Part 5. Protection and management <strong>of</strong> <strong>the</strong> property<br />
Regulatory designations<br />
The <strong>Sydney</strong> <strong>Opera</strong> <strong>House</strong> and its site are protected <strong>by</strong><br />
being listed on statutory heritage registers at all levels <strong>of</strong><br />
government. These registers include specifi c provisions<br />
for managing <strong>the</strong> heritage values <strong>of</strong> <strong>the</strong> property:<br />

The <strong>Sydney</strong> <strong>Opera</strong> <strong>House</strong> was included in <strong>the</strong><br />
National Heritage List on 12 July 2005 under<br />
<strong>the</strong> Environment Protection and Biodiversity<br />
Conservation Act 1999 (<strong>Australia</strong>n Heritage<br />
Database Place ID 105738).<br />
The <strong>Sydney</strong> <strong>Opera</strong> <strong>House</strong> was inscribed on <strong>the</strong><br />
State Heritage Register <strong>of</strong> New South Wales on<br />
3 December 2003 under <strong>the</strong> Heritage Act 1977<br />
(Heritage Item No. 1685).<br />
A buffer zone is proposed to protect <strong>the</strong> setting<br />
<strong>of</strong> <strong>the</strong> <strong>Sydney</strong> <strong>Opera</strong> <strong>House</strong> that will be managed<br />
though <strong>the</strong> <strong>Sydney</strong> Regional Environmental Plan<br />
(<strong>Sydney</strong> Harbour Catchment) 2005 (‘Harbour<br />
REP’). This is discussed in Part 5.D.<br />
In line with best practice, extensive public consultation<br />
was undertaken for each heritage listing. The<br />
implementation <strong>of</strong> this regulatory framework is<br />
discussed in Part 5.C.<br />
O<strong>the</strong>r listings<br />
On 21 October 1980 <strong>the</strong> <strong>Sydney</strong> <strong>Opera</strong> <strong>House</strong><br />
was included in <strong>the</strong> Register <strong>of</strong> <strong>the</strong> National Estate<br />
which was established under <strong>the</strong> <strong>Australia</strong>n Heritage<br />
Commission Act 1975 and now maintained under<br />
<strong>the</strong> <strong>Australia</strong>n Heritage Council Act 2003 (<strong>Australia</strong>n<br />
Heritage Database Place ID 2353).<br />
The <strong>Sydney</strong> <strong>Opera</strong> <strong>House</strong> is included as a heritage<br />
item on <strong>the</strong> <strong>Sydney</strong> Local Environmental Plan 2005<br />
(CSI no. 1064, 2 East Circular Quay) enacted under <strong>the</strong><br />
Environmental Planning and Assessment Act 1979.<br />
The <strong>Sydney</strong> <strong>Opera</strong> <strong>House</strong> is listed on several o<strong>the</strong>r<br />
non-statutory heritage registers that indicate <strong>the</strong><br />
esteem in which it is held within and outside <strong>Australia</strong>:<br />

DOCOMOMO International Advisory Report to<br />
ICOMOS entitled The Modern Movement and<br />
<strong>the</strong> World Heritage List 1997 includes <strong>the</strong> <strong>Sydney</strong><br />
<strong>Opera</strong> <strong>House</strong> on <strong>the</strong> list <strong>of</strong> modern buildings and<br />
sites suggested for <strong>the</strong> World Heritage List.
