<strong>Placement</strong> <strong>Contract</strong> <strong>for</strong> <strong>an</strong> <strong>Erasmus</strong> <strong>student</strong> <strong>placement</strong><br />
Under the Lifelong Learning Programme<br />
Mid Sweden University, called hereafter "the institution", represented <strong>for</strong> the purposes of signature of<br />
this contract by the international Coordinator of the one part, <strong>an</strong>d the <strong>student</strong> called hereafter “the<br />
beneficiary” of the other part, have agreed the Conditions below <strong>an</strong>d the Annexes:<br />

• Annex II: <strong>Erasmus</strong> <strong>Placement</strong> - Quality Commitment<br />
• Annex III: General Conditions<br />
• Annex IV: Final report <strong>for</strong>m<br />
• Annex V: <strong>Erasmus</strong> Student Charter<br />
, which <strong>for</strong>m <strong>an</strong> integral part of this contract.<br />

Purpose of the gr<strong>an</strong>t<br />
The gr<strong>an</strong>t concerns a <strong>placement</strong> under the <strong>Erasmus</strong> programme of the Lifelong Learning Programme<br />
<strong>an</strong>d the activities are described in the Annex I. Any amendment or supplement to the contract shall be<br />
done in writing.<br />
Duration<br />
The contract shall enter into <strong>for</strong>ce on the date when the last of the two parties signs. The <strong>Placement</strong><br />
shall start on <strong>an</strong>d end on the dates according to the Training agreement.<br />
Fin<strong>an</strong>ce<br />
The amount of the gr<strong>an</strong>t is determined according to the rules <strong>an</strong>d regulations of the Life Long Learning<br />
Programme. The payment is to be made to the beneficiary as soon as the gr<strong>an</strong>t has been approved <strong>an</strong>d<br />
assigned.<br />
Final report<br />
The beneficiary shall submit the final report using the official <strong>for</strong>ms after the end of the <strong>Placement</strong>.<br />
Law applicable <strong>an</strong>d competent court<br />
The gr<strong>an</strong>t is governed by the terms of the contract, the Community rules applicable <strong>an</strong>d, on a subsidiary<br />
basis, by the law of Sweden relating to gr<strong>an</strong>ts. The beneficiary may bring legal proceedings regarding<br />
decisions by the institution concerning the application of the provisions of the contract <strong>an</strong>d the<br />
arr<strong>an</strong>gements <strong>for</strong> implementing it be<strong>for</strong>e the competent Court in accord<strong>an</strong>ce with the applicable<br />
national law.<br />

<strong>Erasmus</strong> <strong>Placement</strong> - Quality commitment<br />
I. Quality Commitment <strong>for</strong> <strong>Erasmus</strong> Student <strong>placement</strong><br />
This Quality Commitment replicates the principles of the Europe<strong>an</strong> Quality Charter <strong>for</strong> Mobility<br />
Annex II<br />
Mid Sweden University undertakes to:<br />
• Define the learning outcomes of the <strong>placement</strong> in terms of the knowledge, skills <strong>an</strong>d competencies to be<br />
acquired.<br />
• Assist the <strong>student</strong> in choosing the appropriate host org<strong>an</strong>isation, project duration <strong>an</strong>d <strong>placement</strong> content to<br />
achieve these learning outcomes.<br />
• Select <strong>student</strong>s on the basis of clearly defined <strong>an</strong>d tr<strong>an</strong>sparent criteria <strong>an</strong>d procedures <strong>an</strong>d sign a <strong>placement</strong><br />
contract with the selected <strong>student</strong>s.<br />
• Help <strong>student</strong>s to prepare <strong>for</strong> the practical, professional <strong>an</strong>d cultural life of the host country.<br />
• Give full recognition to the <strong>student</strong> <strong>for</strong> satisfactory completed activities specified in the Training Agreement<br />
• Evaluate with each <strong>student</strong> the personal <strong>an</strong>d professional development achieved through participation in the<br />
<strong>Erasmus</strong> programme.<br />
Mid Sweden University <strong>an</strong>d the host org<strong>an</strong>isasation jointly undertakes to:<br />
• Negotiate <strong>an</strong>d agree a tailor-made Training Agreement (including the programme of the <strong>placement</strong> <strong>an</strong>d the<br />
recognition arr<strong>an</strong>gements) <strong>for</strong> each <strong>student</strong> <strong>an</strong>d the adequate mentoring arr<strong>an</strong>gements.<br />
• Monitor the progress of the <strong>placement</strong> <strong>an</strong>d take appropriate action if required.<br />
The host org<strong>an</strong>isation undertakes to:<br />
• Assign to <strong>student</strong>s tasks <strong>an</strong>d responsibilities (as stipulated in the Training Agreement) to match their<br />
knowledge, skills, competencies <strong>an</strong>d training objectives <strong>an</strong>d ensure that appropriate equipment <strong>an</strong>d support is<br />
available.<br />
• Draw a contract or equivalent document <strong>for</strong> the <strong>placement</strong> in accord<strong>an</strong>ce with the requirements of the<br />
national legislation.<br />
• Appoint a mentor to advise the <strong>student</strong>, <strong>an</strong>d help the <strong>student</strong> with the integration in the host environment <strong>an</strong>d<br />
monitor the training progress.<br />
• Provide practical support if required, check appropriate insur<strong>an</strong>ce cover <strong>an</strong>d facilitate underst<strong>an</strong>ding of the<br />
culture of the host country.<br />
The Student undertakes to:<br />
• Comply with all arr<strong>an</strong>gements negotiated <strong>for</strong> his/her <strong>placement</strong> <strong>an</strong>d to do his/her best to make the <strong>placement</strong><br />
a success.<br />
• Abide by the rules <strong>an</strong>d regulations of the host org<strong>an</strong>isation, its normal working hours, code of conduct <strong>an</strong>d<br />
rules of confidentiality.<br />
• Communicate with the sending institution about <strong>an</strong>y problem or ch<strong>an</strong>ges regarding the <strong>placement</strong>.<br />
• Submit a report in the specified <strong>for</strong>mat <strong>an</strong>d <strong>an</strong>y required supporting documents at the end of the <strong>placement</strong>.<br />
II. Commitment of the three parties<br />
By signing this document the <strong>student</strong>, the sending institution <strong>an</strong>d the host org<strong>an</strong>isation confirm that they will abide by<br />
the principles of the Quality Commitment <strong>for</strong> <strong>Erasmus</strong> <strong>student</strong> <strong>placement</strong>s (I) set out in this document.<br />

General Conditions<br />
Article 1: Liability<br />
Each contracting party shall exonerate the other from <strong>an</strong>y<br />
civil liability <strong>for</strong> damages suffered by him or his staff as a<br />
result of per<strong>for</strong>m<strong>an</strong>ce of this contract, provided such damages<br />
are not the result of serious <strong>an</strong>d deliberate misconduct on the<br />
part of the other party or his staff.<br />
The National Agency of Sweden, the Europe<strong>an</strong> Commission<br />
or their staff shall not be held liable in the event of a claim<br />
under the contract relating to <strong>an</strong>y damage caused during the<br />
execution of the <strong>placement</strong>. Consequently, the National<br />
Agency of Sveden or the Europe<strong>an</strong> Commission shall not<br />
entertain <strong>an</strong>y request <strong>for</strong> indemnity of reimbursement<br />
accomp<strong>an</strong>ying such claim.<br />
Article 2: Termination of the contract<br />
In the event of failure by the beneficiary to per<strong>for</strong>m <strong>an</strong>y of<br />
the obligations arising from the contract, <strong>an</strong>d regardless of<br />
the consequences provided <strong>for</strong> under the applicable law, the<br />
institution is legally entitled to terminate or c<strong>an</strong>cel the<br />
contract without <strong>an</strong>y further legal <strong>for</strong>mality where no action<br />
is taken by the beneficiary within one month of receiving<br />
notification by registered letter.<br />
If the beneficiary terminates the contract be<strong>for</strong>e its<br />
contractual end or if he/she fails to follow the contract in<br />
accord<strong>an</strong>ce with the rules, he/she will have to refund the<br />
amount of the gr<strong>an</strong>t already paid.<br />
In case of termination by the beneficiary due to "<strong>for</strong>ce<br />
majeure", i.e. <strong>an</strong> un<strong>for</strong>eseeable exceptional situation or event<br />
beyond the beneficiary's control <strong>an</strong>d not attributable to error<br />
or negligence on his/her part, the beneficiary will be entitled<br />
to receive the amount of the gr<strong>an</strong>t corresponding to the actual<br />
time of the <strong>placement</strong>. Any remaining funds will have to be<br />
refunded.<br />
Article 3: Data Protection<br />
All personal data contained in the contract shall be processed<br />
in accord<strong>an</strong>ce with Regulation (EC) No 45/2001 of the<br />

Annex III<br />
Europe<strong>an</strong> Parliament <strong>an</strong>d of the Council on the protection of<br />
individuals with regard to the processing of personal data by<br />
the Community institutions <strong>an</strong>d bodies <strong>an</strong>d on the free<br />
movement of such data. Such data shall be processed solely<br />
in connection with the implementation <strong>an</strong>d follow-up of the<br />
contract by the sending institution, the National Agency <strong>an</strong>d<br />
the Europe<strong>an</strong> Commission, without prejudice to the<br />
possibility of passing the data to the bodies responsible <strong>for</strong><br />
inspection <strong>an</strong>d audit in accord<strong>an</strong>ce with Community<br />
legislation (Court of Auditors or Europe<strong>an</strong> Antifraud Office<br />
(OLAF)).<br />
The beneficiary may, on written request, gain access to his<br />
personal data <strong>an</strong>d correct <strong>an</strong>y in<strong>for</strong>mation that is inaccurate or<br />
incomplete. He/she should address <strong>an</strong>y questions regarding<br />
the processing of his/her personal data to the sending<br />
institution <strong>an</strong>d/or the National Agency. The particip<strong>an</strong>t may<br />
lodge a complaint against the processing of his personal data<br />
with the national supervising body <strong>for</strong> data protection with<br />
regard to the use of these data by the sending institution, the<br />
National Agency, or to the Europe<strong>an</strong> Data Protection<br />
Supervisor with regard to the use of the data by the Europe<strong>an</strong><br />
Commission.<br />
Article 4: Checks <strong>an</strong>d Audits<br />
The parties of the contract undertake to provide <strong>an</strong>y detailed<br />
in<strong>for</strong>mation requested by the Europe<strong>an</strong> Commission, the<br />
National Agency of Sweden or by <strong>an</strong>y other outside body<br />
authorised by the Europe<strong>an</strong> Commission or the National<br />
Agency of Sweden to check that the <strong>Placement</strong> <strong>an</strong>d the<br />
provisions of the contract are being properly implemented
