7. Denial of Restoration of Certain Employees<br />

If the school district determines that a denial of restoration to a position is necessary to<br />

prevent substantial and grievous economic injury to the school district's operations, the<br />

school district may deny restoration to an employee who is among the highest paid 10<br />

percent of the school district's employees after first notifying the employee of the basis for<br />

the intended denial. The employee may avoid the denial of restoration by returning to work<br />

not later than the day on which the school district has determined that the injury would<br />

occur.<br />

8. Returning to Work<br />

Employees on family or medical leave must report every fourth workweek to their<br />

administrative supervisor either telephonically or in person. If the employee is on medical<br />

leave for a serious medical condition of the employee, which makes the employee incapable<br />

of personally making the report, the report may be made by the employee's health care<br />

provider or another person designated by the employee. Such report shall be on the status<br />

and intention of the employee to return to work. If an employee claims to be unable to<br />

return to work because of the continuation, recurrence, or onset of a serious health<br />

condition for which the employee would be eligible for medical leave, the employee shall<br />

submit to the Human Resources Department an appropriate certification issued by a health<br />

care provider. Employees who do not return to work at the expiration of family or medical<br />

leave and who have not been approved for another leave of absence shall be considered to<br />

have abandoned their employment. At the discretion of the school district, employees<br />

returning from family or medical leave shall be restored the position held prior to leave or<br />

to an equivalent position.<br />

9. Maintenance of Health Benefits<br />

If employees on leaves of absence under this policy desire to maintain their insurance<br />

coverage under the district's group health plan, the employees shall deliver their semimonthly<br />

portions of the insurance premium to the district's employee benefits department<br />

not later than five workdays prior to each district payday. For leaves of absence under this<br />

policy only, the school district shall supplement the employee's portions of the premiums<br />

with any contributions it normally would make toward the employee's group health<br />

insurance premiums. The school district will recover from employees, its contributions if<br />

employees fail to return to work for reasons other than the continuation, recurrence, or onset<br />

of a serious health condition that would entitle the employees to leave under this policy or<br />

for other circumstances beyond the employee's control.<br />

P. DONATION OF SICK LEAVE<br />

It is the desire of <strong>Aldine</strong> <strong>Independent</strong> <strong>School</strong> <strong>District</strong> to provide the opportunity for its employees to<br />

donate annually one of their locally earned sick leave days to other employees who are experiencing<br />

serious, prolonged illnesses or injuries which cause them to be unable to perform their assigned<br />

duties for an extended period of time and who have exhausted their available sick leave benefits.<br />

Full-time and part-time employees who participate in the school district’s general sick leave program<br />

may either donate or receive sick leave days. An employee may donate only one day each school<br />

year. For purposes of this policy only and without regard to either the number of hours normally<br />

worked by the employee or the classification of the employee, a “day” shall mean that daily period<br />

of time normally worked by the employee. For purposes of this policy only, the school year shall be<br />

considered to be from July 1 through June 30. Donated days are not accumulated in reserve or<br />

carried forward from year to year. A donation cannot be withdrawn after it has been received.<br />

Employees may apply to receive donated days only for personal illnesses or injuries and may not use<br />

the days for any other purposes. Employees may begin to receive donations on the twenty-first day<br />

of approved absence from assigned duties following the exhaustion of their general sick leave<br />

benefits and their paid vacation days, if any. Employees may receive a maximum of thirty (30)<br />

donated sick leave days in a school year. Employees may not receive donated days in advance of<br />

absences and may not hold a surplus of donated days. Once eligible to receive donations, an<br />

employee may apply for donations for subsequent illnesses or injuries occurring during the school<br />
