(2) The authority competent to accept the tender will be the authority to order provisional closure of<br />

the original contract and drawing up of the supplementary agreement.<br />

(3) The bill in relation to the work already done by the contractor against the first or original agreement<br />

should be provisionally finalized on the Final Bill Form (Yellow Paper) by adding the words<br />

“Provisional Final” on the top as well as against the entry “Serial number of this bill” of the said Bill<br />

Form. As per condition 2 (f) of the Supplementary Agreement, the final bill relating to the entire<br />

work under the two agreements, i.e. original and supplementary agreements, shall be prepared<br />

after completion of the entire work on the Final Bill Form (Yellow Paper).<br />

23.7 Completion of Agreements<br />

Adequate care should be taken to complete the agreement to be entered into between the contractor<br />

and the Executive Engineer for and on behalf of the President of India.<br />

(1) Constituents of an agreement<br />

(a) A complete agreement would consist of:<br />

(i) CPWD Form no. 6, i.e. notice inviting tenders (which is invariably issued by the Divisional<br />

Officer irrespective of the fact whether he is competent to accept the tender or not),<br />

(ii) Pamphlet CPWD Form 7 or 8 or any other form used for the contract,<br />

(iii) Schedule of Quantities which indicates items of work, quantity, rates, unit, amount,<br />

(iv) Letter of the contractor submitting the tender,<br />

(v) Other letters of the contractor and the departmental officers that were exchanged before<br />

the tender is accepted,<br />

(vi) Letter of the Executive Engineer communicating acceptance of the tender, and<br />

(vii) Letter of the Executive Engineer regarding commencement of the work (after submission<br />

of the performance security/guarantee by the contractor).<br />

(b) CPWD Safety Code, Model Rules for protection of health and sanitary arrangements for workers<br />

employed by the CPWD or its contractors, <strong>Central</strong> PWD Contractors’ Labour Regulations,<br />

Fair Wages clauses etc. should form part of the agreement.<br />

(2) Signing of all correction slips by the contractor Instances have come to notice where there are a<br />

number of correction slips which are required to be inserted at the time of drawing the agreement,<br />

in some cases the contractors fail to sign one or more correction slips resulting in dispute and<br />

disregarding claims of the <strong>Department</strong>. As such, special care is required to be taken to see that all<br />

corrections, additions, alterations, or slips attached to the agreements are duly signed both by the<br />

contractor and the Executive Engineer.<br />
