A maximum <strong>of</strong> two (2) character Witnesses will be allowed <strong>in</strong> a<br />
hear<strong>in</strong>g.<br />
5. Hear<strong>in</strong>g Procedures<br />
The Chairperson shall exercise control over <strong>the</strong> proceed<strong>in</strong>gs to<br />
achieve orderly completion <strong>of</strong> <strong>the</strong> hear<strong>in</strong>g.<br />
Advisors are restricted to private communications with <strong>the</strong>ir<br />
advisee(s). Any communication by <strong>the</strong> Advisor that is audible to<br />
<strong>the</strong> <strong>Student</strong> <strong>Conduct</strong> Panel may be viewed by <strong>the</strong> Chairperson as<br />
disrupt<strong>in</strong>g <strong>the</strong> hear<strong>in</strong>g.<br />
All questions by <strong>the</strong> Compla<strong>in</strong>ant(s) and Accused must be directed<br />
to <strong>the</strong> Chairperson, ra<strong>the</strong>r than to <strong>the</strong> Witness directly. Questions<br />
<strong>of</strong> whe<strong>the</strong>r potential Information will be received shall be resolved<br />
at <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> Chairperson.<br />
In addition to <strong>the</strong> <strong>in</strong>vestigatory packet provided by OSI, <strong>the</strong><br />
<strong>Student</strong> <strong>Conduct</strong> Panel, at <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> Chairperson, may<br />
accept additional pert<strong>in</strong>ent Information and testimony (<strong>in</strong>clud<strong>in</strong>g<br />
impact statements). Any letters <strong>of</strong> recommendation submitted by<br />
<strong>the</strong> Accused will be admitted for consideration at <strong>the</strong> discretion <strong>of</strong><br />
<strong>the</strong> Chairperson and, if admitted, will be viewed only dur<strong>in</strong>g Panel<br />
deliberations.<br />
All procedural questions aris<strong>in</strong>g dur<strong>in</strong>g <strong>the</strong> hear<strong>in</strong>g are subject to<br />
<strong>the</strong> f<strong>in</strong>al decision <strong>of</strong> <strong>the</strong> Chairperson.<br />
The <strong>Student</strong> <strong>Conduct</strong> Panel’s standard <strong>of</strong> pro<strong>of</strong> shall be a<br />
Preponderance <strong>of</strong> <strong>the</strong> Evidence.<br />
The <strong>Student</strong> <strong>Conduct</strong> Panel <strong>in</strong> consultation with OSI, may<br />
reasonably accommodate concerns for <strong>the</strong> personal safety, wellbe<strong>in</strong>g,<br />
and/or fears <strong>of</strong> confrontation <strong>of</strong> <strong>the</strong> Compla<strong>in</strong>ant(s),<br />
Accused, and/or Witnesses dur<strong>in</strong>g <strong>the</strong> hear<strong>in</strong>g.<br />
The <strong>Student</strong> <strong>Conduct</strong> Panel shall make a record<strong>in</strong>g and/or<br />
summary transcription <strong>of</strong> <strong>the</strong> proceed<strong>in</strong>g, which will serve as <strong>the</strong><br />
<strong>of</strong>ficial record <strong>of</strong> <strong>the</strong> hear<strong>in</strong>g. No o<strong>the</strong>r record<strong>in</strong>g will be permitted.<br />
The Accused or <strong>the</strong> Compla<strong>in</strong>ant may request a copy <strong>of</strong> <strong>the</strong><br />
Institute's record<strong>in</strong>g upon payment <strong>of</strong> <strong>the</strong> cost to reproduce <strong>the</strong><br />
record<strong>in</strong>g, or may listen to <strong>the</strong> orig<strong>in</strong>al record<strong>in</strong>g <strong>in</strong> a location<br />
designated by OSI at no charge. The record shall be <strong>the</strong> property <strong>of</strong><br />
<strong>the</strong> Institute.<br />
c. <strong>Faculty</strong> Conference (optional academic case resolution)<br />
A faculty conference is an optional way <strong>in</strong> which an alleged act <strong>of</strong> academic<br />
misconduct can be resolved.<br />
