<strong>of</strong> <strong>Conduct</strong> with an appropriate Sanction and, as warranted, one or more<br />

from among <strong>the</strong> Supplementary Requirements. The Accused, after be<strong>in</strong>g<br />

notified <strong>of</strong> <strong>the</strong> decision and Sanction, may appeal to <strong>the</strong> Vice President for<br />

<strong>Student</strong> Affairs Dean <strong>of</strong> <strong>Student</strong>s, accord<strong>in</strong>g to appeal procedures<br />

described <strong>in</strong> Section G.<br />

3. Schedul<strong>in</strong>g <strong>of</strong> <strong>Student</strong> <strong>Conduct</strong> Panel Hear<strong>in</strong>g<br />

After <strong>the</strong> case is forwarded to a <strong>Student</strong> <strong>Conduct</strong> Panel, <strong>the</strong><br />

Compla<strong>in</strong>ant(s) and <strong>the</strong> Accused will be notified <strong>of</strong> available dates and<br />

times for a hear<strong>in</strong>g. The Accused may <strong>in</strong>dicate preferences from among<br />

<strong>the</strong> available dates and times, which will be considered by OSI if received<br />

with<strong>in</strong> three (3) Bus<strong>in</strong>ess Days. This <strong>of</strong>ficial notice will be provided at<br />

least five (5) Bus<strong>in</strong>ess Days prior to <strong>the</strong> hear<strong>in</strong>g and will <strong>in</strong>clude <strong>the</strong> time,<br />

date, and location <strong>of</strong> <strong>the</strong> hear<strong>in</strong>g. In addition, <strong>the</strong> notice will specify <strong>the</strong><br />

Compla<strong>in</strong>ant(s), Witnesses(s), and nature <strong>of</strong> <strong>the</strong> alleged misconduct.<br />

Accused may waive <strong>the</strong> notification timel<strong>in</strong>e <strong>in</strong> order to expedite <strong>the</strong><br />

hear<strong>in</strong>g process. Upon request, <strong>the</strong> Accused may meet with a <strong>Student</strong><br />

<strong>Conduct</strong> Adm<strong>in</strong>istrator to review Information and hear<strong>in</strong>g procedures.<br />

4. Hear<strong>in</strong>g Participants and Attendees<br />

<strong>Student</strong> <strong>Conduct</strong> Panel hear<strong>in</strong>gs shall ord<strong>in</strong>arily be closed except<br />

for <strong>the</strong> Accused, <strong>the</strong> Compla<strong>in</strong>ant(s), Advisor(s), and Witnesses.<br />

Exceptions may be made at <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> Chairperson.<br />

Witnesses are allowed at <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> Chairperson. The<br />

Chairperson may exclude any person, <strong>in</strong>clud<strong>in</strong>g <strong>the</strong> Accused, who<br />

disrupts a hear<strong>in</strong>g.<br />

An Accused <strong>Student</strong> who fails to appear after proper notice will be<br />

deemed to have responded "Not Responsible" to <strong>the</strong> charges<br />

aga<strong>in</strong>st him/her and to have exercised <strong>the</strong> right to rema<strong>in</strong> silent<br />

without prejudice. At <strong>the</strong> discretion <strong>of</strong> <strong>the</strong> Chairperson <strong>the</strong> hear<strong>in</strong>g<br />

may be conducted <strong>in</strong> <strong>the</strong> absence <strong>of</strong> <strong>the</strong> Accused and all <strong>the</strong><br />

Information regard<strong>in</strong>g <strong>the</strong> alleged misconduct shall be presented<br />

and considered.<br />

The Compla<strong>in</strong>ant(s) and Accused have <strong>the</strong> right to be accompanied<br />

by an Advisor. The Compla<strong>in</strong>ant(s) and/or Accused should select<br />

an Advisor who can attend <strong>the</strong> hear<strong>in</strong>g at <strong>the</strong> scheduled date and<br />

time. Delays are not usually granted due to schedul<strong>in</strong>g conflicts <strong>of</strong><br />

an Advisor.<br />

Subject to <strong>the</strong> Chairperson’s control <strong>of</strong> <strong>the</strong> hear<strong>in</strong>g, <strong>the</strong><br />

Compla<strong>in</strong>ant(s), Accused and <strong>the</strong>ir Advisors, shall be allowed to<br />

attend <strong>the</strong> <strong>Student</strong> <strong>Conduct</strong> Panel hear<strong>in</strong>g, but shall not be allowed<br />

to attend Panel deliberations.<br />

In <strong>Student</strong> <strong>Conduct</strong> Panel hear<strong>in</strong>gs <strong>in</strong>volv<strong>in</strong>g more than one<br />

Accused, OSI may permit <strong>the</strong> <strong>Student</strong> <strong>Conduct</strong> Panel hear<strong>in</strong>gs<br />
