epresentative who will be compensated by the Union. The State will have an equal number of<br />

representatives on the committee.<br />

B. The committee will continue to conduct a study and present recommendations and alternatives<br />

within the term of the MOU.<br />

C. The State shall provide administrative support to the committee.<br />

D. Any recommendations resulting from this study are subject to approval by both parties.<br />

Side Letter 10.4 Dispatcher Clerks, CDF<br />

The DPA and Forestry and Fire Protection (CDF) will meet with the Union within forty-five (45) days of<br />

ratification of this agreement to discuss the Union’s proposal for changes to the Dispatcher Clerk<br />

Classification.<br />

The Union shall receive periodic written status reports regarding the department’s proposed action. Any<br />

proposed changes to the classification with be done in accordance with section 14.1, Classification<br />

Changes.<br />

Side Letter 11.4 - Auditor and/or Accountant Upward Mobility Program<br />

The State agrees to an upward mobility training program for Unit 4 employees who are currently<br />

employed by the EDD, BOE or FTB. In accordance with article 13.11.4, this program is to provide<br />

preference for upward mobility into the auditing or accountant classifications which has been identified<br />

and approved in the employee’s annual Individual Development Plan. This section is subject to<br />

available training resources.<br />

Side Letter 12.4 – Department of Motor Vehicles (DMV) – Motor Vehicle Field Representative PI<br />

Permanent Intermittent employees in Motor Vehicle Field Representative (MVFR) classification, in the<br />

DMV, shall be provided the opportunity to change time base as follows:<br />

A. When DMV decides to fill a vacant full-time permanent position, fifty percent (50%) of the available<br />

positions are subject to this procedure, and will be advertised in the same manner as other post<br />

and bid announcements utilizing the Opportunity Bulletin.<br />

B. DMV shall after permitting intradepartmental transfers within the class and prior to appointing an<br />

employee from an eligible list, select from the most senior PI employee, within the department and<br />

the class, with the highest State Service seniority who meets the eligibility criteria for a time base<br />

change as defined by SPB rule 277.<br />

1. The employee must:<br />

a. have passed probation in the MVFR class;<br />

b. have not received an Adverse Action in the past twelve (12) months;<br />

c. have an overall rating of satisfactory in their most recent performance appraisal;<br />

d. have no negative documentation in their official personnel file in the past twelve (12)<br />

months;<br />

e. apply for the vacant position<br />

C. The appointment shall be made within a departmentally defined geographic/organizational area:<br />

DMV may combine geographic/organizational areas.<br />

D. Seniority shall be defined as one point for each month of qualifying State Service as used for the<br />

purpose of determining leave (e.g. vacation) accrual.<br />

E. An employee who applies for and is selected for a time base change pursuant to this section, and<br />

refuses the appointment shall be removed from future consideration under this section. An<br />

employee may remove their name from the list of most senior employees prior to interview.<br />

Employees applying and selected under this section waive any rights to claim moving and<br />

relocation expenses. This does not preclude payment of such expenses, at management’s<br />

discretion.<br />

F. Dispute Resolution:<br />

Employees who dispute the appropriateness of the bid award for the posted position may file a<br />

written protest pursuant to section 20.2.4.<br />

G. Each appointing authority shall maintain sufficient data to track and verify compliance with the<br />

provision. Such information shall be maintained by the appointing power for three (3) years and<br />

shall be made available to the Union upon request.<br />
