(8) Before a dispute is put to arbitration, the <strong>Department</strong> should know its exact position with regard to<br />

each item of the claims under dispute. It is very necessary that a very close and thorough study<br />

of the relevant documents is made and the case prepared accordingly.<br />

(9) The Executive Engineer should send a quarterly statement (ending March, June, September and<br />

December) of pending arbitration cases in the proforma Annexure IV on 7th April, 7th July, 7th<br />

October and 7th January every year to the Superintending Engineer, who should send a similar<br />

statement for the entire circle to the concerned Chief Engineer on 15th April, 15th July, 15th<br />

October and 15th January every year. These reports should be reviewed by the Chief Engineer<br />

during periodical meetings with his Superintending Engineers/Executive Engineers to expedite<br />

the finalization of arbitration cases.<br />

(10) All correspondence between the Executive Engineer and his Superintending Engineer/Chief<br />

Engineer regarding appointment of Arbitrator, or on award, and subsequent court cases, if any,<br />

should be through D.O. letters, and should be sent through special messenger in the same station.<br />

35.23 Jurisdiction of Courts<br />

The Court of the place from where the letter of award of work has been issued shall have the jurisdiction<br />

to decide any dispute arising out of or in respect of the contract.<br />
