(10) bBus<strong>in</strong>ess dDays ei<strong>the</strong>r <strong>in</strong> person, or <strong>in</strong> accordance with <strong>the</strong> communication<br />

guidel<strong>in</strong>es <strong>in</strong> Section D.2. At <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> Appellate Officer, a designee may be<br />

selected to determ<strong>in</strong>e <strong>the</strong> outcome <strong>of</strong> <strong>the</strong> appeal. The Appellate Officers are as follows:<br />

a. For all low-level cases: <strong>the</strong> Dean <strong>of</strong> <strong>Student</strong>s.<br />

b. For high-level academic cases: <strong>the</strong> Vice Provost for Undergraduate Studies and<br />

Academic Affairs <strong>in</strong> conjunction with <strong>the</strong> Office <strong>of</strong> <strong>the</strong> Dean <strong>of</strong> <strong>Student</strong>s.<br />

c. For high-level non-academic cases: <strong>the</strong> Vice President for <strong>Student</strong> Affairs.<br />

For all decisions made by <strong>the</strong> Office <strong>Student</strong> Integrity, <strong>the</strong> Appellate Officer shall be <strong>the</strong><br />

Dean <strong>of</strong> <strong>Student</strong>s.<br />

For all academic cases where <strong>the</strong> sanction <strong>in</strong>cludes Suspension or Expulsion, once an<br />

appeal decision has been made by <strong>the</strong> Dean <strong>of</strong> <strong>Student</strong>s, <strong>the</strong> Appellate Officer shall be <strong>the</strong><br />

Institute President. The Senior Vice Provost <strong>of</strong> Academic Affairs will review <strong>the</strong> case<br />

and make a recommendation to <strong>the</strong> Institute President. The Institute President’s decision<br />

will be <strong>the</strong> f<strong>in</strong>al decision <strong>of</strong> <strong>the</strong> Institute.<br />

For all non-academic cases where <strong>the</strong> sanction <strong>in</strong>cludes Suspension or Expulsion, once an<br />

appeal decision has been made by <strong>the</strong> Dean <strong>of</strong> <strong>Student</strong>s, <strong>the</strong> Appellate Officer shall be <strong>the</strong><br />

Institute President. The Vice President for <strong>Student</strong> Affairs will review <strong>the</strong> case and make<br />

a recommendation to <strong>the</strong> Institute President. The Institute President’s decision will be <strong>the</strong><br />

f<strong>in</strong>al decision <strong>of</strong> <strong>the</strong> Institute.<br />

3. Appeal Decisions<br />

Decisions <strong>of</strong> <strong>the</strong> Appellate Officer go <strong>in</strong>to effect immediately. The Appellate Officer is<br />

authorized to take one <strong>of</strong> <strong>the</strong> follow<strong>in</strong>g actions:<br />

a. dismiss <strong>the</strong> appeal for failure to state valid reasons, <strong>in</strong> accordance with Section<br />

G.1.<br />

b. f<strong>in</strong>d no error and uphold <strong>the</strong> orig<strong>in</strong>al decision;<br />

c. uphold <strong>the</strong> orig<strong>in</strong>al decision, but modify Sanctions and Supplementary<br />

Requirements;<br />

d. remand <strong>the</strong> case to <strong>the</strong> orig<strong>in</strong>al a <strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator or <strong>Student</strong><br />

<strong>Conduct</strong> Panel; or<br />

e. reverse <strong>the</strong> orig<strong>in</strong>al decision.<br />

4. Board <strong>of</strong> Regents<br />

The Board <strong>of</strong> Regents <strong>of</strong> <strong>the</strong> University System <strong>of</strong> <strong>Georgia</strong> (<strong>the</strong> "Board") is <strong>the</strong> f<strong>in</strong>al<br />

appellate authority for all cases <strong>of</strong> Suspension or Expulsion that have been reviewed by<br />

<strong>the</strong> Institute President. Should <strong>the</strong> Accused be dissatisfied with <strong>the</strong> decision <strong>of</strong> an <strong>the</strong><br />

Institute Appellate Officer President, he/she may apply to <strong>the</strong> Board for a review <strong>of</strong> <strong>the</strong><br />

decision. The application for review shall be submitted <strong>in</strong> writ<strong>in</strong>g to <strong>the</strong> executive<br />

secretary <strong>of</strong> <strong>the</strong> Board with<strong>in</strong> <strong>the</strong> period specified by <strong>the</strong> Board <strong>of</strong> Regents.<br />
