The Prison and Probation Service is responsible for the<br />
country’s 31 remand institutions. On 1 October 2011,<br />
approximately 1,800 persons were remanded in custody.<br />
what is the difference between apprehension,<br />
arrest and remand?<br />
Apprehension is an immediate decision taken by an individual police<br />
officer. A person is apprehended until the police make contact with<br />
the public prosecutor, which must occur within nine hours, or until<br />
the police themselves decide to release the suspect.<br />
Arrest is decided on by the prosecutor and lasts for a maximum of<br />
four days.<br />
Remand is decided on by the court. The remand order must be<br />
reconsidered every fourteen days and cannot exceed the possible<br />
length of the sanction, i.e. the prison sentence.<br />
when can a person be remanded?<br />
Remand is decided on by the court at the request of the prosecutor.<br />
There must be grounds to suspect that the person concerned is guilty<br />
of an offence that could lead to at least one year’s imprisonment.<br />
Also, at least one of the following three conditions must be fulfilled:<br />
risk of absconding, risk of an investigation being impeded and/or risk<br />
of continued criminal activity.<br />
A remand order will be given regardless of the nature of the offence<br />
if the suspect is unknown and refuses to provide a name and address<br />
or is not a resident of Sweden. Alternatives to remand are supervision,<br />
a travel ban and a reporting order.<br />
There is no legislation limiting time on remand. If charges are not<br />
brought within two weeks, a new remand hearing shall be held.<br />
