An employee who has been employed for at least 12 months and has worked at least 1,250
of absence for a total of twelve work weeks during any twelve-month period. Separate
periods of employment are counted unless there is a break that exceeds seven years.
A family leave of absence may be taken for the following reasons;
A family leave expires at the end of the twelve month period after the birth or placement.
A medical leave of absence may be taken for the following reasons:
a) in order to care for the employee's spouse, son, daughter, or parent if such spouse,
mental or physical disability.
A serious health condition is an illness, injury, impairment or mental condition that involves
either an overnight stay in a medical care facility, or continuing treatment by a health care
provider for a condition that either prevents the employee from performing the functions of
the employee’s job, or prevents the qualified family member from participating in school or
other daily activities. Subject to certain conditions, the continuing treatment requirement
may be met by a period of incapacity of more than three consecutive calendar days
combined with at least two visits to a health care provider or one visit and a regimen of
continuing treatment, or incapacity due to pregnancy, or incapacity due to a chronic
condition. Other conditions may meet the definition of continuing treatment.
A military exigency leave may be taken because of a qualifying exigency, as defined by
federal regulations, arising out of the fact that the spouse, or a son, daughter, or parent of
the employee is on active duty (or has been notified of an impending call or order to active
A service member family leave may be taken by an eligible employee. An eligible
