4. Bid amount<br />

(a) At the fall of hammer the highest bidder will be required to deposit in cash bid amount @ 25% of his<br />

bid money. Balance of the sale value shall be paid by the buyer to the Executive Engineer or his<br />

accredited representative after the acceptance of the bid within the time limits mentioned below:<br />

(i) In case bids which do not exceed Rs. 10000/-, within 24 hours of the receipt of notice of the<br />

acceptance of the bid.<br />

(ii) In case of bids which exceed Rs.10000/-, within three days of receipt of notice of the acceptance<br />

of the bid.<br />

(b) The supervising Officer shall have the discretion to demand more than 25% of the bid money upto<br />

full amount of the bid, if considered necessary by him.<br />

(c) In case of bidder’s failure to deposit the full bid money in time, the earnest money deposited by the<br />

bidder shall stand forfeited, the materials shall be re-auctioned. The name of defaulting bidders<br />

shall be intimated to Chief Engineer’s office for circulation to other Divisions, so that such bidders<br />

are debarred from bidding in future.<br />

5. Acceptance of bid<br />

(a) The acceptance of the bid by the competent authority must be conveyed in writing (Registered<br />

AD) to the bidder as far as possible within five days from the date of auction. In case, the bid is to<br />

be accepted by Superintending Engineer, it shall be conveyed within ten days.<br />

(b) It is not incumbent on officers of CPWD to out-right accept the highest bid, which can be rejected<br />

without assigning any reason to the bidder concerned, but he must record in writing his reasons<br />

for not accepting the same.<br />

6. Removal of auctioned materials<br />

(a) As far as possible, auctioned materials must be removed by the bidder within 3 days from the date<br />

of acceptance of bid. However, the materials will be allowed to be removed only after payment of<br />

bid money, which will be accepted in cash or amount deposited by the bidder in branch of RBI/SBI<br />

and challan made over to CPWD. No cheques will be accepted under any circumstance.<br />

(b) As soon as the full amount of the bid money is made good by the prospective buyer, he would<br />

acquire his lien on the auctioned stores etc. and it will be his duty/responsibility to any damage<br />

done by way of pilferage, fire, or any other unforeseen calamity, and no claim on this account shall<br />

be entertained.<br />

(c) The bidder will leave storage place of the material quite clean.<br />

(d) The materials will be removed from site in presence of the bidder himself or agent duly authorised<br />

by him in writing in this behalf.<br />

(e) If the bidder does not vacate the site within three days, EE may confiscate the balance materials<br />

lying at the site. (such Provisions may be kept in Auction Documents)<br />

7. Records of bids<br />

(a) The officer who supervised the conduct of auction, will maintain in his own handwriting, a complete<br />

record of all the bids offered by different bidders.<br />

(b) The scroll of bids will indicate the full description of the materials, reserve price, site, date and time<br />

of auction and will be signed by the Supervising Officer and at least two witnesses at the conclusion<br />

of the auction.<br />

(c) The bid sheet in triplicate should be signed simultaneously by the purchaser and the Supervising<br />

Officer.<br />

(d) The Supervising Officer should send an immediate report about the auction to the next higher<br />

authority.<br />

8. Power to accept the bid<br />

Bids should be accepted by the Executive Engineer concerned. In case of bids below the reserve<br />

price, the bids will be accepted by the next higher authority.<br />
