preference will be honored. However, OSI reserves <strong>the</strong> right to determ<strong>in</strong>e <strong>the</strong><br />

process to be used based on <strong>the</strong> circumstances, <strong>in</strong>clud<strong>in</strong>g but not limited to:<br />

i) imm<strong>in</strong>ent graduation <strong>of</strong> <strong>the</strong> <strong>Student</strong><br />

ii) end <strong>of</strong> semester<br />

iii) extraord<strong>in</strong>ary circumstances<br />

A decision <strong>of</strong> OSI not to honor <strong>the</strong> <strong>Student</strong>’s preference shall require <strong>the</strong> consent<br />

<strong>of</strong> <strong>the</strong> Dean <strong>of</strong> <strong>Student</strong>s. The <strong>Student</strong> may convey <strong>the</strong> reasons for his/her<br />

preference <strong>in</strong> verbal or written form to <strong>the</strong> Dean <strong>of</strong> <strong>Student</strong>s. If <strong>the</strong> <strong>Student</strong>’s<br />

preference is not honored, <strong>the</strong> rationale for such will be provided to <strong>the</strong> <strong>Student</strong> <strong>in</strong><br />

writ<strong>in</strong>g.<br />

c. If <strong>the</strong> case is adjudicated by <strong>the</strong> <strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator, <strong>the</strong> The <strong>Student</strong><br />

<strong>Conduct</strong> Adm<strong>in</strong>istrator <strong>of</strong>fers <strong>the</strong> Accused <strong>the</strong> opportunity to provide his/her<br />

statement regard<strong>in</strong>g <strong>the</strong> alleged misconduct, support<strong>in</strong>g Information, and<br />

Witnesses. The Accused may br<strong>in</strong>g an Advisor, however if <strong>the</strong> Advisor disrupts<br />

<strong>the</strong> <strong>in</strong>vestigation and resolution process, he/she may be asked to leave. The<br />

<strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator cont<strong>in</strong>ues <strong>the</strong> <strong>in</strong>vestigation as necessary by<br />

meet<strong>in</strong>g with <strong>the</strong> Compla<strong>in</strong>ant(s), and Witnesses and ga<strong>the</strong>r<strong>in</strong>g additional<br />

Information. The <strong>in</strong>vestigation will be completed <strong>in</strong> an expeditious fashion. If <strong>the</strong><br />

<strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator determ<strong>in</strong>es that a Witness (<strong>in</strong>clud<strong>in</strong>g faculty or<br />

staff) may have relevant Information, s/he will make a good faith effort to contact<br />

such Witnesses to obta<strong>in</strong> a statement from <strong>the</strong>m. The <strong>in</strong>vestigation will be<br />

completed <strong>in</strong> an expeditious fashion. Upon conclusion <strong>of</strong> <strong>the</strong> <strong>in</strong>vestigation, <strong>the</strong><br />

<strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator will render a decision, which will be<br />

communicated to <strong>the</strong> <strong>Student</strong> via <strong>the</strong> <strong>Student</strong>’s Institute email address.<br />

d. If <strong>the</strong> case is to be adjudicated by a <strong>Student</strong> <strong>Conduct</strong> Panel, <strong>the</strong> case shall be<br />

referred to <strong>the</strong> <strong>Student</strong> <strong>Conduct</strong> Panel and follow <strong>the</strong> procedures outl<strong>in</strong>ed <strong>in</strong><br />

Section D.5.b.<br />

c. The <strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator cont<strong>in</strong>ues <strong>the</strong> <strong>in</strong>vestigation by meet<strong>in</strong>g with<br />

<strong>the</strong> Compla<strong>in</strong>ant(s), and Witnesses and ga<strong>the</strong>r<strong>in</strong>g additional Information. The<br />

<strong>in</strong>vestigation will be completed <strong>in</strong> an expeditious fashion.<br />

d. Upon <strong>the</strong> conclusion <strong>of</strong> <strong>the</strong> <strong>in</strong>vestigation, <strong>the</strong> <strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator will<br />

determ<strong>in</strong>e <strong>the</strong> level <strong>of</strong> <strong>the</strong> case (Low or High). If <strong>the</strong> case is determ<strong>in</strong>ed to be<br />

Low, <strong>the</strong> <strong>Student</strong> <strong>Conduct</strong> Adm<strong>in</strong>istrator will render a decision <strong>in</strong> accordance<br />

with Section D.5.a. If <strong>the</strong> case is determ<strong>in</strong>ed to be High, <strong>the</strong> <strong>Student</strong> <strong>Conduct</strong><br />

Adm<strong>in</strong>istrator may choose to have <strong>the</strong> case heard by a <strong>Student</strong> <strong>Conduct</strong> Panel;<br />

o<strong>the</strong>rwise <strong>the</strong> Accused chooses one <strong>of</strong> <strong>the</strong> two follow<strong>in</strong>g forms <strong>of</strong> case resolution<br />

1) Adm<strong>in</strong>istrative (see D.5.a.) or 2) <strong>Student</strong> <strong>Conduct</strong> Panel (see D.5.b) with<strong>in</strong> 48<br />

hours.<br />

e. The Accused shall submit a list <strong>of</strong> desired Witnesses to <strong>the</strong> <strong>Student</strong> <strong>Conduct</strong><br />

Adm<strong>in</strong>istrator at <strong>the</strong> conclusion <strong>of</strong> <strong>the</strong> <strong>in</strong>vestigation or no later than 48 hours prior<br />

to <strong>the</strong> scheduled hear<strong>in</strong>g.<br />
