Notwithstanding clause 6, but subject always to clause 1.2, <strong>of</strong> the club's P&I war risks clause 2012, cover also includes<br />

liability for bio-chemical risks in accordance with the terms <strong>of</strong> the club's bio-chemical risks inclusion clause 2012.<br />

A portion <strong>of</strong> this cover for certain ships is provided pursuant to the requirements <strong>of</strong> the Terrorism Risk Insurance Program<br />

Reauthorization Act 2007. Notice <strong>of</strong> the availability and details <strong>of</strong> this cover was included as part <strong>of</strong> the initial coverage<br />

cost quotation provided by the club. The portion <strong>of</strong> club coverage costs attributable to the cover made available for<br />

relevant ships is US$0.0025 per entered ton.<br />

RISKS EXCLUDED<br />

In addition to any exclusions set out in the rules, the following risks are specifically excluded:<br />

Collision liability claims arising under rule 3.6 to the extent that they are covered under the member’s hull insurance.<br />

Claims for damage to property which would otherwise be covered under rule 3.9 to the extent that they are covered<br />

under the hull policy <strong>of</strong> the ship.<br />

WARRANTIES/RESTRICTIONS<br />

TRADING WARRANTY<br />

The member warrants that the ship trades only between European ports and all places in the Mediterranean, Black Sea<br />

and Caspian Sea, within the following limits: -<br />

North by 66th degree Latitude N, excluding Greenland, but including coastal voyages to and from Kirkenes and<br />

Murmansk.South by 15th degree Latitude N, i.e. not South <strong>of</strong> Dakar.West by 15th degree Longitude W, including<br />

voyages to Madeira, Iceland, Canary Islands and coastal voyages to Dakar.East by 45th degree Longitude E, extended<br />

to include voyages to and including all ports within the Aral Sea and Caspian Sea. Excluding Suez Canal, Red Sea and<br />

Persian Gulf.<br />

In the event <strong>of</strong> any breach <strong>of</strong> this warranty the club shall not be liable for any loss, damage or liabilities arising out <strong>of</strong> or<br />

resulting from an incident during the period <strong>of</strong> that breach.<br />

DEDUCTIBLES<br />

The member is to bear the following deductibles:<br />

EUR 3,000, any one event, in respect <strong>of</strong> crew claims arising under rule 3.1;<br />

EUR 5,000, each single voyage, in respect <strong>of</strong> cargo claims arising under rules 3.13 and 3.14;<br />

EUR 2,500, any one event, in respect <strong>of</strong> all other claims.<br />

The club’s liability is limited in accordance with the rules unless limited to a lesser amount in this certificate <strong>of</strong> entry. Such<br />

limit(s) shall apply in the aggregate in respect <strong>of</strong> the member and any other person entitled to claim under the rules, any<br />

one event, including legal and survey fees and expenses.<br />

COMPLAINTS<br />

The managers are committed to providing the highest standard <strong>of</strong> service to members. If a member has any complaint it<br />

is important that it should be resolved to the member’s satisfaction so far as possible, in an expeditious manner.<br />

In the first instance a member should address any complaint to the person with whom they normally deal within the<br />

managers' organisation. However, if this fails to resolve the matter the complaint may be referred to the club’s<br />

Compliance Officer, who can be contacted as follows:<br />

Some members <strong>of</strong> the club are potentially "eligible complainants" under the UK Financial Ombudsman Service. This<br />

service exists to mediate between insureds and an insurer in the event <strong>of</strong> an unresolved conflict. While the service is<br />

primarily aimed at retail customers, its remit does extend to small businesses where the turnover does not exceed Euro<br />

2m per annum. Further guidance on a member's eligibility for the scheme can be obtained from the managers.<br />

CANCELLING RETURNS<br />

The club will not allow any refund <strong>of</strong> calls paid in respect <strong>of</strong> this entry except in the event that the ship is lost, sold, or is<br />

withdrawn in accordance with the rules, in which case a pro-rata refund may be allowed.<br />

Payment <strong>of</strong> any recovery from the club in respect <strong>of</strong> any liabilities incurred to which the member is entitled may, at the<br />

option <strong>of</strong> the club, be made to Windsor Partners Limited and any such payment shall constitute a full and complete<br />

discharge <strong>of</strong> the club's liabilities in respect there<strong>of</strong>.<br />

LOSS PAYABLE<br />

Payment <strong>of</strong> any recovery the member is entitled to make out <strong>of</strong> the funds <strong>of</strong> the club in respect <strong>of</strong> any liabilities incurred<br />

by him shall be made to the member or his order unless and until the club receives notice from Commerzbank AG,<br />

Königstr. 15-19, 47051 Duisburg, Germany to the contrary, in which event all recoveries shall thereafter be paid to<br />

Commerzbank AG, or their order, provided always that no liability whatsoever shall attach to the club, its managers or<br />

their agents for failure to comply with the latter obligation until after the expiry <strong>of</strong> two clear business days from the receipt<br />

<strong>of</strong> such notice.<br />

The club undertakes:-<br />

(a) to inform the mortgagees if the managers give the member for the above ship notice under rule 16.4(2) that his<br />

insurance in the club in respect <strong>of</strong> such ship is to cease at the end <strong>of</strong> the then current policy year;<br />

(b) to give the mortgagees 14 days’ notice <strong>of</strong> the club's intention to cancel the insurance <strong>of</strong> the member by reason <strong>of</strong> his<br />

failure to pay when due and demanded any sum due from him to the club.<br />

EVIDENCE OF INSURANCE<br />

This certificate <strong>of</strong> entry is evidence only <strong>of</strong> the contract <strong>of</strong> indemnity insurance between the above-named member and<br />

the club and shall not be construed as evidence <strong>of</strong> any undertaking on the part <strong>of</strong> the club to any other party.<br />

In the event that the member tenders this certificate as evidence <strong>of</strong> insurance under any applicable law relating to<br />

financial responsibility, or otherwise shows or <strong>of</strong>fers it to any other party as evidence <strong>of</strong> insurance, this is not to be taken<br />

as any indication that the club thereby consents to act as guarantor or to be sued directly in any jurisdiction whatsoever.<br />

The club does not so consent.<br />
