This matter having come before the Court upon the petitions to quash (Doc. Nos. 1, 5)
filed by Petitioners Frank Gangi, Ferrous Miner Holdings, Ltd. (“Ferrous Miner”), BABP VI
LLC, and Global Naps Inc., upon the Government’s motion to enforce (Doc. No. 4), and upon
the August 25, 2010 Report and Recommendation filed by Magistrate Judge Douglas E. Arpert
(Doc. No. 12); and this Court having considered the parties’ submissions and decided the matter
without oral argument pursuant to Federal Rule of Civil Procedure 78; and for the reasons stated
in the accompanying Memorandum Opinion;
IT IS THIS 7th day of January, 2011,
ORDERED that the August 25, 2010 Report and Recommendation (Doc. No. 12) is
ADOPTED WITH MODIFICATIONS; and it is further
ORDERED that the Government’s motion to enforce (Doc. No. 4) is GRANTED IN
PART, such that the CitiBank and Sovereign Bank summonses may be enforced as against
Petitioner Gangi; and it is further
ORDERED that the petitions to quash (Doc. Nos. 1, 5) are GRANTED IN PART, such
