the default has been committed, with a note that necessary deductions from the contractor’s bill be<br />

made and the wages and other dues be paid to the labourers under clause 13 of these regulations.<br />

Actual payment to labourers will be made by the Executive Engineer after the Superintending<br />

Engineer has given his decision on such appeal.<br />

(2) The Executive Engineer shall arrange payments to the labour concerned within 45 days from the<br />

receipt of the report from the Labour Officer or the Superintending Engineer, as the case may be.<br />

(3) The contractors in the CPWD are required to pay to the labour employed by them, either directly or<br />

through sub-contractors, fair wage as defined in the Contractors’ Labour (Regulation and Abolition)<br />

Act, 1970 and the rules made thereunder.<br />

(4) No deduction on account of Jamadar’s commission charges etc. is to be deducted from the wages<br />

of labourers. In no case the liability of the commission charges shall fall on the workers.<br />

34.7 Procedure in case of accidents to contract labour<br />

(1) In case of fatal accidents or accidents involving permanent total disability, the accident must<br />

invariably be reported to the Chief Engineer, with a copy, among others, to the Superintending<br />

Engineer and Labour Officer concerned immediately after the accident.<br />

(2) A meeting of the Executive Engineer and the Labour Officer, and the Medical Officer (for Delhi<br />

only), should be held within 24 hours of the accident for enquiry and report.<br />

(3) Thereafter the Labour Officer (Executive Engineer concerned for Delhi) should make personal<br />

investigation into the matter and submit a brief report to the Chief Engineer, with a copy to the<br />

Superintending Engineer concerned. The disposal of accident cases should be given priority at all<br />

levels.
