Data Protection Act 1998 – Fair Processing Notice<br />

<strong>The</strong> purpose of this Fair Processing Notice is to inform you of the use that will be made of your<br />

personal data, as required by the Data Protection Act 1998.<br />

Fera is the data controller in respect of any personal data that you provide when you complete National<br />

List <strong>and</strong> Plant Breeders’ Rights Application Forms, Technical Questionnaires, Authorisation of Agent<br />

<strong>and</strong> Assignment of Rights forms.<br />

Fera will use your personal data primarily for the purposes of producing the Public Record of National<br />

Lists <strong>and</strong> Grants of Plant Breeder’s Rights in accordance with <strong>The</strong> Seeds (National Lists of Varieties)<br />

Regulations 2001 (as amended) <strong>and</strong> the Plant Breeders’ Rights Regulations 1998. Your personal data<br />

will be disclosed to the Devolved Authorities, NIAB <strong>and</strong> the British Society of Plant Breeders for the<br />

administration of DUS tests <strong>and</strong> VCU trials.<br />

Fera may also use your personal information where appropriate for purposes, including the production<br />

of the Common Catalogues of Agricultural <strong>and</strong> Vegetable Plant Species <strong>and</strong> the OECD List of<br />

Agricultural Plant Species Eligible for Seed Certification. Data may be passed to other bodies where<br />

necessary for any of the above-mentioned purposes. <strong>The</strong> data collected may also be used to provide<br />

publicly available statistics that will not identify individuals.<br />

Fera may be required to release information, including personal data <strong>and</strong> commercial information, on<br />

request under the <strong>Environment</strong>al Information Regulations 2004 or the Freedom of Information Act<br />

2000. However, Fera will not permit any unwarranted breach of confidentiality nor will we act in<br />

contravention of our obligations under the Data Protection Act 1998.<br />

Fera or its appointed agents may use the name, address <strong>and</strong> other details on your application form to<br />

contact you in connection with occasional customer research aimed at improving the services that Fera<br />

provides to you.<br />

Defra’s Information Charter - Public Service Guarantee on Data H<strong>and</strong>ling, which gives details of your<br />

rights in respect of the h<strong>and</strong>ling of your personal data, is on the Defra website at<br />

Customers considering applying for National Listing (NL) or Plant Breeders’ Rights (PBR) of plant<br />

species which contain Genetically Modified Organisms (GMOs) should contact Fera Varieties <strong>and</strong><br />

Seeds at the earliest opportunity for advice <strong>and</strong> certainly in advance of submitting the application.<br />

requirement from six plants to eight<br />

Requesting Authorities must forward their paperwork to the test centre within 10 working<br />

days of the final deadline for applications, to allow time for planning the trial.<br />

<strong>The</strong> deadlines apply to vegetatively propagated varieties except where specifically indicated,<br />

<strong>and</strong> assume all material to be container grown.<br />

* Different dates will apply to varieties flowering over winter or in very early spring. Please<br />

ask for further information.<br />

No plant material should be sent until specifically requested. Submission periods may be<br />

varied slightly from year to year to take account of National Holidays etc., <strong>and</strong> applicants<br />

Plant breeders who are intending to make applications <strong>and</strong>/or submit seed for Plant Breeders’<br />

Rights <strong>and</strong>/or National List tests <strong>and</strong> trials in the 2011 season in respect of the following species are<br />

asked to arrange for these to be sent to the address below so as to arrive no later than the dates<br />

given. Please note that if the closing date falls at a weekend or on a Bank Holiday,<br />

applications/seed must be received by the next working day. Applications <strong>and</strong>/or seed/plant<br />

material received after these dates cannot be considered for tests <strong>and</strong> trials in the 2011 season.<br />

BSPB will request seed for VCU trials. Wheat, barley, oats <strong>and</strong> field bean seed for DUS plots will<br />

Written representations <strong>and</strong>/or requests to be heard by the Controller or by a person appointed by<br />

him for that purpose may be made regarding proposals made in Section IV & VI above. Only written<br />

representations may be made regarding applications under Section I.<br />

For Sections I & IV, representations may be made by the applicant, any person who has a<br />

substantial interest in an application which is the subject of one of these proposals or who is in a<br />

position to provide evidence which is likely to be material to its consideration. For proposals under<br />

Section VI, representations may be made by the holder of rights, any person who is the holder of a<br />

licence to exercise any Plant Breeders’ Rights in the plant varieties in question <strong>and</strong> any persons<br />

whose financial interests are likely to be affected by the decision.<br />

<strong>The</strong> representations <strong>and</strong>/or requests to be heard must be sent to the Controller by 18 January 2011.<br />

Written representations should be accompanied by a fee of £30.00 (Cheques should be made<br />

payable to Fera). If a hearing is granted then a fee of £65.00 is payable before it is held.<br />

Any representations received will be circulated by the Controller to all interested parties <strong>and</strong> a period<br />

of 21 days allowed for subsequent representations to be made. <strong>The</strong> Controller shall then be entitled<br />

to make a decision after he has received any further representations but may, if he considers it<br />

desirable, allow further representations.<br />

If a hearing is to be held then at least 14 days notice will be given to all parties. Any supporting<br />

documents relating to the hearing must be made available to the Controller at least 7 days before<br />

the hearing.<br />
