perform the functions of the employee's position. For a request to take leave in order to<br />

care for the employee's spouse, son, daughter, or parent, the certificate also shall state<br />

whether the employee is needed to care for the employee's spouse, son, daughter, or<br />

parent.<br />

For any request to take leave intermittently or on a reduced schedule for planned medical<br />

treatment, the certificate also shall state the dates on which planned medical treatment is<br />

expected to be given and the duration of the treatment. For a request to take leave<br />

intermittently or on a reduced schedule for a personal health condition, the certificate also<br />

shall state the medical necessity for and the expected duration of the intermittent leave or<br />

leave on a reduced schedule. For a request to take leave intermittently or on a reduced<br />

schedule in order to care for the employee's spouse, son, daughter, or parent, the certificate<br />

also shall state whether the employee's intermittent leave or leave on a reduced schedule is<br />

necessary for the care of the employee's spouse, son, daughter, or parent who has a serious<br />

health condition, or will assist in their recovery, and the expected duration and schedule of<br />

the intermittent leave or reduced leave schedule.<br />

If the school district has reason to doubt the validity of any of the required information in<br />

the certification, the school district may require the employee to obtain the opinion of a<br />

second health care provider designated or approved by the school district. If the opinions<br />

of the health care providers conflict, the school district may require the employee to obtain<br />

a final and binding opinion of a third health care provider.<br />

5. Intermittent or Reduced Leave Schedule<br />

If medically necessary, an employee may take a medical leave of absence intermittently or<br />

on a reduced leave schedule due to the serious health condition of the employee or covered<br />

family member or the serious injury or illness of a covered service member. If the<br />

employee is not employed principally in an instructional capacity and the requested leave<br />

is foreseeable based on planned medical treatment, the employee may be required to<br />

transfer temporarily to an available alternative position for which the employee is<br />

qualified. An employee who is employed principally in an instructional capacity and<br />

whose requested leave is foreseeable based on planned medical treatment, may take leave<br />

for periods of a particular duration rather than intermittently or on a reduced leave<br />

schedule if the employee would be on leave for greater than 20 percent of the total number<br />

of working days in the period during which the leave would extend. Leave may not be<br />

taken intermittently or on a reduced leave schedule other than as authorized in this<br />

paragraph.<br />

6. Leaves Near End of Academic Semesters<br />

Classroom teachers and teachers' aides who desire to take family or medical leave more<br />

than five weeks prior to the end of an academic semester may be required to continue<br />

taking leave until the end of the semester if the leave is of at least three weeks duration and<br />

the return to employment would occur during the three-week period before the end of such<br />

semester. Classroom teachers and teachers' aides who desire to take family leave or<br />

medical leave for other than their own serious health condition less than five weeks prior<br />

to the end of an academic semester may be required to continue taking leave until the end<br />

of the semester if the leave is of at least two weeks duration and the return to employment<br />

would occur during the two week period before the end of such semester. Classroom<br />

teachers and teachers' aides who desire to take family leave or medical leave for other than<br />

their own serious health condition less than three weeks prior to the end of an academic<br />

semester may be required to continue taking leave until the end of the semester if the leave<br />

is of duration of at least five working days.<br />
