are required in the case of tenders to be sent to the <strong>Central</strong> <strong>Works</strong> Board. Director General<br />

(<strong>Works</strong>), or the Additional Director General, as the case may be, for their/his approval, the Chief<br />

Engineer shall negotiate with the lowest tenderer before sending the tenders to them.<br />

20.4.8 Rejection of Tenders<br />

No tenders which are required to be accepted with the approval of the <strong>Central</strong> <strong>Works</strong> Board/Director<br />

General (<strong>Works</strong>)/Additional Director General should be rejected by any lower authority, and all such<br />

tenders should be submitted to the Board/Director General (<strong>Works</strong>)/Additional Director General for<br />

consideration. It will be for the Board/Director General (<strong>Works</strong>)/Additional Director General to reject them<br />

or to approve them or to authorize further negotiations.<br />

20.4.9 Communication of acceptance/rejection of tenders<br />

(1) After the tender for the work has been accepted, the same shall be communicated to the contractor<br />

in a sample form shown in Annexure-I. Para 21.1 may be seen for submission of the performance<br />

security/guarantee by the contractor.<br />

(2) After submission of the performance security/guarantee by the contractor in an acceptable form,<br />

an intimation to commence the work shall be given in a sample form shown in Annexure-II<br />

(3) Copies of these letters should also be endorsed to the following in addition to the concerned<br />

departmental officers and the concerned branches:<br />

(i) Assistant Labour Commissioner (<strong>Central</strong>).<br />

(ii) Conciliation Officer (<strong>Central</strong>).<br />

(iii) Income-tax Officer (Concerned).<br />

(iv) Labour Officer.<br />

(4) In special case where the work is required to be completed in a short time, and it is not desirable<br />

to allow 10 days’ period for commencement of work, the <strong>Central</strong> PWD Officers may reduce this<br />

period and make the necessary change in the contract form and the letter of acceptance of tender.<br />

(5) In the acceptance letter, the officer accepting the tender should give a reference to all the<br />

contractor’s letters received with the tender or thereafter, and/or incorporate the fact of acceptance<br />

or rejection of the condition(s) mentioned in these letters of the contractor.<br />

(6) The tenderers whose tenders are rejected should be sent written intimation about the rejection.<br />

20.4.10 Issue of letter of award while EE is on tour or on leave.<br />

Following instructions may be followed in case tender is approved/accepted by the higher authority and<br />

award letter is to be issued by EE and where expiry of validity of tender is very near and EE being on tour.<br />

(a) Whenever tender papers are sent to EE, the envelope containing tender papers must be marked<br />

‘Tender papers’.<br />

(b) Copy of letter of approval/acceptance of tender be sent separately to the E.E. through Fax/email.<br />

(c) Whenever E.E. is on tour or on casual leave, award letter, after the tender has been accepted by<br />

the competent authority, can be issued by the A.E. (P) clearly indicating that this letter when<br />

countersigned by E.E. will form part of the agreement.<br />

20.5 Re-invitation of tenders<br />

If the lowest tenderer backs out, there should be re-tendering in a transparent and fair manner. In such<br />

a situation, the NIT approving authority may advise call for limited or short notice tender if so justified in the<br />

interest of work and take decision on the basis of lowest tender. While retendering for the work, tender will<br />

not be issued to the contractor who has backed out.<br />

20.6 <strong>Central</strong> <strong>Works</strong> Board<br />

As laid down in the CPWD Code, the Government of India have constituted a <strong>Central</strong> <strong>Works</strong> Board<br />

which acts as the body in the matter of acceptance of contracts and other miscellaneous matters relating<br />

to execution of works.<br />
