. Non-consensual sexual <strong>in</strong>tercourse <strong>in</strong>clud<strong>in</strong>g, but not limited to, anal, oral or<br />

vag<strong>in</strong>al penetration, however slight.<br />

c. Sexually related <strong>of</strong>fenses <strong>in</strong>clud<strong>in</strong>g, but not limited to, obscene, <strong>in</strong>decent behavior<br />

and/or exposure.<br />

21. Violation <strong>of</strong> any <strong>Georgia</strong> Institute <strong>of</strong> <strong>Tech</strong>nology policy, rule, or regulation.<br />

22. Violation <strong>of</strong> any Board <strong>of</strong> Regents policy and/or federal, state, or local law.<br />

D. STUDENT CODE OF CONDUCT PROCEDURES<br />

1. Case Referrals<br />

Any person may file a compla<strong>in</strong>t aga<strong>in</strong>st a <strong>Student</strong> for violations <strong>of</strong> <strong>the</strong> <strong>Student</strong> <strong>Code</strong> <strong>of</strong><br />

<strong>Conduct</strong>. The compla<strong>in</strong>t shall be prepared <strong>in</strong> writ<strong>in</strong>g and directed to OSI or, <strong>in</strong> academic<br />

cases, <strong>the</strong> <strong>in</strong>structor <strong>of</strong> record may hold a <strong>Faculty</strong> Conference (see Section D.5.c.). The<br />

procedures for fil<strong>in</strong>g a compla<strong>in</strong>t can be found on <strong>the</strong> OSI Web site as listed <strong>in</strong> <strong>the</strong><br />

References. This compla<strong>in</strong>t should be submitted as soon as possible after <strong>the</strong> event takes<br />

place or when it is reasonably discovered, no later than thirty (30) Bus<strong>in</strong>ess Days<br />

follow<strong>in</strong>g <strong>the</strong> discovery <strong>of</strong> <strong>the</strong> <strong>in</strong>cident. In extraord<strong>in</strong>ary circumstances, OSI may waive<br />

this timel<strong>in</strong>e.<br />

2. Communication<br />

All communication (requests for meet<strong>in</strong>gs, notifications, notice <strong>of</strong> hear<strong>in</strong>gs, etc.) will be<br />

provided via <strong>the</strong> <strong>of</strong>ficial Institute e-mail address, as def<strong>in</strong>ed by <strong>the</strong> Office <strong>of</strong> Information<br />

<strong>Tech</strong>nology. If <strong>the</strong> Accused is not currently enrolled, <strong>the</strong> notification will be sent via US<br />

Postal Service to <strong>the</strong> last known address on file with <strong>the</strong> Registrar.<br />

3. Rights <strong>of</strong> <strong>the</strong> Accused<br />

Throughout <strong>the</strong> <strong>Conduct</strong> process, <strong>the</strong> Accused is granted <strong>the</strong> follow<strong>in</strong>g rights:<br />

a. to seek <strong>in</strong>formation from a <strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator about <strong>the</strong> Investigation<br />

and Resolution Process;<br />

b. to be <strong>in</strong>formed <strong>of</strong> <strong>the</strong> charge(s) and alleged misconduct upon which <strong>the</strong> charge is<br />

based;<br />

c. to be <strong>in</strong>formed <strong>of</strong> <strong>the</strong> Information upon which a charge is based and afforded an<br />

opportunity to <strong>of</strong>fer a relevant response;<br />

d. to be accompanied by an Advisor <strong>of</strong> his/her choice;<br />

e. to rema<strong>in</strong> silent with no <strong>in</strong>ference <strong>of</strong> responsibility drawn;<br />

f. to call and question relevant Witnesses;<br />

g. to present Information <strong>in</strong> his/her behalf;<br />

h. to be considered not responsible until proven responsible by a Preponderance <strong>of</strong><br />

<strong>the</strong> Evidence;<br />

i. to appeal <strong>the</strong> decision;<br />
