Actions to Encourage DSM and Energy Efficiency<br />

In <strong>2008</strong>, the Legislature amended Section 366.82, F.S., which directs the <strong>Commission</strong>’s<br />

process for establishing DSM and energy efficiency goals. More specifically, the <strong>Commission</strong> must<br />

now consider the impact <strong>of</strong> demand-side renewable energy systems as well as an expanded scope <strong>of</strong><br />

potential conservation and efficiency measures. Additional considerations include the need for<br />

incentives and the effect <strong>of</strong> emission compliance costs. These changes should further promote utility<br />

implementation <strong>of</strong> new DSM programs. The utilities have launched a technical potential study to start<br />

the goal-setting process.<br />

Utilities are scheduled to file their proposed goals around May 2009, and a hearing is<br />

currently scheduled for August 19-21, 2009. The <strong>Commission</strong> will re-establish demand and energy<br />

conservation goals for Florida’s largest utilities to become effective January 1, 2010. The impact <strong>of</strong><br />

the new goals should be reflected in the utilities’ 2010 <strong>Ten</strong>-<strong>Year</strong> <strong>Site</strong> <strong>Plans</strong>.<br />
