realities <str<strong>on</strong>g>in</str<strong>on</strong>g> the member countries. Affected<br />

people fear their respective oppressive governments.<br />

This is <strong>on</strong>e of the reas<strong>on</strong>s why they d<strong>on</strong>’t show<br />

their disagreement to a project, not to menti<strong>on</strong> file<br />

compla<str<strong>on</strong>g>in</str<strong>on</strong>g>ts aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st a project implemented by the<br />

government or a private sector project supported by<br />

the government. The AM <str<strong>on</strong>g>in</str<strong>on</strong>g> its provisi<strong>on</strong>s menti<strong>on</strong><br />

that the SPF or CRP will keep the identities of<br />

the requesters c<strong>on</strong>fidential if requested. This has<br />

not been the case. The requesters feel that due to<br />

their case they have been <str<strong>on</strong>g>in</str<strong>on</strong>g>timidated by execut<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

agencies. In such situati<strong>on</strong>s, women <str<strong>on</strong>g>in</str<strong>on</strong>g> particular<br />

become vulnerable to physical and psychological<br />

harassment. Many affected people believe that due<br />

to their name <str<strong>on</strong>g>in</str<strong>on</strong>g> the compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t, they were treated<br />

badly by the execut<str<strong>on</strong>g>in</str<strong>on</strong>g>g agencies. There are no clear<br />

provisi<strong>on</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> the AM, outl<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g its resp<strong>on</strong>sibilities,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> deal<str<strong>on</strong>g>in</str<strong>on</strong>g>g with fears of affected people from the<br />

possiblity of be<str<strong>on</strong>g>in</str<strong>on</strong>g>g harassed by the execut<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

agencies <str<strong>on</strong>g>in</str<strong>on</strong>g> borrow<str<strong>on</strong>g>in</str<strong>on</strong>g>g countries.<br />

SPF and CRP: M<strong>on</strong>itor<str<strong>on</strong>g>in</str<strong>on</strong>g>g,<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> and its functi<strong>on</strong><br />

The process is too bureaucratic which affected<br />

people d<strong>on</strong>’t understand. The CRP m<strong>on</strong>itor<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

and <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> process is not satisfactory. It is<br />

recommended that the CRP team needs assistance<br />

of technical experts to evaluate the specific issues<br />

under a compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t. Many are <str<strong>on</strong>g>in</str<strong>on</strong>g> the op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> that CRP<br />

must have a technical advisory, advis<str<strong>on</strong>g>in</str<strong>on</strong>g>g them <strong>on</strong><br />

technical issues such as compensati<strong>on</strong>, value of land<br />

and property, and envir<strong>on</strong>mental, am<strong>on</strong>g others.<br />

It is believed that there is a limitati<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

CRP’s functi<strong>on</strong>. The 2006 CRP m<strong>on</strong>itor<str<strong>on</strong>g>in</str<strong>on</strong>g>g report <strong>on</strong><br />

STDP <str<strong>on</strong>g>in</str<strong>on</strong>g> Sri Lanka shows that the <strong>ADB</strong> management<br />

and the execut<str<strong>on</strong>g>in</str<strong>on</strong>g>g agency did not complied with<br />

most of the remedial acti<strong>on</strong> proposed <str<strong>on</strong>g>in</str<strong>on</strong>g> the CRP<br />

report issued <str<strong>on</strong>g>in</str<strong>on</strong>g> July 2005. It is also recommended<br />

that the CRP must be allowed to appo<str<strong>on</strong>g>in</str<strong>on</strong>g>t its own<br />

Secretary, not by the management, who will assist<br />

them <str<strong>on</strong>g>in</str<strong>on</strong>g> their tenure. The resp<strong>on</strong>sibility of the CRP<br />

must be clearly menti<strong>on</strong>ed <str<strong>on</strong>g>in</str<strong>on</strong>g> the policy. The CRP<br />

must also have an emergency fund, approved by the<br />

Board of Directors, to address the grievances of the<br />

affected people.


The SPF and CRP procedures, as well as the<br />

language used, are too technical. Most projectaffected<br />

people are <str<strong>on</strong>g>in</str<strong>on</strong>g>capable of understand<str<strong>on</strong>g>in</str<strong>on</strong>g>g those<br />

technical terms to file their cases to the AM. There<br />

is a need to simplify the technicalities of the CRP<br />

language and procedures.<br />

After the <str<strong>on</strong>g>in</str<strong>on</strong>g>specti<strong>on</strong>, the CRP sends the<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>specti<strong>on</strong> report to the Board management and<br />

submits its resp<strong>on</strong>se. Like the Japan Bank for<br />

Internati<strong>on</strong>al Cooperati<strong>on</strong> that sends its Exam<str<strong>on</strong>g>in</str<strong>on</strong>g>er<br />

report to all the parties c<strong>on</strong>cerned, CRP report must<br />

be shared with the Requester and pay attenti<strong>on</strong> to<br />

op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong>s provided, and may send the op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong>s to<br />

the management. M<str<strong>on</strong>g>in</str<strong>on</strong>g>utes of Board discussi<strong>on</strong>s and<br />

deliberati<strong>on</strong>s about the report should be open to the<br />

public.<br />

Both SPF and CRP, should proceed with claims,<br />

regardless of the cases filed under local legislati<strong>on</strong>s.<br />

In the case of STDP, the <strong>ADB</strong> used the argument<br />

that there is a case pend<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> the Supreme Court<br />

which delayed the process.<br />

AM should be highly <str<strong>on</strong>g>in</str<strong>on</strong>g>dependent from <strong>ADB</strong><br />

management. It is not acceptable for the SPF nor<br />

CRP to hire former Banks staff to the positi<strong>on</strong>s.<br />

There has been pa<str<strong>on</strong>g>in</str<strong>on</strong>g>ful experience for the claimants<br />

when certa<str<strong>on</strong>g>in</str<strong>on</strong>g> SPF and CRP staff acted bias towards<br />

the <strong>ADB</strong>.<br />

Corrupti<strong>on</strong><br />

The AM excludes the corrupti<strong>on</strong> issue <str<strong>on</strong>g>in</str<strong>on</strong>g> its<br />

ambit. Although the office of the Anti-Corrupti<strong>on</strong><br />

and Integrity deals with allegati<strong>on</strong>s of fraud and<br />

corrupti<strong>on</strong> it fails to combat corrupt practices <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

project management at the local and nati<strong>on</strong>al levels.<br />

The present review must look at paragraph 72 <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

policy.<br />

We are str<strong>on</strong>gly request<str<strong>on</strong>g>in</str<strong>on</strong>g>g the Jo<str<strong>on</strong>g>in</str<strong>on</strong>g>t Work<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

Group of the AM Review to c<strong>on</strong>sider the issues<br />

<strong>on</strong> the exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g AM for its review. We emphasize<br />

that the review must attempt fill <str<strong>on</strong>g>in</str<strong>on</strong>g> pr<str<strong>on</strong>g>in</str<strong>on</strong>g>ciple gaps<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> the exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g policy and to make Accountability<br />

Mechanism more accountable and resp<strong>on</strong>sible to<br />

project-affected people.<br />
