(ii) In case where T&P is issued without stipulation in the agreement<br />

Full hire charges, i.e. Direct charges and Indirect charges, both shall be recovered.<br />

(iii) In case T&P is issued to other departments and private bodies, when articles are lent to them<br />

for use on works under their supervision<br />

All the charges mentioned under para 28.2, excepting supervision charges, shall be recovered.<br />

(2) Different rates for hire charges as determined above are applicable for use on CPWD works,<br />

either done departmentally or through contract where supply of T & P is stipulated in the agreement<br />

for issue to the contractor. If the T & P is issued to private individuals, non-government bodies or<br />

even to departmental contractors where there is no stipulation for issue in the agreement, full<br />

economic rates are chargeable.<br />

(3) In this connection, the following conditions are required to be observed:<br />

(i) The hire charges shall be recovered at the prescribed rates from and inclusive of the date the<br />

plant and/or machine is made over, and up to and inclusive of the date of its return in good<br />

order, even though the same may not have been working for any cause except for major<br />

breakdown due to no fault of the contractor, or faulty use by the departmental operator, and<br />

requiring more than 3 continuous working days (i.e. excluding intervening holidays and Sundays)<br />

for bringing the plant in order.<br />

(ii) The contractor shall immediately intimate in writing to the Engineer-in-charge when any plant<br />

or machinery gets out of order requiring major repairs as aforesaid. The Engineer-in-charge<br />

shall record the date and time of receipt of such intimation in the log sheet of the plant or<br />

machinery. Based on this, if the breakdown occurs before lunch, the period of major breakdown<br />

will be computed by considering half a day’s breakdown on the day of complaint. If the<br />

breakdown occurs in the post-lunch period, the period of major breakdown will be computed<br />

starting from the next working day. In case of any dispute, the decision of the Superintending<br />

Engineer shall be final.<br />

(iii) The hire charges will include services of operational staff, viz. Driver/Operator, and maintenance<br />

staff such as Mechanic and Cleaner as required. The hire charges shall also include lubricating<br />

oil, stores for normal repairs and for cleaning purposes. All the other charges such as cost of<br />

power, fuel, fire matches, diesel oil, petrol, kerosene oil, etc. for running the machinery, and<br />

water for working and washing of steam roller, and pay of Chowkidar for guarding the T & P at<br />

night shall, however, be borne by the contractor/indentor.<br />
